Minutes of Commissioners Meeting   -   March 23, 2016

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 7:00 p.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on November 4, 2015.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

THE CLERK READS THE FOLLOWING STATEMENT ON THE RECORD FROM COMMISSIONER JOYCE GOULD:

 

“I, JOYCE GOULD, Commissioner of Revenue & Finance of the Borough of Wildwood Crest, have reviewed the 2016 Municipal Budget and have voted in favor of the introduction of same at the February 24, 2016 Commissioners’ meeting.  Due to a preplanned vacation, I will not be present for the Commissioners’ meeting on March 23, 2016 where the introduced 2016 Municipal Budget will be voted on for adoption.  I hereby acknowledge my consent and approval of the adoption in its entirety of the 2016 Municipal Budget for the Borough of Wildwood Crest.”

  RESOLUTION NO. 640-16

 

SUBJECT:  LOCAL BUDGET OF THE BOROUGH OF WILDWOOD CREST, COUNTY OF CAPE MAY, NEW JERSEY, FOR THE FISCAL YEAR 2016

 

BE IT RESOLVED that the following statements of revenue and appropriations shall constitute the local budget for the year 2016.

 

BE IT FURTHER RESOLVED that said budget be published in The Cape May County Herald issue of March 2, 2016.

 

NOTICE is hereby given that the budget and tax resolution were approved by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey on February 24, 2016.

 

A hearing on the budget and tax resolution will be held in the Municipal Court Room in Borough Hall on Wednesday, MARCH 23, 2016 AT 7:00 P.M., Municipal Court Room, Borough Hall, 6101 Pacific Avenue, Wildwood Crest, New Jersey, at which time and place objections to said budget and tax resolution for the year 2016 may be presented by taxpayers and other interested persons.

 

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 657-16

AUTHORIZING THE BUDGET TO BE READ BY TITLE

 

WHEREAS, N.J.S.A. 40A:4-8 provides that the budget be read by title only at the time of the public hearing if a Resolution is passed by not less than a majority of the full membership of the governing body, providing that at least one week prior to the date of hearing a complete copy of the approved budget is advertised, has been posted on the bulletin board in Borough Hall, and copies have been made available by the Borough Clerk to persons requiring them on a daily basis thereafter, including the date and time of the actual public hearing held as a result thereof; and

 

WHEREAS, these required conditions have been made;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, State of New Jersey, that the municipal budget of the Borough of Wildwood Crest be read by title only.

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the budget hereinbefore set forth is hereby adopted and shall constitute an appropriation for the purposes stated of the sums therein set forth as appropriations, and authorizations of the below amount of $14,921,817.42 for municipal purposes.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 659-16

Authorizing Retention Via Professional Services Agreement

Of Law Enforcement Consultant Specializing In Police Accreditation

 

WHEREAS, the Borough of Wildwood Crest requires the professional services of a Law Enforcement Consultant specializing in police accreditation; and

 

WHEREAS, it is desired to employ a professional, pursuant to law, who is duly trained, experienced and specialized in the area of police accreditation; and

 

WHEREAS, the Local Public Contracts Law provides for the entering into of a contract for professional services pursuant to R.S.40A:11-5(1)(a), without advertising for competitive bidding; and

 

WHEREAS, the Borough has determined that Christopher J. Winter, Sr. is qualified to perform said work and it is desired to enter a professional contract with him for said services pursuant to law, and to provide for the advertising of a notice pursuant to law; and

 

WHEREAS, Cristopher J. Winter, Sr. has completed and submitted a Business Entity Disclosure Certification which certifies that Christoper J. Winter, Sr. will not make any reportable contributions pursuant to N.J.S.A. 19:44A-1 commencing March 23, 2016 to any political committee or candidate through the term of this contract;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, as follows:

 

1.                   Christopher J. Winter, Sr. is hereby retained as Law Enforcement Consultant to provide specialized professional services in the field of Police Accreditation for the period March 23, 2016 through December 31, 2016. The said professional services to be received shall be “as directed” by the Borough of Wildwood Crest from time to time.

 

2.                   The Mayor and Borough Clerk be and they are hereby authorized and directed to enter into a contract with Christopher J. Winter, Sr., for specialized professional services in the field of police accreditation for a term of the period indicated above, which contract shall provide for payment at the not to exceed rate of Five thousand four hundred dollars ($5,400.00).  Said award is further contingent upon the certification of availability of funds below by the CFO.

 

3.                   This contract is awarded without competitive bidding as a professional service in accordance with the provisions of the Local Public Contracts Law aforesaid, and in accordance with the provisions of N.J.S.A. 19:44A-1, and shall be in a form approved by the Borough.

