Minutes of Commissioners Meeting   -   June 4, 2016

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on November 4, 2015.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

 

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 700-16

WHEREAS, by direction of the Cape May County Board of Taxation, adopted pursuant to the terms and provisions of N.J.A.C. 18:12A-1.6(d), any and all tax appeals seeking either increases or decreases of Tax Assessment which shall be submitted to the Cape May County Board of Taxation by the various municipalities which are situated in the County of Cape May are required to, as a prerequisite to their filing, be authorized by a Resolution of the Tax District involved; and

 

WHEREAS, upon being appraised of said fact, the Tax Assessor of the Borough of Wildwood Crest requested that a Resolution authorizing the execution of such tax appeals by the Tax Assessor of the Borough of Wildwood Crest be authorized by the governing body of the Borough of Wildwood Crest so that disposition of the same may be made by the Cape May County Board of Taxation.

 

WHEREAS, when such cases arise where there is a conflict of interest, the Borough of Wildwood Crest wishes to appoint a Conflict Assessor to hear all appeals on behalf of the Borough of Wildwood Crest.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May and State of New Jersey, as follows:

 

1.     That Kevin Maloney, Tax Assessor of the Borough of Wildwood Crest, be and he hereby is authorized to both pursue and defend to completion Tax Appeals on behalf of the Borough of Wildwood Crest for either increase or decreases in Tax Assessments for the calendar year 2016, for disposition by the Cape May County Board of Taxation.

 

2.     That Jeffrey Hesley, Tax Assessor for the Borough of Avalon, be and he hereby is authorized to both pursue and defend to completion Tax Appeals on behalf of the Borough of Wildwood Crest for either increase or decreases in Tax Assessments for the calendar year 2016, when a conflict arises, for disposition by the Cape May County Board of Taxation.

 

3.     That Patricia A. Feketics, Borough Clerk of the Borough of Wildwood Crest, be and she hereby is instructed to direct certified copies of this Resolution to the following persons or agencies:

A.   Kevin Maloney, Tax Assessor of the Borough of Wildwood Crest;

B.    Jeffrey Hesley, Tax Assessor for the Borough of Avalon;

C.    Lyndsey Herman, Tax Collector of the Borough of Wildwood Crest; and

D.   Cape May County Board of Taxation.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

Vote:          Gould - Cabrera Yes               Groon Abstain

 

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 696-16

WHEREAS, there exists a need for the appointment of a Conflict Solicitor to represent the Borough of Wildwood Crest for one residential property tax appeal; and

 

WHEREAS, Paul J. Baldini, P.A., Solicitor for the City of Sea Isle, has offered to represent the Borough of Wildwood Crest in this one appeal at no charge to the Borough of Wildwood Crest;

 

NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, State of New Jersey, as follows:

 

1.  That Paul J. Baldini, P.A. is appointed to provide legal services for the one Conflict of Interest residential property tax appeal, at no charge.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

Vote:          Gould - Cabrera Yes                Groon Abstain

 

The Mayor then opened the floor for public commentary. 

 

Christina Stasiuk, 7601 Atlantic Avenue, thanked the Governing Body for holding the meeting on Saturday.  She would like to see more bike racks where some parking spaces are located.  Secondly, she would like to see more wheelchairs for the beach. 

 

Aileen Kennedy, 122 E. Sweetbriar Road, inquired about motorized bikes and skateboards, etc. on the bikepath.  She pointed out how dangerous they are to pedestrians.  She asked for signage to be placed along the bikepath.  She wanted to know if there were an ordinance in place that would prohibit them.  The Mayor indicated it would be researched and asked Lt. Lloyd to follow up. 

 

Patty Scharff, 117 E. Stockton Road, asked if there were any plans for Pacific Avenue in the future.  The Mayor indicated they were still reviewing options at this point and looking for a traffic study to be done and they needed to contact the County for their thoughts.  He further indicated that an engineer was not engaged at this point and they would try to do before next summer.  The Administrator pointed out that same paving will be done to smooth it out.

 

Ken Hand, 7312 Pacific Avenue, asked about the possibility of beach fees.  He would like to see them.  The Mayor indicated that there were presently no discussions regarding this issue.  Commissioner Gould indicated that this would have to be island wide topic to discuss. 

 

Christina Stasiuk, 7601 Atlantic Avenue, asked about Doo Wop Architecture /Counsel.  The Mayor shared that this topic has been discussed by the Planning Board for years.  However, historical rules to fix and upgrade existing structures are stringent.  The Planning Board did not recommend this and several years ago, applications were made to the State and the State tried to force regulations and subsequently, projects were dropped.  Commissioner Gould pointed out that the Caribbean Motel is a landmark.

 

After no further commentary from the public, Mrs. Gould motioned, seconded by Mr. Cabrera that the meeting be adjourned.  All were in favor.  The time was 9:43 a.m.
