Minutes of Commissioners Meeting   -   July 19, 2017

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 5:30 p.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by e-mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on December 1, 2016.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Prior to the first resolution being read, Mayor Groon acknowledged W. Scott Jett, the Municipal Clerk from North Wildwood.

 

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1004-17

Authorizing Retention Via Professional Services Agreement

Of A Facility & General Engineer  

 

WHEREAS, there exists the need for “Professional Services” of a FACILITY & GENERAL ENGINEER, to be retained by the Borough for the performance of engineering work and related duties associated therewith as directed by the authorized representatives of the Borough of Wildwood Crest, all as more specifically set forth in the attached Agreement which is made a part hereof by reference as if fully set forth; and,

 

WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A: 1-11, et seq.) requires that the Resolution authorizing the award of contracts for “Professional Services” without competitive bids must be publicly advertised; and

 

WHEREAS, this contract was not awarded through a “fair and open process,” but does meet all of the criteria required by the provisions of N.J.S.A. 19:44A-20.4, et seq. for said award;

 

WHEREAS, the Borough has determined that Marc DeBlasio of DeBlasio & Associates located in Wildwood, New Jersey is qualified to perform said work and it is desired to enter a professional contract with DeBlasio & Associates for said services pursuant to law, and to provide for the advertising of a notice pursuant to law; and

 

WHEREAS, the firm DeBlasio & Associates, has completed and submitted a Business Entity Disclosure Certification which certifies that DeBlasio & Associates, will not make any reportable contributions pursuant to N.J.S.A. 19:44A-1 commencing August 1, 2017 to any political committee or candidate through the term of this contract;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, as follows:

 

1.                   That the allegations of the preamble hereto are incorporated herein as if fully set forth.

 

2.                   The Commissioner of Public Works and Borough Clerk be and they are hereby authorized, instructed, and empowered to execute the attached agreement with DeBlasio & Associates, who shall be compensated by voucher at the agreed upon hourly rates, contingent upon certification below from the Chief Financial Officer as to the availability of funds, and whose rate/fee structure are contained in the aforesaid Agreement and said “Independent Contractor” shall be required to comply with this Resolution, and the attached Agreement.  Said Facility & General Engineer is further required to comply with all other conditions/provisions of law or regulation applicable to a “Professional Services Contractor,” including but not limited to procuring/maintaining sufficient insurance coverages necessary to fully protect the interests of the Borough in each and every instance relative to performance under this contract.

 

3.                   This contract is awarded without competitive bidding as a professional service in accordance with the provisions of the Local Public Contracts Law aforesaid, and in accordance with the provisions of N.J.S.A. 19:44A-1, and shall be in a form approved by the Borough.

 

4.                   The Business Disclosure Entity Certification and the Determination of Value shall be placed on file with this Resolution.

 

5.                   This Resolution and a copy of the contract for professional services shall be maintained on filed in the offices of the Borough Clerk for public inspection.

 

6.                   A copy of this Resolution shall be published in the legal newspaper designated by the Borough as required by law, within ten (10) days of its passage.

For the record, the Clerk read that Commissioner Cabrera sent an email with respect to the Resolution regarding Mr. DeBlasio and to feel free to advise the Commissioners and the public that he is a Yes.  

 

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1005-17

WHEREAS, there exists the need for the “Professional Services” of an ENGINEER, to be retained by the Borough for the performance of engineering work and related duties associated with coastal engineering services as directed by the authorized representatives of the Borough of Wildwood Crest, all as more specifically set forth in the attached Agreement which is made a part hereof by reference as if fully set forth; and

 

          WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:1-11, et. seq.) requires that the Resolution authorizing the award of contracts for “Professional Services” without competitive bids must be publicly advertised; and

 

          WHEREAS, this contract was not awarded through a “fair and open process,” but does meet all of the criteria required by the provisions of N.J.S.A. 19:44A-20.4, et. seq. for said award;

 

          NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, as follows:

 