 

4.                   The Business Disclosure Entity Certification and the Determination of Value shall be placed on file with this Resolution.

 

5.                   This Resolution and a copy of the contract for professional services shall be maintained on filed in the offices of the Borough Clerk for public inspection.

 

6.                   A copy of this Resolution shall be published in the legal newspaper designated by the Borough as required by law, within ten (10) days of its passage.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 660-16

Authorizing Retention Via Professional Services Agreement

Of A Certified Building Inspection Engineering Company Specializing In

Mold Remediation

 

WHEREAS, the Borough of Wildwood Crest requires the professional services of a Certified Building Inspection Engineering Company specializing in mold remediation; and

 

WHEREAS, it is desired to employ a professional, pursuant to law, who is duly trained, experienced and specialized in the area of skilled mold remediation; and

 

WHEREAS, the Local Public Contracts Law provides for the entering into of a contract for professional services pursuant to R.S.40A:11-5(1)(a), without advertising for competitive bidding; and

 

WHEREAS, the Borough has determined that Lockatong Engineering, Inc. of Rosemont, New Jersey is qualified to perform said work and it is desired to enter a professional contract with them for said services pursuant to law, and to provide for the advertising of a notice pursuant to law; and

 

WHEREAS, Lockatong Engineering, Inc., has completed and submitted a Business Entity Disclosure Certification which certifies that Lockatong Engineering, Inc. will not make any reportable contributions pursuant to N.J.S.A. 19:44A-1 commencing March 23, 2016 to any political committee or candidate through the term of this contract;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, as follows:

 

7.                   Lockatong Engineering, Inc. of Rosemont, New Jersey is hereby retained as Certified Building Inspection Engineer to provide specialized professional services in the field of mold remediation for through December 31, 2016. The said professional services to be received shall be “as directed” by the Borough of Wildwood Crest from time to time.

 

8.                   The Mayor and Borough Clerk be and they are hereby authorized and directed to enter into a contract with Locktatong Engineering, Inc. for specialized professional services in the field of mold remediation for a term of the period indicated above, which contract shall provide for payment at the not to exceed amount of ninety five hundred ($9,500.00) dollars.  Said award is further contingent upon the certification of availability of funds below by the CFO.

 

9.                   This contract is awarded without competitive bidding as a professional service in accordance with the provisions of the Local Public Contracts Law aforesaid, and in accordance with the provisions of N.J.S.A. 19:44A-1, and shall be in a form approved by the Borough.

 

10.                The Business Disclosure Entity Certification and the Determination of Value shall be placed on file with this Resolution.

 

11.                This Resolution and a copy of the contract for professional services shall be maintained on filed in the offices of the Borough Clerk for public inspection.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 661-16

AUTHORIZING SHARED SERVICES AGREEMENT WITH THE CITY OF NORTH WILDWOOD FOR BEACH SAND HARVESTING AND TRANSFER AND FOR THE DIRECT PAYMENT OR REIMBURSEMENT OF PROFESSIONAL SERVICES REQUIRED IN CONJUNCTION WITH THE PROJECT

 

WHEREAS, the Uniform Shared Services and Consolidation Act, N.J.S.A. 40A:65-1, et. seq., authorizes municipalities to enter into agreements for the exchange and sharing of services; and

 

WHEREAS, there exists a large amount of sand on the berm in the Borough of Wildwood Crest that can be removed without detriment to the shore protection of that municipality; and

 

WHEREAS, as a result of the storms and weather conditions experienced during 2015 and 2016 to date, various portions of the beaches in the City of North Wildwood, particularly the north-end beaches, are in dire need of immediate beach sand replenishment; and

 

WHEREAS, the City of North Wildwood’s engineering and beach surveying professionals have examined and analyzed the beach sand in the Borough of Wildwood Crest and have advised the Mayor and City Council that, under prevailing federal and state regulations, it would be lawful to utilize that sand for beach replenishment purposes on those north-end beaches in the City of North Wildwood that are in need of such replenishment; and

 

WHEREAS, the City of North Wildwood possesses all necessary federal and state permits that are needed to conduct beach replenishment activities on the City’s north-end beaches; and

 

WHEREAS, the governing bodies of the City of North Wildwood and the Borough of Wildwood Crest have determined that it would be mutually beneficial to enter into a Shared Services Agreement under the terms of which harvested beach sand will be transferred to North Wildwood in connection with beach replenishment uses by the City of North Wildwood; and

 

WHEREAS, the City of North Wildwood will bear the cost of engineering, surveying, and inspecting the beach, upon the submission of detailed billing both from in-house professionals as well as reimbursement to the Borough of Wildwood Crest upon the presentment of said invoices for prompt payment.  Said shared services agreement shall further include such remedial action to be taken by the City of North Wildwood as necessary to ensure that the beaches in the Borough of Wildwood Crest from which sand is harvested are properly graded and/or groomed to the extent necessary to return the beaches to their pre-harvested condition.

