Minutes of Commissioners Meeting   -   February 8, 2017

Wildwood Crest, NJ

Prior to the opening of the meeting, Mrs. Gould led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by e-mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on December 1, 2016.

 

Mrs. Gould next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance 1251 be placed on second and final passage by title only.

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1251

AN ORDINANCE TO VACATE THE PUBLIC ACCESS RIGHTS AND TO TERMINATE, EXTINGUISH AND ABANDON THE SEWER EASEMENT SITUATE ON THE REAR SEVEN AND ONE HALF (7½’) FEET OF LOTS 1 THROUGH 12 OF BLOCK 56.02 (FORMERLY BLOCK 56-A) RUNNING FROM PALM ROAD TO FERN ROAD A DISTANCE OF TWO HUNDRED (200’) FEET IN TOTAL LENGTH AND FIFTEEN (15’) FEET IN TOTAL WIDTH

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that a public hearing now be held on Ordinance No. 1251.

After no comments from the public, Mrs. Gould motioned, seconded by Mr. Cabrera, that the public hearing on Ordinance No. 1251 now be closed.

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1251 be passed on second and final reading and advertised according to law.

Mrs. Gould motioned, seconded by Mr. Cabrera that Ordinance 1252 be placed on second reading and final passage by title only.

Mrs. Gould then wanted to discuss the Borough Seal and had reservations about moving forward.  The Solicitor indicated that the Ordinance just protects the rights of all the logos.  The Mayor indicated at some point the official Borough Seal would need to be formalized.  Commissioner Cabrera pointed out that he circulated the materials on a Borough Seal and would resend them. 

The Commissioners agreed to withdraw the present Ordinance, revise and re-introduce.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  904-17

ANNUAL SEWER RATE

                WHEREAS, Borough of Wildwood Crest Ordinance Numbers 947 and 1203 contain formulas for the calculation and establishment of annual sewerage rates, including the current year Variable Rate Fee; and

 

                WHEREAS, the said calculations have been prepared and reviewed in accordance with the aforementioned Ordinances Numbered 947 and 1203; and

 

                WHEREAS, it is promulgated in Ordinance No. 947 the Commissioner of Revenue and Finance shall submit the proposed sewerage rates and minimum charges to the Board of Commissioners for confirmation by resolution; and

 

                WHEREAS, the rates as calculated, reviewed and submitted are as follows:

 

                Fixed Rate Charge:             $4.00 per 1000 gallons of metered water consumption

                Variable Rate Charge:        $22.60 per 1000 gallons of metered water consumption

                Minimum Annual Charge:                $124.00

 

                WHEREAS, the due date for the first quarter will be April 1, 2017 with a ten day grace period.

 

                NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May and the State of New Jersey, that the sewerage rates and minimum charges as presented by the Commissioner of Revenue and Finance be confirmed for calendar year 2017.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  905-17

AMENDING RESOLUTION NO. 783-16 ADOPTED ON OCTOBER 19, 2016 TO REDUCE THE AUTHORIZED CONTRACT AMOUNT

 

WHEREAS, the Governing Body adopted Resolution No. 783-16, on October 19, 2016, which  authorized the Borough to enter into a contract for professional services for Architectural/ Engineering Services for Replacement of Bicycle Building totaling $26,100.00; and

 

WHEREAS, in accordance with procurement laws, the Chief Financial Officer certified the availability of funds in the amount of $26,100.00; and

 

WHEREAS, it has since been determined that the amount deemed necessary for completion of professional engineering services for the Replacement of the Bicycle Building is $7,830.00; and

 

WHEREAS, Mott MacDonald has submitted Invoice No. IV 00244977 in the amount of $7830.00 marked FINAL INVOICE.

 

NOW THEREFORE BE IT RESOLVED that Resolution 783-16 in the amount of $26,100.00 is hereby amended to reduce the authorized contract amount to 7,830.00.

