Minutes of Commissioners Meeting   -   December 27, 2017

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by e-mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on December 1, 2016.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mrs. Gould motioned, seconded by Mr. Groon, that Ordinance 1262 be placed on second and final passage by title only.

THE CLERK READS THE FOLLOWING ORDINANCE BY TITLE:

ORDINANCE NO. 1262

AN ORDINANCE TO AMEND SECTION 59‑3 OF THE CODE OF THE BOROUGH

OF WILDWOOD CREST, KNOWN AS THE “SALARY ORDINANCE," FIXING AND

DETERMINING SALARIES AND COMPENSATIONS OF THE BOROUGH OF WILDWOOD

CREST, IN THE COUNTY OF CAPE MAY, NEW JERSEY, PROVIDING FOR THE

RAISING OF THE AMOUNTS THEREOF BY TAXATION AND FOR THE TIME AND

METHOD OF PAYMENT

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that a public hearing now be held on Ordinance No. 1262.

Mrs. Gould then motioned, seconded by Mr. Cabrera, that the public hearing on Ordinance No. 1262 now be closed.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1082-17

WHEREAS, N.J.S.A. 40A:4-58 permits transfers between budget appropriations during the final two (2) months of the fiscal year;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that transfers between 2017

 budget appropriations be and the same are hereby authorized as follows:

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1083-17

Authorizing Grant Agreement between the Borough of Wildwood Crest and

State of New Jersey

By and For

The Department of Environmental Protection

Grant Identifier: FS18-003

 

WHEREAS, the Governing Body of the Borough of Wildwood Crest desires to further the public interest by obtaining a grant from the State of New Jersey in the amount, for up to $3,000.00 to fund the following project: NJFS Urban and Community Forestry Program Green Communities Grant.

THEREFORE, the Governing Body resolves that Constance A. Mahon of the successor to the office of Business Administrator is authorized (a) to make application for such a grant, (b) if awarded, to execute a grant agreement with the State for a grant in an amount not less than $0.00 and not more than $3,000.00, and (c) to execute ___ any amendments thereto _x_ any amendments thereto which do not increase the Grantee’s obligations.

The Board of Commissioners authorizes and hereby agrees to match ­50% of the Total Project Amount, in compliance with the match requirements of the agreement.  The availability of the match for such purposes, whether cash, services, or property, is hereby certified.  100% of the match will be made up of in-kind services (if allowed by grant program requirements and the agreement).

The Grantee agrees to comply with all applicable Federal, State, and municipal laws, rules, and regulations in its performance pursuant to the agreement.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1084-17

WHEREAS, WILDWOOD CATHOLIC HIGH SCHOOL, 1500 Central Avenue, North Wildwood, New Jersey 08260, has requested the entering into of a Lease Agreement with the Borough of Wildwood Crest for the rental of the Joseph Von Savage Memorial Pool during specifically designated days and times for one swim season (2017-2018) and at a term rental of $4,000.00; and

 

WHEREAS, the Board of Commissioners are desirous of permitting the utilization of Borough-owned facilities through the establishment of a reasonable fee schedule to promote, encourage, and foster greater participation in the Borough’s recreational activities by all facets of the community; and

 

WHEREAS, the Board of Commissioners does herewith agree to enter into a lease agreement with WILDWOOD CATHOLIC HIGH SCHOOL for the rental of the Joseph Von Savage Memorial Pool.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, as follows:

 

1.                   That the allegations of the preamble are incorporated herein as if fully set forth.

2.                   That a lease by and between the Borough of Wildwood Crest (Landlord) and Wildwood Catholic High School (tenant) for the rental of the Joseph Von Savage Memorial Pool, situated at 8800 New Jersey Avenue, Wildwood Crest, New Jersey 08260, for the period commencing effective November 1, 2017 and terminating March 31, 2018 at the term rental of $4,000.00.  The foregoing payment schedule, the days and hours of permitted use, and all other conditions, which shall affect, change or modify this rental shall be contained in said lease, a copy of which is attached hereto and made a part hereof.

3.                   The Mayor and the Borough Clerk be and they are hereby authorized and directed to execute and attest said lease on behalf of the Borough.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1085-17

AUTHORIZING A LEASE AGREEMENT BETWEEN

BOROUGH OF WILDWOOD CREST AND

WILDWOOD CREST DOLPHINS SWIM TEAM

 

WHEREAS, on November 25, 2015, the Wildwood Crest Dolphins Swim Team agreed to lease the Joseph Von Savage Pool for a four year term from January 1, 2014 through December 31, 2017; and

 

WHEREAS, on April 6, 2016, via Resolution No. 670-16, the terms of the lease agreement stipulate the tenant agrees to pay a yearly fee of $6,500 as follows: $3,250.00 due on or before April 1st and $3,250.00 due on or before July 1st; and

 

WHEREAS, the Wildwood Crest Dolphins Swim Team would like to enter into an agreement for 2018 with the same payment terms: $3,250.00 due on or before April 1, 2018 and $3,250.00 due on or before July 1, 2018; and

 

WHEREAS, the Board of Commissioners does herewith agree to enter into a lease agreement with THE WILDWOOD CREST DOLPHINS SWIM TEAM for the rental of the Joseph Von Savage Memorial Pool for 2018.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, as follows:

 

1.                   That the allegations of the preamble are incorporated herein as if fully set forth.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1086-17

WHEREAS, the Borough of Wildwood Crest is desirous of displaying holiday decorative street lighting on certain streets with the Borough of Wildwood Crest utilizing certain facilities owned and maintained by Atlantic City Electric Company; and