 

NOW, THEREFORE, BE IT RESOLVED, by the Members of the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May and State of New Jersey as follows:

 

1)  All of the statements of the preamble are incorporated herein by this reference thereto as though the same were set forth at length.

2)  The Mayor and the Borough Clerk, on behalf of the Borough of Wildwood Crest, be and they hereby are authorized to execute a Shared Services Agreement with the City of North Wildwood for the purposes aforesaid, the form and substance of which shall be subject to approval by the Borough Solicitor and Administrator.

3) Execution of the subject Shared Services Agreement shall be contingent upon adoption by the governing body of the City of North Wildwood at a public meeting conducted in accordance with the Open Public Meetings Act, N.J.S.A. 10:4-6, et. seq., of a Resolution authorizing the subject Shared Services Agreement.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 663-16

Resolution Incorporating Municipal Access Plan (MPAP) in the

Borough of Wildwood Crest Master Plan

 

WHEREAS, the Borough of Wildwood Crest Municipal Public Access Plan (MPAP) was submitted to the Borough Commissioners and reviewed at the regular meeting of March 23, 2016, and

 

WHEREAS, the governing body has approved the plan as submitted, and

 

WHEREAS, the governing body recognizes the need to make the MPAP an authorized component of the municipal decision making by incorporating it into the municipal master plan.

 

NOW, THEREFORE, BE IT RESOLVED by the Borough Commissioners of Wildwood Crest, the “Wildwood Crest Municipal Public Access Plan,” a copy of which is attached, is hereby approved.

 

FURTHER RESOLVED, the MPAP shall be incorporated into the municipal master plan within the land use plan element once approved.

 

FURTHER RESOLVED a copy of the plan shall be sent to the New Jersey Department of Environmental Protection for review and approval in accordance with N.J.A.C.7.7.

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, that the Borough Clerk be and she is hereby authorized, instructed and empowered to advertise Notice to Bidders in The Herald of Cape May County issue of March 30, 2016.

 

Sealed bids will be received by the Bid Opening Committee in the Municipal Court Room, Wildwood Crest Borough Hall, on Tuesday, April 12, 2016 at 11:00 a.m., prevailing time, for furnishing the items hereinafter set forth in accordance with the Specifications on file in the Borough Hall.  Said items are as follows:

CANCELING ERRONEOUS 2016 SEWER RENTS

 

                WHEREAS, it has been determined by the Tax Collector of the Borough of Wildwood Crest, that a sewer account has been billed erroneous sewer rents for 2016.

 

                WHEREAS, sewer account 858-1, at 6301 Ocean Avenue was returned to the Borough of Wildwood Crest, the sewer rents levied in 2016 should be canceled.

 

                WHEREAS, the Tax Collector of the Borough of Wildwood Crest has determined the said erroneous sewer rents should be canceled accordingly as indicated below.

WHEREAS, on March 2, 2016 , MIDDLE TWP ELEMENTARY SCHOOL #2 , 101 W. Pacific Ave , Cape May Court House, NJ 08210 , applied for a Special Events Permit for the purpose of a STUDENT FUN DAY   to be held on JUNE 10, 2016, (rain date June 13, 2016) ,  from 9:30 AM TO 2:00 PM, on the RAMBLER RD BEACH ; and

                                                                                                                                                         

WHEREAS,  MIDDLE TWP ELEMENTARY SCHOOL #2, 101 W. Pacific Ave, Cape May Court House, NJ 08210, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Deputy Municipal Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  MIDDLE TWP ELEMENTARY SCHOOL #2 , 101 W. Pacific Ave, Cape May Court House, NJ 08210 for the purpose of a STUDENT FUN DAY to be held on JUNE 10, 2016, (rain date June 13, 2016) , from 9:30 AM TO 2:00 PM, on the RAMBLER RD BEACH.