 

BE IT FURTHER RESOLVED that the CFO is hereby authorized and directed to release the encumbered balance of $18,270.00.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  906-17

A Resolution Re-Appointing Chief Joseph McGrath as

Emergency Management Coordinator and Coordinator of the Local Defense Council / Local Emergency Planning Committee for the

Borough of Wildwood Crest, New Jersey

 

WHEREAS, on February 26, 2014, the Governing Body adopted Resolution No. 78-14 authorizing Joseph McGrath to serve as Emergency Management Coordinator and Coordinator of the Local Defense Council / Local Emergency Planning Committee for the Borough of Wildwood Crest for a term of three years; and

 

WHEREAS, Chief Joseph McGrath of the Wildwood Crest Police Department has the necessary qualifications to perform the duties of Emergency Management Coordinator, and Coordinator of the Local Defense Council/Local Emergency Planning Committee of the Borough of Wildwood Crest; and

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, that Chief Joseph McGrath be and is hereby appointed as Emergency Management Coordinator, and as Coordinator of the Local Defense Council/Local Emergency Planning Committee of the Borough of Wildwood Crest for a term of three (3) years commencing with the adoption of this Resolution, and

 

BE IT FURTHER RESOLVED that Chief Joseph McGrath shall be compensated annually in the amount of Three Thousand Five Hundred Dollars ($3,500.00) for the duties to be performed by him in accordance with N.J.S.A. (Appendix A:9-33, et seq.) as identified in copy of same attached hereto and made a part hereof and for all duties required to be performed by Chief McGrath as Coordinator of the Local Emergency Planning Committee of the Borough of Wildwood Crest.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  907-17

WHEREAS, Borough of Wildwood Crest Resolution No. 571-93 created a “LOCAL DEFENSE COUNCIL”/LOCAL EMERGENCY PLANNING COMMITTEE, and appointments thereto, under the authority of rules and regulations established by the Governor in pursuance of the provisions of the Civil Defense and Disaster Control Act; and

 

                WHEREAS, authority for appointments to the said LOCAL DEFENSE COUNCIL/LOCAL EMERGENCY PLANNING COMMITTEE are within the jurisdiction of the office of the Mayor; and

 

                WHEREAS, Mayor Carl H. Groon is desirous of appointing a “LOCAL DEFENSE COUNCIL”/LOCAL EMERGENCY PLANNING COMMITTEE for calendar year 2017, which said “COUNCIL” shall remain operational and in full force and effect upon the date of passage of this resolution and until such time as a resolution confirming his re-appointments and/or replacements thereto has been duly adopted.

 

                NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, that the appointments as specifically set forth hereinbelow be and the same have been made by Mayor Carl H. Groon and are hereby reduced to the form of a resolution of the Board of Commissioners to confirm the appointments made and so that the same may be properly entered into the minutes of this meeting for record-keeping purposes:

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  908-17

 

A RESOLUTION COMMEMORATING THE 30TH ANNIVERSARY OF THE ATLANTIC COUNTY MUNICIPAL JOINT INSURANCE FUND

 

WHEREAS, the Atlantic County Municipal Joint Insurance Fund has been organized pursuant to N.J.S.A. 40A:10‑36 et seq., and

 

WHEREAS, the Borough of Wildwood Crest is a member of the Atlantic County Municipal Joint Insurance Fund; and

 

WHEREAS, the Atlantic County Municipal Joint Insurance Fund commenced operations on January 1, 1987 with seven charter members who, when challenged with an unfavorable market for their insurance, decided to join together to avoid the high costs and limited coverage associated with traditional insurance for fire and property, liability and workers compensation risks; and

 

WHEREAS, over the past 30 years the Fund has grown to 41 members and stands today as one of the greatest examples of an inter-local service agreement in the State of New Jersey’s history; and

 

WHEREAS, municipalities participating in the ACMJIF have saved their local taxpayers millions of dollars in the form of lower premiums and the return of nearly $31 million dollars in surplus distributions; and

 

WHEREAS, the elected officials and the municipal employees covered by the Atlantic County Municipal Joint Insurance Fund are the foundation of the Fund’s success and without whose dedication to the Fund Safety and Risk Management programs the Fund would not have achieved the status it enjoys today; and

 

WHEREAS, the Borough of Wildwood Crest wishes to recognize and commemorate the Fund on its 30th year of successful operation.

 

NOW, THEREFORE, BE IT RESOLVED, by the Commissioners of the Borough of Wildwood Crest assembled in a public session on February 8, 2017, that this body does hereby recognize and commemorate 2017 as the 30th year of the successful operation of the Atlantic County Municipal Joint Insurance Fund; and

 

BE IT FURTHER RESOLVED that the Borough of Wildwood Crest wishes to acknowledge this 30th Anniversary as a milestone event in the history of the Fund and wishes the Fund continued success for many years to come; and

 

BE IT FURTHER RESOLVED, that a copy of this Resolution shall be provided to the Executive Director of the Atlantic County Municipal Joint Insurance Fund for his information and distribution to the membership.

