Minutes of Commissioners Meeting   -   March 26, 2014

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader, the Herald and The Press on November 28, 2012.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1188

AN ORDINANCE TO AMEND SECTION 59-3 OF THE CODE OF THE

BOROUGH OF WILDWOOD CREST, KNOWN AS THE “SALARY

THE CLERK READS RESOLUTION NO. 75-14 AUTHORIZING APPROVAL OF THE CY 2014 MUNICIPAL BUDGET ADOPTED ON FEBRUARY 26, 2014

 

SUBJECT:  LOCAL BUDGET OF THE BOROUGH OF WILDWOOD CREST, COUNTY OF CAPE MAY, NEW JERSEY, FOR THE FISCAL YEAR 2014

 

BE IT RESOLVED that the following statements of revenue and appropriations shall constitute the local budget for the year 2014.

 

BE IT FURTHER RESOLVED that said budget be published in The Cape May County Herald issue of March 12, 2014.

 

NOTICE is hereby given that the budget and tax resolution were approved by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey on February 26, 2014.

 

A hearing on the budget and tax resolution will be held in the Municipal Court Room in Borough Hall on Wednesday, MARCH 26, 2014 AT 7:00 P.M., Municipal Court Room, Borough Hall, 6101 Pacific Avenue, Wildwood Crest, New Jersey, at which time and place objections to said budget and tax resolution for the year 2014 may be presented by taxpayers and other interested persons.

 

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 100-14

            WHEREAS, N.J.S.A. 40A:4-78b has authorized the Local Finance Board to adopt rules that permit municipalities in sound fiscal condition to assume the responsibility, normally granted to the Director of the Division of Local Government Services, of conducting the annual budget examination; and

 

WHEREAS, N.J.A.C. 5:30-7 was adopted by the Local Finance Board on February 11, 1997; and

 

WHEREAS, pursuant to N.J.A.C. 5:30-7.2 thru 7.5, the Borough of Wildwood Crest has been declared eligible to participate in the program by the Division of Local Government Services, and the Chief Financial Officer has determined that the Borough of Wildwood Crest meets the necessary conditions to participate in the program for the 2011 budget year;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, that in accordance with N.J.A.C. 5:30-7.6a & b and based upon the Chief Financial Officer’s certification, the governing body has found the budget has met the following requirements:

 

                1.  That with reference to the following items, the amounts have been calculated pursuant to law and appropriated as such in the budget:

 

                a.  Payment of interest and debt redemption charges

                b.  Deferred charges and statutory expenditures

                c.  Cash deficit of preceding year

                d.  Reserve for uncollected taxes

                e.  Other reserves and non-disbursement items

                f.  Any inclusions of amounts required for school purposes

 

                2.  That the provisions relating to limitation on increases of appropriations pursuant to N.J.S.A. 40A:4-45.2 and appropriations for exceptions to limits on appropriations found at 40A:4-45.3, et. seq., are fully met (Complies with the “CAP” law).

 

                3.  That the budget is in such form, arrangement, and content as required by the Local Budget Law and N.J.A.C. 5:30-4 and 5:30-5.

 

                4.  That pursuant to the Local Budget Law:

 

                a.  All estimates of revenue are reasonable, accurate, and correctly stated,

                b.  Items of appropriation are properly set forth,

                c.  In itemization, form, arrangement, and content the budget will permit the exercise of  

                   the comptroller function within the municipality.

 

                5.  The budget and associated amendments have been introduced and publicly advertised in accordance with the relevant provisions of the Local Budget Law, except that failure to meet the deadlines of NJ.S.A. 40A:4-5 shall not prevent such certification.

 

                6.  That all other applicable statutory requirements have been fulfilled.

 

BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the Director of the Division of Local Government Services.

THE CLERK READS THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 101-14

WHEREAS, N.J.S.A. 40A:4-8 provides that the budget be read by title only at the time of the public hearing if a Resolution is passed by not less than a majority of the full membership of the governing body, providing that at least one week prior to the date of hearing a complete copy of the approved budget is advertised, has been posted on the bulletin board in Borough Hall, and copies have been made available by the Borough Clerk to persons requiring them on a daily basis thereafter, including the date and time of the actual public hearing held as a result thereof; and

 

WHEREAS, these required conditions have been made;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, State of New Jersey, that the municipal budget of the Borough of Wildwood Crest be read by title only.

RESOLUTION NO. 102-14:

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the budget hereinbefore set forth is hereby adopted and shall constitute an appropriation for the purposes stated of the sums therein set forth as appropriations, and authorizations of the below amount of $14,408,275.25 for municipal purposes.

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, that the Borough Clerk be and she is hereby authorized, instructed and empowered to advertise Notice to Bidders in The Herald of Cape May County issue of April 9, 2014.

 

Sealed bids will be received by the Bid Opening Committee in the Municipal Court Room, Wildwood Crest Borough Hall, on Tuesday, April 22, 2014, AT 11:00 A.M., prevailing time, for furnishing the items hereinafter set forth in accordance with the Specifications on file in the Borough Hall.  Said items are as follows:

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, that the Borough Clerk be and he is hereby authorized, instructed and empowered to advertise Notice to Bidders in The Herald of Cape May County issue of April 2, 2014.

