Minutes of Commissioners Meeting   -   April 12, 2017

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

 

Gould –    Cabrera –   Groon        YES

 

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by e-mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on December 1, 2016.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

There were no ordinances for Introduction or Adoption.

 

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  943-17

WHEREAS, the Wildwood Crest Police Department is desirous of having the following seven people attend the Cape May County Police Academy:

 

Christine Edwards

Christopher Geresi

Patrick Kane

Kyle Klemas

Cory McDermott

Shane Moyer

Declan Rae; and

 

WHEREAS, the governing body of the Borough of Wildwood Crest has concluded that this would be in the best interests of the Wildwood Crest Police Department, and wishes to authorize same;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that Christine Edwards, Christopher Geresi, Patrick Kane, Kyle Klemas, Cory McDermott, Shane Moyer and Declan Rae be and they are hereby authorized to attend the Cape May County Police Academy on behalf of the Wildwood Crest Police Department.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  944-17

WHEREAS, the Borough of Wildwood Crest has received multiple requests from varying agencies seeking to obtain consent for the use of the right of way to install antennae or nodes throughout the municipality; and

 

 WHEREAS, said agencies have represented that these installations are necessary to provide adequate or upgraded cellular service throughout the area; and

 

WHEREAS, the requests have been varied and do not adequately address the size and placement of the antennae, address the control of independent poles, or conform in terms of compensation; and

 

WHEREAS, it is the desire of this Governing Body to develop a unified plan to address many of the unanswered questions with regard to the "Nodes" issue as set forth herein; and

WHEREAS,  as members of the Atlantic County Municipal Joint Insurance Fund and having similar issues as all other municipalities in the County of Cape May, it is in the best interest of the Borough of Wildwood Crest to participate and engage in a collective effort to address the concerns mentioned herein; and

 

NOW THEREFORE BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest that it hereby authorizes the Borough Solicitor to participate in a joint effort with solicitors from other municipalities in the County of Cape May to provide a uniform agreement for the installation of “nodes” or antennae.  

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  945-17

WHEREAS, on April 6, 2017 , MAGILLA ENTERTAINMENT LLC , 42 Broadway, Suite 227 , New York, NY 10004 , applied for a Special Events Permit for the purpose of a TV SHOOT   to be held from APRIL 29, 2017 thru MAY 2, 2017 , at VARIOUS LOCATIONS in the BOROUGH OF WILDWOOD CREST ; and

                                                                                                                                                         

WHEREAS, MAGILLA ENTERTAINMENT LLC, 42 Broadway, Suite 227, New York, NY 10004, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to MAGILLA ENTERTAINMENT LLC , 42 Broadway, Suite 227, New York, NY 10004 for the purpose of a TV SHOOT to be held from APRIL 29, 2017 thru MAY 2, 2017 , at VARIOUS LOCATIONS in the BOROUGH OF WILDWOOD CREST.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  946-17

WHEREAS, on March 27, 2017 , the NORTH AMERICAN POWER KITE ASSOCIATION (NAPKA) , PO Box 1358 , West Port, WA 98595 , applied for a Special Events Permit for the purpose of a KITE BUGGY EVENT   to be held from APRIL 24, 2017 through APRIL 30, 2017 , from SUNRISE to SUNSET, on the ROSEMARY ROAD BEACH and adjacent beach from Heather Rd. to Rambler Rd. ; and

                                                                                                                                                         

WHEREAS,  the NORTH AMERICAN POWER KITE ASSOCIATION (NAPKA), PO Box 1358, West Port, WA 98595 has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  the NORTH AMERICAN POWER KITE ASSOCIATION (NAPKA) , PO Box 1358, West Port, WA 98595 for the purpose of a KITE BUGGY EVENT to be held from APRIL 24, 2017 through APRIL 30, 2017, from SUNRISE to SUNSET, on the ROSEMARY ROAD BEACH and adjacent beach from Heather Rd. to Rambler Rd.

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

The Mayor then opened the floor for public commentary. 

 

Captain Robert Lloyd, Wildwood Crest Police Department, gave an overview of a recent telephonic scam to one of our residents.  The person said they were Paul Goodman from Publishers Clearing House and he stressed to all that if you feel you are being scammed, to contact the Police immediately.  The Mayor indicated that we should put something on our website and Capt. Lloyd indicated it was going on their Facebook page and our Administrator asked the Captain to send over she could do a press release. 

 

Hearing nothing further from the public regarding the Public Commentary portion, the Mayor indicated there was no new business to discuss.  With regard to old business, the Mayor pointed out that we needed to revisit the generator topic and touch base with the Chief, our Engineer and advise of the next step in the process.  With regard to both the Army Corps Beach plan and Kayak launch, the Mayor advised we were waiting on the Army Corps.

 

The Mayor opened the floor again for public commentary, and hearing nothing further from the public, Mrs. Gould motioned, seconded by Mr. Cabrera that the meeting be adjourned.  All were in favor.  The time was 9:35 a.m.
