Minutes of Commissioners Meeting   -   February 4, 2015

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 7:00 p.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on November 12, 2014.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mr. Cabrera motioned, seconded by Mr. Groon, that Ordinance No. 1205 be placed on second reading and final passage by title only.

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 32A, FEES, OF THE CODE OF THE BOROUGH OF WILDWOOD CREST; AMENDING SECTION 32A-5, ADDITIONAL FEES; AND AMENDING ORDINANCE NO. 1167 ADOPTED MAY 8, 2013 AND ORDINANCE NO. 1190 ADOPTED APRIL 30, 2014

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 46, OFFICERS AND EMPLOYEES, ARTICLE I, UNUSED SICK LEAVE RETIREMENT BENEFIT, TO INCLUDE NEW SECTION 46-5.2, MEDICARE PART B REIMBURSEMENT, OF THE CODE OF THE BOROUGH OF WILDWOOD CREST

 

Mr. Cabrera motioned, seconded by Mrs. Gould, that Ordinance No. 1209 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on Wednesday, February 18, 2015 at 7:00 p.m.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 353-15

WHEREAS, Notice to Bidders was advertised in the Herald of Cape May County on October 22, 2014 with receipt of oral bids on November 6, 2014, and on December 3, 2014 with receipt of oral bids on December 16, 2014 for Beach Umbrella Concession in the Borough of Wildwood Crest; and

 

WHEREAS, no bids were received on either date; and

 

WHEREAS, the Board of Commissioners thereafter undertook to negotiate a three year contract for Beach Umbrella Concession;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest that as a result of negotiations conducted after twice advertising for bidders resulting in no bids being received, WILLIAM KELLY submitted an overall bulk bid amount of $151,500, over a three (3) year lease period, for the lease of all six (6) specified locations - as precisely defined and contained in the bid documents which are made a part hereof by reference as if fully set forth - otherwise known as Concession A, Concession B, Concession C, Concession D, Concession E, and Concession F, situate on the beach in the Borough of Wildwood Crest, and permitted to be utilized for the rental of beach umbrellas, beach chairs, and approved flotation devices, and sale of water only, it is hereby determined to be in the best interest of the Borough of Wildwood Crest to accept the highest, which has been submitted by WILLIAM KELLY for the said six (6) concession rentals and bid amount set forth hereinabove for calendar years 2015, 2016, and 2017.

 

BE IT FURTHER RESOLVED that Carl H. Groon, Mayor of the Borough of Wildwood Crest, and Janelle M. Holzmer, Borough Clerk, be and they are hereby authorized, instructed and empowered to execute and attest the Lease by and between the Borough of Wildwood Crest and WILLIAM KELLY, incorporating all of the terms and conditions of the above successful umbrella concession rental bid.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 354-15

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, that a “JIF SAFETY CONTRACT” with the ATLANTIC COUNTY MUNICIPAL JOINT INSURANCE FUND be and the same is hereby authorized and approved for participation in the annual Safety Incentive Program.

 

BE IT FURTHER RESOLVED that all designated and currently named Department Heads, specifically representing: POLICE, RECREATION, PUBLIC WORKS, AMBULANCE/RESCUE, AND ADMINISTRATION as set forth therein be and the same are likewise authorized, directed, and empowered to execute that portion of the contract which evidences participation in the aforesaid Safety Incentive Program as well as compliance with all requirements appertaining thereto.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 355-15

SUBJECT:           A RESOLUTION AUTHORIZING APPROVAL OF ESTIMATE CERTIFICATE NUMBER 6-FINAL  DPW GARAGE RENOVATIONS

 

WHEREAS, MJJ Construction, LLC of Atco, New Jersey has satisfactorily completed the contract for the project known as DPW Garage Renovations; and

 

WHEREAS, the Contractor has now submitted the final Payment Request Number 6 – FINAL on the project; and

 

WHEREAS, the Borough Engineer, Ralph Petrella Jr. of Van Note – Harvey Associates has recommended acceptance of the project as complete.

 

NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, that said Estimate Certificate Number 6 – FINAL be and the same are hereby approved.

