Minutes of Commissioners Meeting   -   September 17, 2014

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 7:00 p.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader, Herald of Cape May County and The Press on November 26, 2013.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1196 be placed on second reading and final passage by title only.

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1196

 

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 32A, FEES, GENERAL, OF THE CODE OF THE BOROUGH OF WILDWOOD CREST, ESTABLISHING SECTION 32A-5, EMERGENCY MEDICAL TRANSPORT SERVICES CHARGES, AND AMENDING ORDINANCE NO. 920, ESTABLISHING EMERGENCY MEDICAL TRANSPORT SERVICES FOR SERVICES RENDERED WITHIN THE BOROUGH OF WILDWOOD CREST, COUNTY OF CAPE MAY AND STATE OF NEW JERSEY, ADOPTED NOVEMBER 25, 2002; AND AMENDING ORDINANCE NO. 1091 ADOPTED JANUARY 27, 2010; RENUMBERING SECTION 32A-5, ADDITIONAL FEES, AS SECTION 32A-6; AND AMENDING ORDINANCE NO. 1167 ADOPTED MAY 8, 2013

There being no public comments, Mrs. Gould motioned, seconded by Mr. Cabrera, that the public hearing on Ordinance No. 1196 be closed.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 235-14

WHEREAS, Nina Eisenfeld, 402 Lavender Hill Drive, Cherry Hill, NJ 08003, paid the requisite fee for participation as a vendor for the Seafarers Weekend Celebration on September 19-20, 2014 in the amount of $125.00, and for the Firefighters Weekend Craft Show on September 12-13, 2014 in the amount of $125.00; and

 

WHEREAS, Nina Eisenfeld has requested a refund of the total fees paid in the amount of $250.00 due to an injury necessitating her withdrawal from both events.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Chief Financial Officer of the Borough of Wildwood Crest be and she is hereby authorized and directed to cause a refund in the amount of $250.00 to be made to Nina Eisenfeld, 402 Lavender Hill Drive, Cherry Hill, NJ 08003 for the reasons more fully set forth above.

RESOLUTION NO. 236-14

WHEREAS, on September 9, 2014 , the NORTH AMERICAN POWER KITE ASSOCIATION (NAPKA) , P.O. Box 1358 , Westport, WA 98595 , applied for a Special Events Permit for the purpose of a KITE BUGGY EVENT   to be held from October 15-19, 2014 ,  from 8:00 a.m. until dusk, on the WILDWOOD CREST BEACH ; and

                                                                                                                                                         

WHEREAS,  the NORTH AMERICAN POWER KITE ASSOCIATION (NAPKA), P.O. Box 1358, Westport, WA 98595 has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and she is hereby authorized and directed to issue a Special Events Permit to  the NORTH AMERICAN POWER KITE ASSOCIATION (NAPKA) , P.O. WHEREAS, on September 9, 2014 , REGINALD CORBIN & REGINA FIRBY , 1612 Woodbrook Lane, , Philadelphia, PA 19150 , applied for a Special Events Permit for the purpose of a WEDDING   to be held on September 19, 2014 ,  from 11:00 a.m. to 12:00 p.m., at SUNRISE PARK ; and

                WHEREAS, an overpayment was created for the reason listed below, and

The Mayor opened up the floor for public commentary.  After hearing no comments from the public, the Mayor opened new business.  The Army Corps Beach Plan has not had any developments to report.  With regards to the Memorial Benches, the Administrator indicated he is still working on that.  The next topic of Borough work hours has had no further developments.  The next topic was Emergency Generators and the Mayor reminded the Board that approximately two years ago an ordinance was passed to place a generator at Crest Memorial School, which will serve as the evacuation center for the Borough.  Also, the Borough applied for a grant through county and FEMA and Mr. Eugene Taylor, Director of Public Safety, is currently working on this.  The Borough received the grant and it was decided to hold back on using the ordinance money until information was received, and it is now time to move forward with the ordinance.  The Mayor also wanted to remind the commissioners that during a recent power outage, the Borough Administration side was not covered by an emergency generator and the Superintendent of Public Works indicated he would find out what the generator actually powers.  The Mayor indicated that Crest Memorial as the evacuation center should be handled first and then the generator for Borough Hall.  The next topic was Sunset Lake Storm Damage update and snow fencing was put up and the Director of Public Safety was going to handle it.  The Mayor indicated the under FEMA, only repairs are covered.  There may be grant money available and this needs to be researched.  Originally FEMA denied the original application and the Borough was working on an appeal of that process.  Lastly, Commissioner Cabrera wanted to discuss the NJEIT October 10, 2014 application deadline.  The Engineer indicated that there is another round of funding available and that it would be up to the governing body to pursue it, and if interested, immediate action was needed.  He also indicated that a lengthy report would have to accompany the letter of interest.  The Mayor pointed out that with the New Jersey Avenue project; he believed there was an opportunity to have the funding through grant money.  It was denied and the Mayor believed the type of work fit within the criteria and the Engineer indicated any sanitary sewer and storm sewer driven project was eligible. The Engineer added that projects are ranked and essentially most of the grant money went to Ocean County.  Furthermore, he added that all those apply and meet the deadlines and supply necessary documents will receive funding, but it could be loans.  The Mayor wanted to know if there could be a review of the New Jersey Avenue proposal and the Engineer indicated that it could.  The CFO added that the cost of implementing the infrastructure is very expensive and that what is in the Capital Plan in the foreseeable future which would fall into FY2016 program, administratively to try to enter this program would be very costly and that BANs are less expensive.  The Commissioners decided to schedule a Special Meeting on Wednesday, September 24, 2014 to discuss the Capital Plan.  Lastly, the Mayor added that there is still a section of New Jersey Avenue to do that will involve the county and there is a timeframe for that.  There will need to be discussions with the County because they are responsible for the asphalt and the safety walkways. 

 

The Mayor then opened the floor once again for public commentary.  After hearing nothing from the public, Mrs. Gould motioned, seconded by Mr. Cabrera, that the meeting be adjourned.
