Minutes of Commissioners Meeting   -   May 24, 2017

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 5:30 p.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by e-mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on December 1, 2016.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

A CAPITAL ORDINANCE PROVIDING IMPROVEMENT TO VARIOUS ROAD CURB RAMP ACCESS WITHIN THE MUNICIPALITY AND APPROPRIATING THEREFOR THE AMOUNT OF $50,000 FROM THE CAPITAL IMPROVEMENT FUND

AN ORDINANCE AUGMENTING AND AMENDING CHAPTER 21 – CLAIMS PROCEDURE - OF THE CODE OF THE BOROUGH OF WILDWOOD CREST, COUNTY OF CAPE MAY AND STATE OF NEW JERSEY, AND AMENDING ORDINANCE NO. 965 ADOPTED SEPTEMBER 13, 2004

 

Mrs. Gould motions, Mr. Cabrera seconds that Ordinance No. 1256 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on June 7, 2017 at 9:30 a.m.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  967-17

WHEREAS, the Board of Commissioner adopted Resolution No. 550-15 on December 16, 2015, which authorized payment of $2,000.00 into an Escrow Account with regard to Mr. Laurel Litigation as per Judge Nelson C. Johnson; and

 

WHEREAS, on May 9, 2017, Judge Nelson C. Johnson, ordered an additional payment of $1,000.00 be deposited into to the “Fitzgerald & McGroarty, Mt. Laurel Litigation Escrow Account” and;

 

WHEREAS, THE Borough of Wildwood Crest is one of 24 Plaintiffs and as such pursuant to the Order of Judge Nelson C. Johnson, J.S.C. who appointed Steven P. Perskie, J.S.C. (Ret’d) as Special Master on September 28, 2015 with regard to the municipalities housing element and fair share housing plan, and Richard B. Reading as Special Regional Master advising the court on fair share needs, and

 

NOW, THEREFORE, BE IT RESOLVED the Borough Commissioners of the Borough of Wildwood Crest authorize payment in the amount of One Thousand Dollars ($1,000) be made to the escrow agent, Fitzgerald & McGroarty pursuant to Judge Nelson C. Johnson’s order.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  968-17

WHEREAS, there exists the need for an ROOFING SERVICES FOR BUILDING LOCATED AT 6300 OCEAN AVENUE to be retained by the Borough for the removal of all old shingles and installation of new HD lifetime, dimensional shingles on the entire roof area, the installation of ice and watershield synthetic felt, drip edge, pipe collars, ridge vents, 6 sheets of replacement plywood, cleaning and removal of all debris from premises and guarantees all materials for lifetime and all labor for 10 years, all as more specifically set forth in the attached Agreement which is made a part hereof by reference as if fully set forth; and

 

          WHEREAS, WORLD ROOFING (A DIVISION OF WORLD CONTRACTING NJ, LLC) has completed and submitted a Business Entity Disclosure Certification which certifies that WORLD ROOFING will not make any reportable contributions pursuant to N.J.S.A. 19:44A-1 commencing May 24, 2017 to any political committee or candidate through the term of this contract, December 31, 2017.

 

          NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, as follows:

 

          1.  That the allegations of the preamble hereto are incorporated herein as if fully set forth.

 

          2.  That the Mayor and Borough Clerk be and they are hereby authorized, instructed, and empowered to execute the attached agreement with WORLD ROOFING, who shall be compensated by voucher at the agreed upon rate of Thirty Six Thousand Five Hundred Seventy Five ($36,575.00) plus $45.00 per sheet of plywood for all sheets that exceed the first six (6) sheets included in the base price, contingent upon certification below from the Chief Financial Officer as to the availability of funds, and whose rate/fee structure are contained in the aforesaid Agreement and said “Independent Contractor” shall be required to comply with this Resolution, and the attached Agreement.  Said World Roofing is further required to comply with all other conditions/provisions of law or regulation applicable, including but not limited to procuring/maintaining sufficient insurance coverage necessary to fully protect the interests of the Borough in each and every instance relative to performance under this contract.

         

          3.   The Qualified Purchasing Agent has reviewed all quotes and is satisfied that World Roofing has met of all of the requirements and recommends approval of said contract.