 

Sealed bids will be received by the Purchasing Committee in the Municipal Court Room, Wildwood Crest Borough Hall, on Tuesday, April 15, 2014, AT 11:00 A.M., prevailing time, for furnishing the items hereinafter set forth in accordance with the Specifications on file in the Borough Hall.  Said items are as follows:

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 105-14

WHEREAS, bids have been received in response to advertisement of NOTICE TO BIDDERS dated February 26, 2014, and published in The Herald of Cape May County issue of March 5, 2014, for the following item:

 

BEACH CLEANER WITH HYDRAULIC PUMP POWER; and

 

WHEREAS, the Solicitor has reviewed the bids submitted and thereby provided a legal opinion recommending that the contract be awarded to the “lowest responsible bidder,” H. BARBER & SONS, 15 Raytkwich Drive, Naugatuck, CT 06770, for the total lump sum bid of $37,442.64 for the item described above; that said award is further conditioned upon technical review by the Public Works Superintendent, as to compliance with the bid specifications, along with the certification of availability of funds below by the Chief Financial Officer; and

 

WHEREAS, the legal opinion provided does specifically recommend that the contract be awarded to the above “lowest responsible bidder,” and is finally conditioned upon compliance with the Notice to Bidders, Specifications, Bid Proposal Form and all other related bid/contract documents appertaining to this award which are made a part hereof by reference as if fully set forth; and

 

WHEREAS, the Public Works Superintendent and Motor Pool Supervisor have reviewed the total and complete bids submitted in conjunction with the specifications and all other requirements appertaining thereto and has certified that the compliance has been met and that a contract be awarded to H. BARBER & SONS, 15 Raytkwich Drive, Naugatuck, CT 06770, for the total bid amount of $37,442.64.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May and State of New Jersey, as follows:

 

                1.  That the allegations of the preamble hereto are incorporated hereby in reference as if fully set forth.

                2.  That a contract be awarded to the successful bidder, H. BARBER & SONS, 15 Raytkwich Drive, Naugatuck, CT 06770, for the total and complete bid price of $37.442.64; all of which is subject to certification below by the Chief Financial Officer as to the availability of funds.

                3.  That the Commissioner of Revenue & Finance and Borough Clerk be and they are hereby authorized and directed to execute and attest said contract on behalf of the Borough provided necessary funds are available.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 106-14

WHEREAS, it has been determined by the Board of Commissioners of the Borough of Wildwood Crest that it would be in the public interest to have the general and permanent ordinances of the Borough of Wildwood Crest codified and revised; and

 

WHEREAS, it has been further determined by the Board of Commissioners, pursuant to N.J.S.A. 40A:4-56, that the services to be rendered are of a special technical nature;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, that Coded Systems LLC, a limited liability company of the State of New Jersey, whose principal offices are located in the Borough of Spring Lake Heights, Monmouth County, State of New Jersey, is hereby designated to codify and revise the general and permanent ordinances of the Borough of Wildwood Crest in accordance with the provisions of a certain Agreement to be executed and dated simultaneously with the adoption of this resolution, at the not to exceed contract amount of $9,200. Said Agreement provides for the work to be performed in accordance with the proposal as submitted. A copy of the Agreement shall be on file in the Office of the Borough Clerk.

 

BE IT FURTHER RESOLVED that the aforesaid Agreement is hereby made a part of this resolution, and the terms and provisions set forth therein are adopted as legal and binding on all parties concerned.

BE IT FURTHER RESOLVED that a certified copy of this resolution be transmitted to Coded Systems LLC with directions that the work on the codification shall be commenced immediately, and a copy of this resolution be advertised according to law.

 

BE IT FURTHER RESOLVED that the Mayor and Borough Clerk be, and they are hereby authorized to execute the Agreement on behalf of the Borough of Wildwood Crest, subject to certification below of availability of funds by the Chief Financial Officer.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 107-14

WHEREAS, William G. Blaney, Esquire, of the law firm of Blaney & Donohue, P.A. represents the Borough of Wildwood Crest in the on-going matter of Hunt v. Borough of Wildwood Crest, et al; and

 

WHEREAS, it is in the best interest of the Borough of Wildwood Crest to continue the retention of William G. Blaney, Esquire, as special counsel for the Borough of Wildwood Crest in regard to the above referenced matter.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, that William G. Blaney, Esquire, of the firm of Blaney & Donohue, P.A., be and he is hereby authorized to be exclusively retained as the attorney of record for the Borough of Wildwood Crest in the matter of Hunt v. Borough of Wildwood Crest, et al, and to continue said representation at the hourly rate of $140.00 as a professional services contract award through final adjudication of the aforesaid pending matter, said contract to be effective March 26, 2014 through March 25, 2015.

