Minutes of Commissioners Meeting   -   June 11, 2014

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader, the Herald and The Press on November 26, 2013.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mr. Groon motioned, seconded by Mr. Cabrera, that Ordinance No. 1191 be placed on second reading and final passage by title only.

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 79, VEHICLE AND TRAFFIC, OF THE CODE OF THE BOROUGH OF WILDWOOD CREST, SECTION 79-6, PARKING TIME LIMITED, SCHEDULE IV, AND AMENDING ORDINANCE NO. 388 ADOPTED AUGUST 14, 1968, ORDINANCE NO. 478 ADOPTED APRIL 9, 1975, ORDINANCE NO. 522 ADOPTED MAY 24, 1978, ORDINANCE NO. 592 ADOPTED MAY 1, 1984 AND ORDINANCE NO. 1170 ADOPTED JUNE 12, 2013

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 173-14

WHEREAS, on March 15, 2011 the Borough of Wildwood Crest, New Jersey, received a certified check in the amount of Four Thousand Nine Hundred ($4,900.00) Dollars from 8900 Bayview Contractors, LLC (BVC), said check representing a Performance Guaranty for a street opening at 8901 Bayview Avenue, Wildwood Crest, New Jersey; and

 

WHEREAS, on this same date, the Borough received a certified check in the amount of Seven Hundred Thirty Five ($735.00) Dollars from BVC representing a Maintenance Guaranty for a street opening at 8901 Bayview Avenue; and

 

WHEREAS, BVC has satisfactorily completed the required work at 8901 Bayview Avenue, BVC has now requested a refund of the Five Thousand Six Hundred Thirty-Five ($5,635.00) Dollars deposited with the Borough of Wildwood Crest, and it is the desire of the Board of Commissioners of the Borough of Wildwood Crest to grant said request.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Chief Financial Officer be and she is hereby authorized and directed to issue a refund in the amount of Five Thousand Six Hundred Thirty-Five ($5,635.00) Dollars to Bayview Contractors LLC.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 174-14

WHEREAS, the Wildwood Crest Beach Patrol is in need of a four-wheel drive utility vehicle for use on the beach; and

 

WHEREAS, it is the desire of the governing body to rent/lease said utility vehicle;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, as follows:

 

                1.             That the preamble hereto is repeated as if set forth in full.

 

                2.             That the Wildwood Crest Beach Patrol be authorized to rent/lease from Sunbelt Rentals, 223 Paulsboro Road, Swedesboro, NJ 08085, one (1) four-wheel drive, four seat  gasoline utility vehicle for the period July 1, 2014 through September 1, 2014, for the total rental amount of $1,962.80.

 

                3.             That the Mayor and Borough Clerk be and they are hereby authorized and instructed to execute any and all documents necessary to effectuate said rental/lease agreement.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 175-14

WHEREAS, Dennis Travascio has tendered his resignation as a Member of the ZONING BOARD of the Borough of Wildwood Crest; and

 

WHEREAS, the term of Dennis Travascio as a Member  of the ZONING BOARD of the Borough of Wildwood Crest expires December 31, 2015; and

 

WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest wish to appoint GREG GRASSO 110 West Crocus Road, Wildwood Crest, New Jersey, to fill the unexpired term of Dennis Travascio;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, that GREG GRASSO be and he is hereby appointed as a Member  of the ZONING BOARD of the Borough of Wildwood Crest for the balance of the unexpired term of Dennis Travascio, commencing immediately and expiring December 31, 2015.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

WHEREAS, in 2000, the Borough of Wildwood Crest purchased a 2000 E-One Emergency Fire Truck, VIN 4EN3AAA84Y1000867, for the Wildwood Crest Volunteer Fire Company No. 1; and

 

WHEREAS, it is the desire of the Wildwood Crest Volunteer Fire Company No. 1 to sell said vehicle, and utilize the proceeds from said sale toward the purchase of a replacement vehicle; and

 

WHEREAS, it is the desire of the governing body to authorize said sale;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, as follows:

 

                1.             That the preamble hereto is repeated as if set forth in full.

 

                2.             That the Wildwood Crest Volunteer Fire Company No. 1 be and it is hereby authorized to see the 2000 E-One Emergency Fire Truck, VIN 4EN3AAA84Y1000867, and to utilize the proceeds from said sale toward the purchase of a replacement vehicle.

 

                3.             That the Borough Clerk be and she is hereby authorized and instructed to execute the title to the 2000 E-One Emergency Fire Truck, VIN 4EN3AAA84Y1000867, for the purpose of said sale.

WHEREAS, on June 6, 2014 ,  the GREATER WILDWOOD YACHT CLUB , 6510 Park Blvd. , Wildwood Crest, NJ 08260 , applied for a Special Events Permit for the purpose of a YOUTH REGATTA   to be held on June 26, 2014 ,  from 8:00 a.m. to 3:00 p.m., on Sunset Lake and Park Blvd. between Rosemary Rd. and Forget-Me-Not Rd. ; and

                                                                                                                                                         

WHEREAS,  VIETNAM VETERANS OF AMERICA CHAPTER 955, 4200 Atlantic Ave., Wildwood, NJ 08260 has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and have further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 183-14

Authorizing Retention Of Can You Dig It Sand Tools/Matt Long

For an Amateur Sand Sculpting Contest

 

WHEREAS, the Borough of Wildwood Crest requires the services of a sand sculpting contest professional to assist the municipality with an amateur sand sculpting contest to be held on Saturday, July 12, 2014 on the beach in Wildwood Crest; and