 

          4.  That the aforesaid contract is awarded under the provisions of Local Public Contracts Law, N.J.S.A. 40A:11-1, et. seq., and World Roofing is qualified to perform the services and is the lowest responsive bidder for the period of May 24, 2017 through December 31, 2017.

 

          5.   The Business Disclosure Entity Certification shall be placed on file with this Resolution.

 

          6.  That a copy of the specific items appertaining to the award of this contract shall be published in a Notice of Award in The Herald of Cape May County as required by law within ten (10) days of passage of the Resolution authorizing same.

RESOLUTION NO.  969-17

Authorizing Retention Via Professional Services Agreement

Of An Expert Witness Engineer Specializing In HVAC Installation

 

WHEREAS, the Borough of Wildwood Crest adopted Resolution No. 668-16 on April 6, 2016, which authorized the retention via professional services agreement of an expert witness engineer specializing in HVAC installation;

 

WHEREAS, it is desired to continue to employ a professional, pursuant to law, who is duly trained, experienced and specialized in the area of skilled HVAC Installation; and

 

WHEREAS, the Local Public Contracts Law provides for the entering into of a contract for professional services pursuant to R.S.40A:11-5(1)(a), without advertising for competitive bidding; and

 

WHEREAS, the Borough has determined that Robert N. Roop, of Lockatong Engineering, Inc. of Rosemont, New Jersey is qualified to perform said work and it is desired to enter a professional contract with him for said services pursuant to law, and to provide for the advertising of a notice pursuant to law; and

 

WHEREAS, Robert N. Roop, of Lockatong Engineering, Inc., has completed and submitted a Business Entity Disclosure Certification which certifies that Robert N. Roop, of Lockatong Engineering, Inc. will not make any reportable contributions pursuant to N.J.S.A. 19:44A-1 commencing May 24, 2017 to any political committee or candidate through the term of this contract;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, as follows:

 

1.                   Robert N. Roop, of Lockatong Engineering, Inc. of Rosemont, New Jersey is hereby retained as an Expert Witness to provide specialized professional services as Expert Witness in the field of HVAC Installation through December 31, 2017. The said professional services to be received shall be “as directed” by the Borough of Wildwood Crest from time to time.

 

2.                   The Mayor and Borough Clerk be and they are hereby authorized and directed to enter into a contract with Robert N. Roop, of Locktatong Engineering, Inc. for specialized professional services as Expert Witness in the field of HVAC Installation for a term of the period indicated above, which contract shall provide for payment according to the fee schedule in the proposal dated March 24, 2016.  Said award is further contingent upon the certification of availability of funds below by the CFO.

 

3.                   This contract is awarded without competitive bidding as a professional service in accordance with the provisions of the Local Public Contracts Law aforesaid, and in accordance with the provisions of N.J.S.A. 19:44A-1, and shall be in a form approved by the Borough.

 

4.                   The Business Disclosure Entity Certification and the Determination of Value shall be placed on file with this Resolution.

 

5.                   This Resolution and a copy of the contract for professional services shall be maintained on filed in the offices of the Borough Clerk for public inspection.

 

6.                   A copy of this Resolution shall be published in the legal newspaper designated by the Borough as required by law, within ten (10) days of its passage.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  970-17

WHEREAS, it is the position of the Borough of Wildwood Crest to ensure its beaches are maintained in an attractive condition; and

 

WHEREAS, the Borough of Wildwood Crest would like to provide citizens with the opportunity to assist the Borough in achieving safe, attractive and litter-free beaches; and

 

WHEREAS, the Borough of Wildwood Crest is desirous of enacting an “Adopt-a-Beach” program to join numerous other municipalities that sponsor similar programs; and

 

WHEREAS, the “Adopt-a-Beach” Agreement sets forth the requirements to participate in the program; and

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the “Adopt-a-Beach” that the Commissioner of Public Works and Borough Clerk be and they are hereby authorized and instructed to execute any and all documents necessary to effectuate said agreement.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  971-17

WHEREAS, the Wildwood Crest Beach Patrol is in need of two (2) four-wheel drive utility vehicles for use on the beach; and

 

WHEREAS, it is the desire of the governing body to rent/lease said utility vehicles;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, as follows:

 

                1.             That the preamble hereto is repeated as if set forth in full.

 

                2.             That the Wildwood Crest Beach Patrol be authorized to rent/lease from Central Jersey Equipment, LLC, 100 U.S. Route 206, Hammonton, NJ  08037 two (2) four-wheel drive, utility vehicles for the period July 1, 2017 through September 1, 2017, for the total rental amount of $3,800.00.

