Minutes of Commissioners Meeting   -   August 2, 2017

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mrs. Gould read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by e-mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on December 1, 2016.

 

Mrs. Gould next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

THE CLERK READS THE FOLLOWING ORDINANCE BY TITLE:

ORDINANCE NO. 1258

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 36 – FLOOD HAZARD AREAS – OF THE CODE OF THE BOROUGH OF WILDWOOD CREST ADOPTED AS ORDINANCE NO. 1177 ON NOVEMBER 25, 2013 TO BRING INTO COMPLIANCE WITH NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION – BUREAU OF FLOOD CONTROL REGULATIONS

Mr. Cabrera motions, Mrs. Gould seconds that Ordinance No. 1258 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on August 16, 2017 at 5:30 p.m.

ORDINANCE NO. 1259

AN ORDINANCE AMENDING CHAPTER 46 – OFFICERS AND EMPLOYEES –SECTION 46-5.1 – GROUP INSURANCE- OF THE CODE OF THE BOROUGH OF WILDWOOD CREST ADOPTED AS ORDINANCE NO. 1201 ON DECEMBER 23, 2014

Mr. Cabrera motions, Mrs. Gould seconds that Ordinance No. 1259 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on August 16, 2017 at 5:30 p.m.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1010-17

SUBJECT:           A RESOLUTION AUTHORIZING APPROVAL OF CHANGE ORDER NUMBER 2 – RECONSTRUCTION OF PACIFIC AVENUE – CONTRACT NO. M-1

 

WHEREAS, Landberg Construction, LLC, of Mays Landing, New Jersey was awarded the contract known as Reconstruction of Pacific Avenue Contract No. M-1 via Resolution No. 927-17 on March 13, 2017; and

 

WHEREAS, additional work was performed by Landberg Construction, which included the installation of a detectable warning surface at the handicap ramp that was replaced at the Southwesterly intersection of Pacific Avenue and Lavender Road and while the additional curb and sidewalk work required at this location were paid for under bid items in the contract, there was no item for the detectable warning surface; and 

 

WHEREAS, additional work performed by Landberg Construction included the infrared repair of the hot mix asphalt course on Pacific Avenue in front of the Borough Fire House; and

 

WHEREAS, additional work performed by Landberg Construction included the removal of the existing stop bar on Heather Road as directed by the Borough; and

 

WHEREAS, as-built quantities for State sharing items results in a net reduction of $41,339.74; and

 

WHEREAS, as-built quantities for State Non-Sharing items results in a net reduction of $108,448.60.

 

NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, that said Change Order Number 2- Reconstruction of Pacific Avenue – Contract M-1- which results in a net reduction in the Contract Price of $147,288.34 and revised Contract Price of $1,148,954.41 and the same is hereby approved.

 

AND BE IT FURTHER RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, as follows:

 

  1. That the allegations of the preamble hereto are incorporated hereby in reference as if fully set forth.
  2. That the Mayor and Borough Clerk of the Borough of Wildwood Crest be and they are hereby authorized and directed to execute and attest said change order documents on behalf of the Borough of Wildwood Crest.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1011-17

WHEREAS, the WILDWOOD CREST FIRE CO. #1 made application on July 24, 2017 for a Raffles License under Application No. RA-108; and

 

WHEREAS, it is the desire of the Board of Commissioners of the Borough of Wildwood Crest to issue a Certificate of Approval under Application No. RA-108 to WILDWOOD CREST FIRE CO. #1 for holding of said Raffle;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, State of New Jersey, as follows:

 

          1.  That the Board issue to the WILDWOOD CREST FIRE CO. #1 a Certificate of Findings and Determination to be signed by the proper officer of said Board of Commissioners under Application No. RA-108 made by said WILDWOOD CREST FIRE CO. #1; and

 

          2. That the Municipal Clerk of the Borough of Wildwood Crest be, and she is hereby authorized, empowered and directed to cause the proper Raffle License to be issued to the WILDWOOD CREST FIRE CO. #1 in accordance with the application made therefor.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1012-17

CANCELING ERRONEOUS 2017 SEWER RENTS

                WHEREAS, it has been determined by the Tax Collector of the Borough of Wildwood Crest, that a sewer account has been billed erroneous sewer rents for 2017.

 

                WHEREAS, sewer account 409-0, at 104 E. Lavender Rd. did not have a water meter installed for the year 2016, the sewer rents levied in 2017 should be canceled.

 

                WHEREAS, the Tax Collector of the Borough of Wildwood Crest has determined the said erroneous sewer rents should be canceled accordingly as indicated below.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1013-17

 

WHEREAS, South Jersey Gas Company submitted check number 91649 dated March 6, 2017 in the amount of $250.00 as payment for a street opening permit at 8705 Pacific Ave., a/k/a blk 152, lot 182; and

 

WHEREAS, it was later determined that this location is a County Road and lies outside of the gas-line permitting authority of the borough; and

 

WHEREAS, South Jersey Gas company has requested a refund, and the Construction Official has approved such refund as reflected in Construction Department Resolution 17.01.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Chief Financial Officer be and is hereby authorized and directed to issue a refund of the balance of $250.00 to South Jersey Gas company, One South Jersey Plaza, Rt. 54, Folsom, NJ 08037.