 

WHEREAS, obtaining quotes for said services would be impractical and not possible due to the limited vendors providing services of this nature; and

 

WHEREAS, the Local Public Contracts Law provides for the entering into of a contract for extraordinary unspecified services pursuant to R.S.40A:11-5(1)(a)(ii), without advertising for competitive bidding; and

 

WHEREAS, the Borough has determined that Can You Dig It Sand Tools/Matt Long is qualified to perform the said work and it is desired to enter a contract with them for said services pursuant to law, and to provide for the advertising of a notice pursuant to law; and

 

WHEREAS, Can You Dig It Sand Tools/Matt Long has completed and submitted a Business Entity Disclosure Certification which certifies that Can You Dig It Sand Tools/Matt Long will not make any reportable contributions pursuant to N.J.S.A. 19:44A-1 commencing June 11, 2014 to any political committee or candidate through the term of this contract;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, as follows:

 

1.                   Can You Dig It Sand Tools/Matt Long is hereby retained to assist with an amateur sand sculpting contest to be held on Saturday, July 12, 2014 on the beach in Wildwood Crest as an extraordinary unspecified service. The said services to be received shall be “as directed” by the Borough of Wildwood Crest.

 

2.                   The Commissioner of Revenue and Finance and Borough Clerk be and they are hereby authorized and directed to enter into a contract with Can You Dig It Sand Tools/Matt Long for specialized services, which contract shall provide for fees not to exceed $6,500, contingent upon certification below from the Chief Financial Officer as to the availability of funds.

 

3.                   This contract is awarded without competitive bidding as an extraordinary unspecified service in accordance with the provisions of the Local Public Contracts Law aforesaid, and in accordance with the provisions of N.J.S.A. 19:44A-1, and shall be in a form approved by the Borough.

 

4.                   The Business Disclosure Entity Certification and the Determination of Value shall be placed on file with this Resolution.

 

5.                   This Resolution and a copy of the contract for professional services shall be maintained on filed in the offices of the Borough Clerk for public inspection.

 

6.                   A copy of this Resolution shall be published in the legal newspaper designated by the Borough as required by law, within ten (10) days of its passage.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 184-14

OPPOSING INCLUSION OF THE SUMMER WORK TRAVEL PROGRAM IN FEDERAL LEGISLATION PERTAINING TO COMPREHENSIVE IMMIGRATION REFORM AND THE FORTE ACT

 

WHEREAS, the Borough of Wildwood Crest supports the continuation and protection of the U.S. State Department managed J-1 Visa Summer Work Travel Program, which allows international college students to come to the United States to work and travel for a period of up to four months during their summer break prior to returning to school in their home country, and

 

WHEREAS, the J-1 Visa Summer Work Travel Program provides important cultural diversity as well as a very important seasonal supplement to businesses in Cape May County and is integral to the success of our seasonal tourism industry, and

 

WHEREAS, the Summer Work Travel program was created to promote educational and cultural exchanges with other countries and has been an important public diplomacy tool for the Department of State and has a successful track record spanning over fifty years, and

 

WHEREAS, Tourism is the number one job creator in Cape May County and is the 3rd largest industry in New Jersey, and

 

WHEREAS, students  who participate in the SWT in Cape May County provide a valuable asset to the local economy by enabling many seasonal businesses to be open when the local workforce is not available or sufficient in numbers, and

 

WHEREAS, although supplemental to our local workforce, if the SWT program were to be eliminated, Cape May County would experience huge economic losses due to our insufficient number of available local workers between March and October as well as the loss of jobs that are supported by the SWT program, and

 

WHEREAS, the Summer Work Travel Program students comprise a small, but important, part of our Cape May County Community, and

 

WHEREAS, the Summer Work Travel Program is being incorrectly incorporated into the comprehensive immigration reform bill (S. 744) which passed the Senate in 2013 and has been included in the language of the FORTE ACT, H.R. 4586, and

 

WHEREAS,  inclusion in either federal legislative actions would have a devastating impact on the Summer Work Travel Program and therefore the Cape May County tourism economy;

 

NOW, THEREFORE, BE IT RESOLVED that that the Borough of Wildwood Crest recognizes the Summer Work Travel Program as an independent, cultural, public diplomacy program overseen by the Department of State and further recognizes this program as a benefit to the Cape May County, New Jersey tourism economy, and;

 

BE IT FURTHER RESOLVED that, the Borough of Wildwood Crest opposes incorporation of the Summer Work Travel program in comprehensive immigration reform legislation and the FORTE ACT.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

The Mayor opened the floor for public comment. There being no public comments, the Mayor introduced the first topic of New Business:  Army Corps Beach Plan.  Commissioner Cabrera indicated that Hatch Mott MacDonald is still working with the state and that he has yet to hear any further developments.  The Mayor then indicated that he would like the new Administrator to be aware of the Army Corps’ proposed plan. 

 

With regards to Old Business, Commissioner Cabrera indicated that he would be getting together with the new Administrator on the subject of “branding.” 

 

With no other Old Business to discuss, the Commissioners welcomed the new Administrator, Thomas Henshaw.  Mr. Henshaw indicated that he was currently working on “branding” and the Personnel Manual.  The Mayor then pointed out that that those two items could be removed from the next agenda. 

 

The floor was once again opened for public comment.  Hearing nothing further from the public, Mrs. Gould motioned, seconded by Mr. Cabrera, that the meeting be adjourned.