          1.  That the allegations of the preamble hereto are incorporated herein as if fully set forth.

 

          2.  That the Mayor and Borough Clerk be and they are hereby authorized, instructed, and empowered to execute the attached agreement with MOTT MacDONALD, who shall be compensated by voucher at the agreed upon hourly rates, contingent upon certification below from the Chief Financial Officer as to the availability of funds at the not to exceed contract amount of Twenty Thousand ($20,000) Dollars, and whose rate/fee structure are contained in the aforesaid Agreement and said “Independent Contractor” shall be required to comply with this Resolution, and the attached Agreement.  Said Engineering Firm is further required to comply with all other conditions/provisions of law or regulation applicable to a “Professional Services Contractor,” including but not limited to procuring/maintaining sufficient insurance coverages necessary to fully protect the interests of the Borough in each and every instance relative to performance under this contract.

 

          3.  That the aforesaid contract is awarded without competitive bidding as a “Professional Service” under the provisions of the Local Public Contracts Law because N.J.S.A. 40A:11-5 states that no local unit shall be required to advertise for bids for services rendered or performed by a person authorized by law to practice a recognized profession and whose practice is regulated by law, or to advertise for bids for services which are of such a qualitative nature as will not reasonably permit the drawing of specifications or the receipt of competitive bids, all of which classification the aforesaid contact falls within.

 

          4.  That a copy of the specific items appertaining to the award of this contract shall be published in a Notice of Award in the Herald of Cape May County as required by law within ten (10) days of passage of the Resolution authorizing same.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1006-17

WHEREAS, DANIELLE ZICCARDI, 2720 South 17th Street, Philadelphia, Pennsylvania  19145, has paid Six Hundred Twenty Five ($625.00) Dollars (check #117) to the Borough of Wildwood Crest for the enrollment of her son, Joseph  Ziccardi, in the Pier Playmates Program, Sessions One and Two; and

 

WHEREAS, due to unforeseen circumstances, Danielle Ziccardi was required to withdraw her son from the first session camp; and

 

WHEREAS, Joseph Ziccardi did not attend the Pier Playmates Program, first session, but will attend the second session;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Chief Financial Officer be and is hereby authorized and directed to issue a refund for the First Session Crest Pier Playmates Program in the amount of Three Hundred Seventy Five ($375.00) Dollars to DANIELLE ZICCARDI, 2720 South 17th Street, Philadelphia, PA  19145 for the withdrawal of her son, Joseph Ziccardi, from the Pier Playmates first session.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1007-17

WHEREAS, on July 6, 2017 , LISA TRAVASCIO , 112 E. Louisville Ave. , Wildwood Crest, NJ  08260 , applied for a Special Events Permit for the purpose of a BLOCK PARTY   to be held on JULY 22, 2017 ,  from 4:00 p.m. to 8:00 p.m., on the 100 EAST BLOCK OF LOUISVILLE AVE ; and

                                                                                                                                                         

WHEREAS,  LISA TRAVASCIO, 112 E. Louisville Ave., Wildwood Crest, NJ  08260, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  LISA TRAVASCIO , 112 E. Louisville Ave., Wildwood Crest, NJ  08260 for the purpose of a BLOCK PARTY to be held on JULY 22, 2017 , from 4:00 p.m. to 8:00 p.m., on the 100 EAST BLOCK OF LOUISVILLE AVE.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  1008-17

WHEREAS, on June 23, 2017 , ADAM MISOVE , 12 Fuller Lane , Hyde Park, NY 12538 , applied for a Special Events Permit for the purpose of the MISOVE-FERN WEDDING   to be held on AUGUST 25, 2017 ,  from 4:00 PM to 5:00 PM, on the FARRAGUT RD BEACH ; and

                                                                                                                                                         

WHEREAS,  ADAM MISOVE, 12 Fuller Lane, Hyde Park, NY 12538, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  ADAM MISOVE , 12 Fuller Lane, Hyde Park, NY 12538 for the purpose of the MISOVE-FERN WEDDING to be held on AUGUST 25, 2017, from 4:00 PM to 5:00 PM, on the FARRAGUT RD BEACH

