Minutes of Commissioners Meeting   -   February 18, 2015

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 7:00 p.m.  On roll call the following answered to their names:

 

Gould – Cabrera – Groon – Yes

 

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing and same to the Gazette-Leader, Herald of Cape May County and The Press on November 12, 2014.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1209 be placed on second reading and final passage by title only.

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1209

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 46, OFFICERS AND EMPLOYEES, ARTICLE I, UNUSED SICK LEAVE RETIREMENT BENEFIT, TO INCLUDE NEW SECTION 46-5.2, MEDICARE PART B REIMBURSEMENT, OF THE CODE OF THE BOROUGH OF WILDWOOD CREST

ORDINANCE NO. 1211

A CAPITAL ORDINANCE PROVIDING FOR IMPROVEMENTS TO MUNICIPALLY OWNED PROPERTY AND ACQUISITION OF VARIOUS EQUIPMENT AND APPROPRIATING THEREFOR THE AMOUNT OF $1,410,000 FROM THE CAPITAL IMPROVEMENT FUND

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1211 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on Thursday, March 5, 2015 at 9:30 a.m.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 358-15

ANNUAL SEWER RATE

            WHEREAS, Borough of Wildwood Crest Ordinance Numbers 947 and 1203 contain formulas for the calculation and establishment of annual sewerage rates, including the current year Variable Rate Fee; and

 

                WHEREAS, the said calculations have been prepared and reviewed in accordance with the aforementioned Ordinances Numbered 947 and 1203; and

 

                WHEREAS, it is promulgated in Ordinance No. 947 the Commissioner of Revenue and Finance shall submit the proposed sewerage rates and minimum charges to the Board of Commissioners for confirmation by resolution; and

 

                WHEREAS, the rates as calculated, reviewed and submitted are as follows:

 

                Fixed Rate Charge:             $4.00 per 1000 gallons of metered water consumption

                Variable Rate Charge:        $23.01 per 1000 gallons of metered water consumption

                Minimum Annual Charge:                $124.00

 

                WHEREAS, the due date for the first quarter will be April 1, 2015 with a ten day grace period.

 

                NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May and the State of New Jersey, that the sewerage rates and minimum charges as presented by the Commissioner of Revenue and Finance be confirmed for calendar year 2015.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing resolution be adopted.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 359-15

SUBJECT:  LOCAL BUDGET OF THE BOROUGH OF WILDWOOD CREST, COUNTY OF CAPE MAY, NEW JERSEY, FOR THE FISCAL YEAR 2015

 

BE IT RESOLVED that the following statements of revenue and appropriations shall constitute the local budget for the year 2015.

 

BE IT FURTHER RESOLVED that said budget be published in The Cape May County Herald issue of March 4, 2015.

 

NOTICE is hereby given that the budget and tax resolution were approved by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey on February 18, 2015.

 

A hearing on the budget and tax resolution will be held in the Municipal Court Room in Borough Hall on Wednesday, MARCH 18, 2015 AT 7:00 P.M., Municipal Court Room, Borough Hall, 6101 Pacific Avenue, Wildwood Crest, New Jersey, at which time and place objections to said budget and tax resolution for the year 2015 may be presented by taxpayers and other interested persons.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 360-15

REFUND OVERPAYMENT ON

PROPERTY TAXES OR UTILITY PAYMENTS

 

            WHEREAS, the Tax Collector of the Borough of Wildwood Crest collected

from the property owner or it's designee an excess amount on 2015 property taxes and/or utility payments; and

 

                WHEREAS, an overpayment was created for the reason listed below, and

 

                WHEREAS, the Tax Collector of the Borough of Wildwood Crest has determined the said overpayment should be refunded accordingly as indicated below.

Collector should mark the records accordingly to reflect said refund as per the meeting on

February 18, 2015.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 361-15

 

WHEREAS, on January 26, 2015 , the OCEAN DRIVE RUN CLUB, INC. , PO Box 1245 , Southeastern, PA 19399 , applied for a Special Events Permit for the purpose of a FOOT RACE   to be held on March 29, 2015 ,  from 9:00 a.m. to 12:00 p.m. on PACIFIC AVE, RAMBLER RD and the BIKE PATH ; and

                                                                                                                                                         

WHEREAS,  the OCEAN DRIVE RUN CLUB, INC., PO Box 1245, Southeastern, PA 19399, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  the OCEAN DRIVE RUN CLUB, INC. , PO Box 1245, Southeastern, PA 19399 for the purpose of a FOOT RACE to be held on March 29, 2015 , from 9:00 a.m. to 12:00 p.m. on PACIFIC AVE, RAMBLER RD and the BIKE PATH.