WHEREAS, on March 2, 2016 , WETLANDS PRODUCTIONS LLC , 531 W 25TH ST STE 3E , NEW YORK, NY 10001 , applied for a Special Events Permit for the purpose of a FEATURE FILM SHOOT   to be held from March 25, 2016 to May 14, 2016,  at VARIOUS LOCATIONS IN THE BOROUGH OF WILDWOOD CREST ; and

                                                                                                                                                         

WHEREAS,  WETLANDS PRODUCTIONS LLC, 531 W 25TH ST STE 3E, NEW YORK, NY 10001, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application for the filming of the movie with a PG-13 rating has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

WHEREAS, the terms and conditions as presented for application is supported in Appendix A of this resolution; and as

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  WETLANDS PRODUCTIONS LLC , 531 W 25TH ST STE 3E, NEW YORK, NY 10001 for the purpose of a FEATURE FILM SHOOT to be held from March 25, 2016 to May 14, 2016, at VARIOUS LOCATIONS IN THE BOROUGH OF WILDWOOD CREST.

 

APPENDIX A

·         Minimal Special event fee for various locations is $5,000 (due first day of operation); additional fee shall be pro-rated if it exceeds 31 days and anything above and beyond will be billed at a daily rate and paid weekly in advance

·         Utility fee for event period is $500

·         Additional services provided by the Borough including staff and/or equipment will be billed in accordance with Ordinance 1190 (post production clean up will be included)

·         Recognize conditions set forth in March 2, 2016 Special Events Application form

·         Various locations will include the use of the Public Building at 6301 Ocean Avenue

·         Wildwood Crest will not be mentioned, nor will the Borough name appear in any signage or script

Mr. Cabrera motioned, seconded by Mr. Groon, that the foregoing Resolution be adopted.

Mr. Groon motioned, seconded by Mr. Cabrera, that all bills properly authorized, as submitted, be paid.

Mr. Groon motioned, seconded by Mr. Cabrera, that all reports received from the CFO, Tax Collector, Court Administrator, and the Wildwood Crest Police Department for the month ending February 29, 2016 be approved as presented.

Mr. Groon motioned, seconded by Mr. Cabrera, that all Minutes from Commission Meetings from February 24, 2016 and March 9, 2016, as well as the Closed Session Minutes from February 24, 2016 be approved as presented.

The Mayor then opened the floor for public commentary.

 

Cliff Glenn, 111 W. Jefferson Avenue, inquired about the purpose of the sand harvesting project with North Wildwood. 

 

Marie Nickerson, 8801 Bayview Drive, inquired about the last resolution on the agenda and Commissioner Cabrera indicated that it was for a lease of the old library for a feature film production. 

 

Cliff Glenn, 111 W. Jefferson Avenue, pointed out that he sees many non-residents taking their recyclables to Public Works.  Commissioner Cabrera indicated that he would ask the Superintendent of Public Works about the situation.    Mr. Glenn then asked about the proposed dog park and where it would be located.  Mr. Cabrera indicated that the proposed location would be next to Public Works and there would also be a smaller soccer field as well.

 

Steve Spagnuolo, 8404 Seaview Avenue, wanted to know about the process moving forward to make the dog park happen.  He further indicated that the dog park on the beach on 24th street beach in North Wildwood has opened and seems to be a success.  Mr. Cabrera then added that he would like the neighbors to see the proposed plans and get their input and would like to address at the last meeting in April.

 

Kay Sparkman, 7705 New Jersey Avenue, asked if there would be a fee associated with using the dog park and Mr. Cabrera indicated that people would have to register their dog and there would be a fee.

 

After no further comments from the public, the Mayor moved to the Discussion of new business.  Commissioner Cabrera indicated that the leasing of the old library for a film production was discussed. 

 

The Mayor then added there were no developments with the generator or Sunset Lake mitigation.  The Mayor then addressed the next topic of Army Corps Beach Plans.  He touched upon the Army Corps’ proposed plan to build a 16’ dung the length of the island and that part of the excess sand would be moved back to North Wildwood every four years or so and that they would use very conservative slopes so the integrity of Wildwood Crest’s beaches is maintained.  He also pointed out that the sand back pass to North Wildwood would help with our outfall pipes.

 

There were no developments with the remaining topics in old business.   

 

The Mayor then opened the floor for public commentary regarding “new” and “old” business.

Cliff Glenn, 111 W. Jefferson Avenue, indicated that he was not in favor of spending money at the Rambler Road bike turnaround.

 

Lastly, for the record, both the Solicitor and Special Counsel were both present to answer questions regarding commentary from the public hearing of February 24, 2016.

 

Hearing nothing further from the public, Mr. Cabrera motioned, seconded by Mr. Groon that the meeting be adjourned.  Both Mayor Groon and Commissioner were in favor; Commissioner Gould was absent.  The time was 7:27 p.m.