 

                3.             That the Mayor and Borough Clerk be and they are hereby authorized and instructed to execute any and all documents necessary to effectuate said rental/lease agreement.

                WHEREAS, an overpayment was created for the reason listed below, and

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  THOMAS VEDDER & LORI TRAVERS , 119 Minuteman Lane, Woolwich, NJ 08085 for the purpose of the VEDDER-TRAVERS WEDDING to be held on JULY 29, 2017, from 11:00 AM to 12:00 PM, on the ROSEMARY RD BEACH.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  978-17

WHEREAS, on May 9, 2017 , MEGAN FRANKS , 31 Summit Pass , Medford, NJ 08055 , applied for a Special Events Permit for the purpose of the "MASH WILDWOOD" - MISSY'S ADVENTURE SCAVENGER HUNT   to be held on JUNE 24, 2017 ,  from 1:00 PM to 4:00 PM, at VARIOUS LOCATIONS in the Borough of Wildwood Crest ; and

                                                                                                                                                         

WHEREAS,  MEGAN FRANKS, 31 Summit Pass, Medford, NJ 08055, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

THE GOVERNING BODY AUTHORIZED APPROVAL OF 7 TAXI CAB LICENSES (3 – Yellow Cab Transportation Inc.; 3 – Checker Cab; 1-Sea Breeze Transportation) for Calendar Year 2017 in accordance with the Provisions of Chapter 73 of the Code of the Borough of Wildwood Crest

The Mayor opened the floor for public commentary.  Dennis Travascio, 112 E. Louisville, inquired about taxi cab licenses and why it did not go island wide.  The Mayor indicated that the state took some action with regard to Uber and they fall under the State Attorney General and the Borough will look to re-do after we receive the mandate from the state.  The Mayor further indicated that if we cannot look to do the licensing island wide, the Borough will do on its own.  Mr. Travascio asked if the reports received from the Chief Financial Officer, Tax Collector, Court Administrator and Chief of Police were public records and the Mayor indicated they were.

 

Hearing nothing further from the public, the Mayor asked if the Commissioners had anything for New Business.  The Mayor added that the Engineer would like to discuss the Kayak launch and would like input from the Board as to what they would like to see /configuration and that this tied into the FEMA Repair Project.  He asked both Commissioners Gould and Cabrera to coordinate with Connie.  The Mayor then raised the issue of people calling with regard to the entrance to the Bike Path at Rambler Road.  Commissioner Cabrera agreed that as you head South on the bike path and come to Rambler Road, you see the orange pylons and asked the Chief if there was a safer way and the Chief indicated he would look and meet with Commissioner Cabrera the following morning.  Commissioner Cabrera then added that Wildwood Crest was chosen 2017 Trip Advisor “Hot Spot” and would like to coordinate posters and signage at the beach.  He also indicated he wanted to call a special meeting with the TDC to discuss this unique opportunity.  The Mayor asked the Clerk to remind the Administrator to follow up.  Commissioner Gould indicated that Channel 6 was scheduled to be in Wildwood Crest the following day to do a piece on the Trip Advisor “Hot Spot.”

 

Commissioner Cabrera lastly added that at his informal “Coffee with Cabrera” that the following concerns were brought to his attention were additional signage with regard to cigarette butts and new beach signs.  The Mayor agreed.  Commissioner Gould also introduced the new boro logo behind them. 

 

With regard to Old Business, the Mayor indicated that the Administrator had a meeting with regard to the generator and would update upon her return.  There were no developments with the Army Corps Beach Plan and the Kayak Launch was previously discussed

 

The floor was opened once again for public commentary.    Hearing nothing further from the public regarding the Public Commentary portion, Mrs. Gould motioned, seconded by Mr. Cabrera that the meeting be adjourned.  All were in favor.  The time was ­­­­­­­­­5:49 p.m.