WHEREAS, on January 26, 2015 , the NATIONAL MS SOCIETY , 1480 U.S. HWY 9 NORTH, SUITE 301, WOODBRIDGE , NJ 07095 , applied for a Special Events Permit for the purpose of a BIKE RIDE   to be held on May 17, 2015 , from 11:30 a.m. to 4:00 p.m., on VARIOUS STREETS in the Borough of Wildwood Crest ; and

                                                                                                                                                         

WHEREAS,  the NATIONAL MS SOCIETY, 1480 U.S. HWY 9 NORTH, SUITE 301, WOODBRIDGE, NJ 07095, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  the NATIONAL MS SOCIETY , 1480 U.S. HWY 9 NORTH, SUITE 301, WOODBRIDGE, NJ 07095 for the purpose of a BIKE RIDE to be held on May 17, 2015, from 11:30 a.m. to 4:00 p.m., on VARIOUS STREETS in the Borough of Wildwood Crest.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 363-15

WHEREAS, on February 5, 2015 , the LIFE ROLLS ON FOUNDATION , 6120 W. 75th St. , Los Angeles, CA 90045 , applied for a Special Events Permit for the purpose of an ADAPTED SURFING PROGRAM   to be held on June 21, 2015 ,  from 6:30 a.m. to 5:00 p.m., on the RAMBLER RD BEACH ; and

                                                                                                                                                         

WHEREAS,  the LIFE ROLLS ON FOUNDATION, 6120 W. 75th St., Los Angeles, CA 90045, has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  the LIFE ROLLS ON FOUNDATION , 6120 W. 75th St., Los Angeles, CA 90045 for the purpose of an ADAPTED SURFING PROGRAM to be held on June 21, 2015, from 6:30 a.m. to 5:00 p.m., on the RAMBLER RD BEACH.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing resolution be adopted.

Mrs. Gould motioned, seconded by Mr. Cabrera, that all reports received from the Court Administrator, CFO, Tax Collector and the Wildwood Crest Police Department for month ending January 31, 2015 be accepted as presented.

Mrs. Gould motioned, seconded by Mr. Cabrera, that the minutes of Commission meetings held on January 21, 2015 and February 4, 2015 be approved as presented.

The Mayor opened the floor for public commentary.  Michael Hawthorne, 102 East Preston Avenue, voiced comments regarding his employment with the Borough of Wildwood Crest.  The Solicitor responded.  A member of the audience also responded regarding a ruling.  Commissioner Cabrera indicated that he was asked to have a meeting at Mr. Hawthorne’s home (at Mr. Hawthorne’s request).  Diana Gant Brunell, 110 E. Palm Road, also commented and the Solicitor responded.  Michael Hawthorne, 102 East Preston Avenue, once again made a comment to which the Solicitor responded.  Tom Hunt, 210 East Charleston Avenue, made several comments.  The Mayor responded in kind. The Solicitor also responded.  The Mayor defended his stance on not releasing certain reports and indicated when the judge makes his ruling that the Borough of Wildwood Crest will abide.  Michael Hawthorne, 102 East Preston, once again made a commentary.  Rodney Lo Scalzo, 7608 Pacific Avenue, voiced concerns over his lawn with the construction on New Jersey Avenue.  Commissioner Gould indicated that she would take copies of the pictures and forward to Mr. Joe Bond, Commissioner Cabrera indicated that he would like a copy as well. 

 

The Mayor indicated he had nothing for new business or old business.  The Commissioners were in agreement. 

 

Pat Anselmo, 9405 Pacific Avenue, stressed to “do the right thing morally” regarding prior comments from Mr. Hawthorne.  Steve Lauriello, 112 East Monterey Avenue, commented about the sand problem from the construction on his street.   The Mayor encouraged Mr. Lauriello to have anyone affected to call Borough Hall.

 

The Mayor asked if there were any additional public comments.  Hearing nothing further from the public, Commissioner Gould motioned, seconded by Commissioner Cabrera, that the meeting be adjourned.  The time was 8:21 p.m.