 

AND BE IT FURTHER RESOLVED that the contract for said work be, and the same is hereby accepted, and that all payments to MJJ Construction, LLC be made thereon.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 356-15

WHEREAS, on January 14, 2015 , THOMAS FURLONG and CLARE GILLESPIE , 210 Wild Oak Lane, Unit 103 , Stafford, VA 22554 , applied for a Special Events Permit for the purpose of the FURLONG-GILLESPIE WEDDING   to be held on June 5, 2015 ,  from 1:00 p.m. to 5:00 p.m., at CENTENNIAL PARK ; and

                                                                                                                                                         

WHEREAS,  THOMAS FURLONG and CLARE GILLESPIE, 210 Wild Oak Lane, Unit 103, Stafford, VA 22554, have supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and have further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  THOMAS FURLONG and CLARE GILLESPIE , 210 Wild Oak Lane, Unit 103, Stafford, VA 22554 for the purpose of the FURLONG-GILLESPIE WEDDING to be held on June 5, 2015 , from 1:00 p.m. to 5:00 p.m., at CENTENNIAL PARK.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 357-15

WHEREAS, on January 26, 2015 , MARGARET SCHIAZZA , 609 Central Ave., Glenside , PA 19038 , applied for a Special Events Permit for the purpose of the SCHIAZZA/MONTAGUE WEDDING   to be held on May 9, 2015 ,  from 4:30 p.m. to 6:30 p.m., on the BEACH AT MONTEREY AVE ; and

                                                                                                                                                         

WHEREAS,  MARGARET SCHIAZZA, 609 Central Ave., Glenside, PA 19038, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  MARGARET SCHIAZZA , 609 Central Ave., Glenside, PA 19038 for the purpose of the SCHIAZZA/MONTAGUE WEDDING to be held on May 9, 2015, from 4:30 p.m. to 6:30 p.m., on the BEACH AT MONTEREY AVE.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing resolution be adopted.

The Mayor opened the floor for public commentary and he indicated the public will be given another opportunity to voice public concerns.  After hearing nothing from the public, the Mayor opened New Business with the Request for a Dog Park.  Commissioner Cabrera indicated the discussion was tabled from the last meeting to give Commissioner Gould the opportunity to hear the proposed request.  Commissioner Cabrera also indicated that he has received several emails over dog park concerns.  He further indicated that Mr. Steve Spagnola had presented a petition from numerous residents last fall requesting a dog park.  Commissioner Cabrera pointed out that the beach was an area to consider and that many municipalities are offering dog parks as well.  Commissioner Gould questioned if the beach was the best place to have a trial run for a dog park.  The Mayor indicated he was not if favor of the location and that an ordinance would have to be reviewed for exposure for the beach and he would like to consult with police with regards to enforcement as well.  Commissioner Gould requested more information on coastal communities with dog parks and Commissioner Cabrera indicated he would follow through with obtaining information. 

 

The second topic was the South Jersey Power Cooperative renewal and the Borough Clerk indicated it was the Electrical Cooperative that the Borough participates in with the County of Cape May for all of South Jersey.  The current contract expires in June and the South Jersey Power Cooperative is asking all those who wish to participate to let them know by February 13, 2015.  The Mayor asked that the Borough Clerk do a review of potential billing to ensure all accounts are listed and accurate.  The governing body was in agreement to move forward with South Jersey Power Cooperative and gave the Borough Clerk verbal authorization to follow through. 

 

Commissioner Cabrera added a new topic under New Business and he has been working with the Assistant Supervisor of Recreation identifying 10 photogenic areas in Wildwood Crest.  For the purpose of discussion, it would now be referred to as “Crest Selfie Spot” locations.  These would be areas to promote photo opportunities and it will be great free publicity. 

 

With regards to Old Business, there have been no changes to report. 

 

The Mayor once again opened the floor for public commentary.  Steve Spagnola, 8404 Seaview Avenue, presented several pamphlets regarding dog friendly parks and dog friendly beach parks and was in favor of Wildwood Crest trying it.  Samantha Freeman, 5900 Pacific Avenue, indicated that sand is better on joints and muscles for dogs with disabilities.  Vince Tenaglia, 105 West Jefferson Avenue, stated he also owns a business at 6805 Atlantic Avenue and cited the beach location is better because it acts as a buffer zone, he sees many people walking dogs while jogging, there are a few hotels that are pet friendly, and is therefore in favor of a dog park.  Michael Hawthorne, 102 East Preston Avenue, also is in favor of a dog park.  Vince Tenaglia, 105 West Jefferson Avenue, added there should not be a problem with DEP or EPA since Asbury Park, Wildwood and Brigantine all have dog beaches.  The Mayor indicated there may be a local ordinance to review first.  Nancy Pietropaoli, 6002 Seaview Avenue, has no objections to a dog park but worries parking may be a problem.  Ms. Pietropaoli wanted to know where the Borough’s emergency shelters are.  The Mayor indicated that Convention Center in Wildwood is an emergency shelter that is for the entire island.  Currently, Wildwood Crest does not have one.  It is being reviewed and perhaps to put a generator down at the school may happen in the future depending on financing.  Lastly, the Mayor indicated the library is expected to be finished by May, but the transfer date has yet to be determined.

 

After hearing nothing further from the public, Mr. Cabrera motioned, seconded by Mrs. Gould, that the meeting be adjourned at 10:19 a.m.