This Resolution was duly adopted by the Commissioners of the Borough of Wildwood Crest at a public meeting held on February 8, 2017.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  909-17

WHEREAS, the Partners in Preservation have requested the Mayor and Commissioners of the Borough of Wildwood Crest by letter, dated January 31, 2017 to help Cape May County celebrate their 325th Anniversary by the placement of a plaque at Turtle Gut Inlet, and

 

WHEREAS, Turtle Gut Inlet, is the site of the only battle in the Revolutionary War fought in Cape May County, and

WHEREAS, Partners in Preservation has secured a grant to cover the expense of the sign which will be made of high quality materials and posted off the walkway for easy reading, and

WHEREAS, the Mayor and Commissioners of the Borough of Wildwood Crest have no objection to the request and are proud of the rich history of the Borough of Wildwood Crest and the historical significance of Turtle Gut Inlet.

                NOW, THEREFORE BE IT RESOLVED by the Commissioners of the Borough of Wildwood Crest as follows:

1.       The Partners in Preservation request to place a sign at Turtle Gut Inlet as outlined in their letter of January 31, 2017 is hereby approved.

2.       The sign shall be properly installed and made of quality material to withstand the outside elements.

3.       The sign shall be placed in a location easily accessible and in an area that will not obstruct any other markers, signs or plaques.

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

Mrs. Gould motioned, seconded by Mr. Cabrera, that all bills properly authorized, as submitted, be paid.

The Mayor opened the floor for public commentary.  Dennis Travascio, 112 E. Louisville Avenue, inquired about the total costs of the logo, branding, ordinance writing, etc.  The CFO indicated that the Branding was under a Tourism Line item, but costs associated with individual departments have their own line items.  Commissioner Cabrera further indicated that new vehicles get the new logo on them; the older vehicles maintain their markings. 

 

After hearing no further comments from the public, the Mayor opened the Discussion portion of the agenda.  There being no new business to discuss, the Mayor opened old business with Polling Places.  The Commissioners agreed that consolidating the polling places to one location was beneficial to the Borough and the poll workers.  They agreed and requested the clerk to compose a resolution authorizing the Borough of Wildwood Crest to consolidate all polling places to Crest Pier. 

 

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO.  909-17

RESOLUTION TO CONSOLIDATE ALL POLLING PLACES TO CREST PIER

 

                WHEREAS, N.J.S.A. 19:18-2 states that the Municipal Clerk of each municipality shall certify to the County Board of Elections each year a suggest list of suitable polling places in the municipality; and

 

                WHEREAS, N.J.S.A. 19:18-2 also states that preference shall be given to schools and public buildings; and

 

                WHEREAS, Wildwood Crest’s designated polling place for Districts 1 & 2 is currently Crest Pier, which is located at 5800 Ocean Avenue; and

 

                WHEREAS, Wildwood Crest’s designated polling place for District 3 is the Wildwood Crest Volunteer Company #1, which is located at 7100 Pacific Avenue; and

 

                WHEREAS, Districts 4 & 5 currently vote in the Borough of Wildwood Crest at the Wildwood Crest Ambulance Corps., which is located at 9100 Pacific Avenue; and

 

                WHEREAS, the Board of the Commissioners of the Borough of Wildwood Crest has discussed and agreed upon having all Five Districts vote at one Polling location: Crest Pier.

 

                NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Wildwood Crest does hereby authorize the Borough Clerk to designate to the Cape May County Election Board that voting Districts 1 through 5 are hereby designated as Crest Pier located at 5800 Ocean Avenue, Wildwood Crest, New Jersey, 08260.

 

                BE IT FURTHER RESOLVED that a copy of this resolution be attached to the Borough Clerk’s certified list of suitable polling places when said list is submitted to the Cape May County Board of Elections.

 

Mr. Cabrera motioned, seconded by Mrs. Gould, that the foregoing Resolution be adoped.

With regard to Old Business, the Mayor indicated the Borough was looking at the school as a potential “Warming Center” with the Generator topic. He also pointed out that the Borough received a grant for a portion of the cost.    

 

Lastly, with regard to Army Corps Beach Plan, the Mayor indicated they were waiting on a response. 

 

The Mayor once again opened the floor for public commentary on old or new business.  Hearing nothing further, Mr. Cabrera motioned, seconded by Mrs. Gould, that the meeting be adjourned.

All were in favor and the time was 9:55 a.m.