WHEREAS, Atlantic City Electric Company requires execution of a Temporary Attachment and Holiday License Agreement in order to permit the Borough of Wildwood Crest to utilize said facilities;

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Commissioner of the Department of Public Works and the Borough Clerk should be, and they are hereby authorized to execute a “Temporary Attachment and Holiday License Agreement” by and between the Borough of Wildwood Crest and Atlantic City Electric Company and a copy of which Agreement is attached hereto and made a part hereof as if fully set forth herein.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1087-17

WHEREAS, on December 7, 2017 , NICOLE GONZALEZ , 324 Park Place, Apt 6 , Brooklyn, NY 11238 , applied for a Special Events Permit for the purpose of the GONZALEZ-THEOHARIS WEDDING   to be held on SEPTEMBER 29, 2018 ,  from 3:00 PM to 7:30 PM, at the SUNSET LAKE GAZEBO ; and

                                                                                                                                                         

WHEREAS,  NICOLE GONZALEZ , 324 Park Place, Apt 6 , Brooklyn, NY 11238 , has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  NICOLE GONZALEZ , 324 Park Place, Apt 6 , Brooklyn, NY 11238 for the purpose of the GONZALEZ-THEOHARIS WEDDING to be held on SEPTEMBER 29, 2018 , from 3:00 PM to 7:30 PM, at the SUNSET LAKE GAZEBO .

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1088-17

RESOLUTION REFUNDING 2018

TAXES FOR 100% DISABLED VETERAN

 

                WHEREAS, the below listed parcel was granted a 100% Totally Disabled Veteran Exemption on December 8th, 2017 and;

 

                WHEREAS, the property has been granted an exemption for all of the 2018 tax year, and said exemption has resulted in an overpayment,

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1089-17

 

WHEREAS, N.J.S.A. 54:5-11 requires that each municipality designate a person who shall make the “Certificate as to liability for assessment for municipal taxes and municipal improvements authorized but not assessed;” and

 

WHEREAS, the Board of Commissioners desire to make the aforesaid appointment.

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May and State of New Jersey that VICTORIA MASON, Tax Clerk, be and she is hereby appointed TAX SEARCH OFFICER of the Borough of Wildwood Crest to search the record of the Borough of Wildwood Crest, effective immediately, for unpaid municipal taxes and municipal improvements authorized but not assessed affecting premises situate within the said municipality, and to issue certificates as to liability for unpaid taxes and authorized improvements not assessed but owed to the Borough of Wildwood Crest; the salary for said appointment to be $1,600.00 in accordance with the provisions of the current Salary Ordinance of the Borough of Wildwood Crest.

Administrator’s Report:

 

December 27, 2017

 

SJ GAS Projects

The South Jersey Gas Grid 1 project is now complete and all punch list items have been completed as of Thursday, December 21, 2017.

 

Kayak Launch/ Sunset Lake Shoreline Stabilization

The Army Corps and NJDEP have issued permits for this project.  DEP approvals are conditional upon certain requirements.

An application for Cape May County Open Space Parks and Recreation Funding has been submitted for just over $300,000 to pay for recreational improvements including an ADA kayak/paddle board launch, fishing and observation pier and replacement pavilion as well as a drinking/filling station, some low level lighting, necessary concrete improvements and bike racks.   We should be hearing from the Open Space Board regarding a presentation before them in January or February with Freeholder consideration at their board meeting following the presentation and recommendation of the Open Space Board.

 

Beach/ Dune Project

Nothing new to report at this time.

 

Storm Drainage

Engineer will cover.

 

Rio Grande Avenue Gateway Improvement Project

Nothing new to report at this time.

 

I’d like to wish every a very happy holiday season and prosperous, healthy New Year.

 

ENGINEER’S REPORT:

 

The Engineer indicated that homeowners on Newark Avenue have been made aware of the intended reconstruction that will take place and that a five-year moratorium will be in effect after completion. 

 

PROCLAMATIONS: The Mayor and Commissioners and Chief of Police presented a Proclamation to the widow of Mr. Richard Grzeskiewicz. 

 

Commissioners Gould and Cabrera presented Mayor Carl Groon with a proclamation for serving three consecutive terms with distinction as Mayor.

 

Public Commentary: The Mayor opened the floor for public commentary. 

Nancy Pietropaoli, 6002 Seaview Avenue, wanted to congratulate Mayor Groon for always being fair, just and honest.  She thanked him for his service and wished him well.

 

Doreen Corino, Solicitor, acknowledged the service of Mayor Groon.  She indicated that working with Mayor Groon was always professional and it was her honor to do so.  She thanked the Governing Body as a whole.

 

Ed Grassi, 209 E. Stockton Road, asked about the process of how streets are prioritized with paving and infrastructure.  Commissioner Cabrera indicated that the Engineer is aware and hopefully in 2018 there will be a comprehensive sanitary sewer and master plan completed with a roadway condition plan to prioritize those streets.  They are looking at getting capital money as well.  Lastly, Commissioner Cabrera indicated that there are a few streets in desperate need as well. 

 

Chief Joseph McGrath told the Mayor it was an honor to work with him and he is always available.

 

Commissioner Cabrera extended well wishes to Mayor Groon and that it was honor to work with him for the past 12 years.

 

 

Hearing nothing further from the public, the Mayor opened new business.

 

New Business:  There was no new business to discuss.

 

Old Business:  There was no old business to discuss.

 

After opening the floor once more, and hearing nothing further from the public, Mrs. Gould motioned and Mr. Cabrera seconded that the meeting be adjourned.  All were in favor.  The time was 9:51 a.m.