WHEREAS, on July 5, 2017 , KAY C. SAGAL , 7209 New Jersey Ave #1NS , Wildwood Crest, NJ 08260 , applied for a Special Events Permit for the purpose of the BRASOVEANU-SAGAL WEDDING   to be held on JULY 29, 2017 ,  from 5:00 PM to 6:00 PM, at the SUNSET LAKE GAZEBO ; and

                                                                                                                                                         

WHEREAS,  KAY C. SAGAL, 7209 New Jersey Ave #1NS, Wildwood Crest, NJ 08260, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  KAY C. SAGAL , 7209 New Jersey Ave #1NS, Wildwood Crest, NJ 08260 for the purpose of the BRASOVEANU-SAGAL WEDDING to be held on JULY 29, 2017, from 5:00 PM to 6:00 PM, at the SUNSET LAKE GAZEBO.

Administrator’s Report:

Tax Bills and Tax Rate

After a delay caused by the failure of the state to adopt its budget and subsequent school funding issue Lyndsey Herman, Tax Collector has finally received the tax duplicate and secured our tax rate allowing to send the Borough’s tax bills to al property owners this Friday.  Of course those residents who wish to see what their 3rd quarter tax payment in advance of Friday can log onto or Borough website and go the highlighted yellow section on homepage titled Tax and Sewer payments towards the bottom.

Pacific Avenue

Project is now complete for the summer.   Cape May County has contracted to make repairs on a few blocks of Pacific Avenue.  The last of the County’s work is expected to be complete today with the white dotted line near Stanton being ground out and striping creating a tapered lane into one lane traffic being installed.

 

 

SJ GAS Projects

South Jersey Gas and ULS continues to install the last of the new services since coordination with seasonal residents was difficult before those people moved back in for the summer season.   They are dwindling.  Also, all final paving will be completed come the fall in the south end of town which is considered the Grid 1 project.

 

Kayak Launch

Tom Thornton, Engineer, had difficulty setting up the pre-application meeting with DEP due to DEP vacation schedules.  In lieu of that meeting, Steve Morey and Tom Thornton called the DEP Land Use Specialist to clarify some questions about necessary permits.  It is expected that all issues will be resolved and all necessary applications will be submitted to NJDEP simultaneously with the submission of the FEMA application for shoreline stabilization.  All permits will be applied for at the same time.  I expect that this will occur in the next few weeks.  Funding for this launch is being explored as it is not part of the FEMA funding.    The timeline for construction of the shoreline stabilization is still being worked out.  I will report back once we a clearer picture.

 

Beach/ Dune Project

DEP is still working with USACE on dune alignment.    Our coastal engineers are reviewing the USACE’s plans as necessary.

 

Public Commentary:

The Mayor opened the floor for public commentary. 

 

Robert White, owner of Number One Taxi, came in to personally thank the Commissioners for future consideration for a taxi license.

 

Hearing nothing further from the public, the Mayor wanted to personally welcome Mr. DeBlasio on board and then opened New Business.

 

New Business: 

There was no New Business to discuss.

 

Old Business:

With regard to Old Business, the Mayor indicated that the Army Corp Beach Plan and Sunset Lake / Kayak Launch were discussed in the Administrator’s Report.

 

The floor was opened once again for public commentary.    Hearing nothing further from the public regarding the Public Commentary portion, the Mayor indicated that the generator topic was pulled from future agendas as the school was too costly after getting a report from the electrical engineer and that other locations were to be pursued. 

 

Prior to adjournment, Lt. Gorski from the Wildwood Crest Police Department indicated that National Night Out was planned for August 1st (after learning the correct date) and that there were lots of activities and giveaways being planned, under the direction of Chief McGrath and Sgt. Ron Becker.    

 

Mrs. Gould motioned, seconded by Mr. Groon that the meeting be adjourned.  All were in favor.  The time was 5:43 p.m.