WHEREAS, on July 21, 2017 , SERDY VIDEO 2 , 619 rue Le breton, Longueuil , J4G 2G9, Quebec Canada , applied for a Special Events Permit for the purpose of a TRAVEL TV SHOW SHOOT   to be held from AUGUST 11, 2017 to AUGUST 18, 2017 ,  from 8 AM to 8 PM, at VARIOUS LOCATIONS in the Borough of Wildwood Crest ; and

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

WHEREAS, on July 17, 2017 , TOM ORR , 3371 Church Rd, Gilbertsville , PA 19525 , applied for a Special Events Permit for the purpose of the ORR-WETHMAN WEDDING   to be held on OCTOBER 21, 2017 ,  from 11:00 AM to 1:00 PM, on the FORGET-ME-NOT RD BEACH ; and

                                                                                                                                                         

WHEREAS,  TOM ORR, 3371 Church Rd, Gilbertsville, PA 19525, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  TOM ORR , 3371 Church Rd, Gilbertsville, PA 19525 for the purpose of the ORR-WETHMAN WEDDING to be held on OCTOBER 21, 2017, from 11:00 AM to 1:00 PM, on the FORGET-ME-NOT RD BEACH.

WHEREAS, on July 27, 2017 , BETH JUDAH TEMPLE , PO Box 1183 , Wildwood, NJ 08260 , applied for a Special Events Permit for the purpose of a SERVICE   to be held on SEPTEMBER 21, 2017 ,  from 5:30 PM to 6:30 PM, at the SUNSET LAKE GAZEBO ; and

                                                                                                                                                         

WHEREAS,  BETH JUDAH TEMPLE, PO Box 1183, Wildwood, NJ 08260, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

Administrator’s Report:

Pacific Avenue

The last of the County’s striping work is now complete south of Rambler and project closeout change order was handled this morning. 

SJ GAS Projects

South Jersey Gas and ULS have completed all phases of natural gas upgrades with the exception of paving the roads affected by the Grid 1 project.

Kayak Launch/ Sunset Lake Shoreline Stabilization

We received cost estimate from MM of $150,000 for replacement of current launch to make it a viewing platform/ fishing pier and construct a combination kayak/ paddle board launch adjacent to the parking lot.  Because there is shellfish habitat there we must apply to DEP for fishing pier. The DEP permitting fee must be calculated for our FEMA project by MM  and will be presented to the CFO prior to the next meeting for inclusion on the bill list. MM has indicated that the necessary DEP permits will be ready to submit at that time.

Beach/ Dune Project

DEP is still working with USACE on dune alignment.    Our coastal engineers are reviewing the USACE’s plans as necessary.

As you know, the Crest experienced a record rainfall of 5.03 inches Friday evening. This caused flooding in the back beach areas which have for the most part been pumped out to the ocean via the outfall pipes (mainly at Hollywood.)  Public Works supplemented their efforts yesterday with our emergency contractor- Garden State.  As of this morning 95% of the water has been removed.  Pumping operations will continue today around Topeka, Pittsburg and Hollywood were the most rainwater accumulated.  It is expected that that this will take until about noon.  Many thanks to the public works crew and to Garden State Contracting for their hard work. 

   

ENGINEER’S REPORT: (Not necessary)

 

Public Commentary:

Dave Thompson, 106 W. Fern Road, inquired about the proposed dune.  The Mayor indicated that this was still in the design phase.  Mr. Thompson indicated there was extensive flooding still on Monday from the rain Friday night.  He further wanted to know the position of the governing body with regard to the proposed dune location.  The Mayor indicated that a recreational zone would be an asset for the community, but consulting with the engineers and on-going discussions were crucial.  Lastly, the Mayor added that the US Army Corps of Engineers had an aggressive calendar and it seems to have slowed a bit.  The Administrator added that our Coastal Engineer has pictures from Wildwood Crest after Friday’s record setting rainfall for both the USACE and the DEP.  Commissioner Cabrera indicated that clearly this proposed dune project is an engineering issue and the state has to deal with it and help us and that a bike path in the south end would bring value.  Commissioner Gould added that the state is looking at the coastal communities as being the same and each municipality is different.  Lastly, the Mayor added that the USACE has both the courts and the government behind them.

 

New Business: 

There was no New Business to discuss.

 

Old Business:

The Army Corps Beach Plan was previously discussed.  With regard to the Kayak Launch, Commissioner Cabrera indicated the old steps would become the new lookout and the Administrator added that this was going to be incorporated in the permitting process for cost savings.  The Mayor added that 90% of the cost for the mitigation project would be reimbursed.

 

Hearing nothing further from the public, Mrs. Gould motioned, seconded by Mr. Cabrera that the meeting be adjoured.  All were in favor.  The time was 9:51 a.m.