RESOLUTION NO. 108-14

REFUND OVERPAYMENT ON

PROPERTY TAXES OR UTILITY PAYMENTS

                WHEREAS, the Tax Collector of the Borough of Wildwood Crest collected

from the property owner or it's designee an excess amount on 2014 property taxes and/or utility payments; and

 

                WHEREAS, an overpayment was created for the reason listed below, and

 

                WHEREAS, the Tax Collector of the Borough of Wildwood Crest has determined the said overpayment should be refunded accordingly as indicated below.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 109-14

 

ESTABLISHING A COMMITTEE FOR A”PROGRAM FOR PUBLIC INFORMATION” (PPI)

WHEREAS, the Borough of Wildwood Crest is evaluated by the Community Rating Service (CRS) for Floodplain Management and is assigned a final score based on participation in various elements of the program, including outreach and education activities; and

WHEREAS, the Borough’s property owners receive discounted premiums on their home flood insurance based on the rating the Borough achieves; and

WHEREAS, the Borough currently realizes a twenty-percent (20%) rating and the Commission strives to improve upon that; and

WHEREAS, establishing a PPI Committee in accordance with Section 332.c of the CRS Coordinator’s Manual may help the Borough achieve a better rating.

NOW, THEREFORE, BE IT RESOLVED by the Commissioners of the Borough of Wildwood Crest that the following individuals be and are hereby appointed to the Wildwood Crest PPI Committee:

1.       Representative for the Borough’s Floodplain Management Office: Pat Malia, Construction Official

2.       Representative from the Borough’s Public Information Office: Janelle Holzmer, Borough Clerk

3.       Member of the Zoning Board of Adjustment: Dennis Travascio, William Carr, Peter Cava, Peter Compare, Herbert Hornsby, and Alan Seijas

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 110-14

WHEREAS, a vacancy has arisen on the Wildwood Crest Zoning Board of Adjustment; and

 

WHEREAS, said vacancy has an unexpired term through December 31, 2014; and

 

WHEREAS, it is the desire of the Board of Commissioners to fill said vacancy; and

 

WHEREAS, the name of PAULINE LEVY has been submitted to fill the vacancy as an Alternate Member of the ZONING BOARD of the Borough of Wildwood Crest; and

 

WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest desires to appoint PAULINE LEVY to this position;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, that PAULINE LEVY be and she is hereby appointed as Alternate Member No. 2 of the ZONING BOARD of the Borough of Wildwood Crest to fill the unexpired term, commencing effective immediately, and expiring December 31, 2014.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 111-14

WHEREAS, Section 40-16, et. seq., of the Code of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, sets forth the pertinent law regarding the issuance of licenses to persons, firms or corporations desiring to engage in the peddling and soliciting of ice cream products within the Borough of Wildwood Crest; and

 

WHEREAS, certain Licenses, for which applications have been filed for the vending of Ice Cream Products during the calendar year 2014, are now available.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, the Governing Body of the Borough of Wildwood Crest, as follows:

RESOLUTION NO. 112-14

WHEREAS, Dianne Kelly, the part-time Tax Assessor of the Borough of Wildwood Crest,  commenced full-time employment with the City of Ventnor effective March 3, 2014; and

 

WHEREAS, the Borough of Wildwood Crest has determined that it is in the best interest of the Borough to continue the part-time status of the Tax Assessor position; and

 

WHEREAS, the Board of Commissioners has determined to ratify the appointment by Commissioner Joyce P. Gould of a candidate for the part-time position of Tax Assessor;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, as follows:

 

                1.             That the appointment of Megan Fasy by Commissioner Joyce P. Gould be and the same is hereby confirmed and ratified commencing effective March 28, 2014, through the unexpired term of Dianne Kelly of June 30, 2015, in accordance with the provisions of N.J.S.A. 40A:9-148.

 

                2.             That Megan Fasy shall work on a part-time weekly basis each Wednesday and Friday, from 9:00 a.m. to 4:30 p.m., two Wednesday evenings per month and two Saturday mornings per month, and at such other additional dates and times necessary to fulfill all statutory requirements of the position of Tax Assessor.

 

                3.             That Megan Fasy shall be compensated at an annual salary as determined by the Commissioner of Revenue and Finance, in accordance with the provisions of the current salary ordinance of the Borough of Wildwood Crest. Due to the part-time nature of the position, health insurance benefits shall not be provided.

Pacific Ave. , Cape May Court House, NJ 08210 , applied for a Special Events Permit for the purpose of a STUDENT FUN DAY   to be held on June 6, 2014 (rain date June 9, 2014) ,  from 9:30 a.m. to 2:15 p.m., on the BEACH at RAMBLER RD. ; and

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE:

RESOLUTION NO. 116-14

WHEREAS, Borough of Wildwood Crest Resolution No. 571-93 created a “LOCAL DEFENSE COUNCIL”/LOCAL EMERGENCY PLANNING COMMITTEE, and appointments thereto, under the authority of rules and regulations established by the Governor in pursuance of the provisions of the Civil Defense and Disaster Control Act; and

 

                WHEREAS, authority for appointments to the said LOCAL DEFENSE COUNCIL/LOCAL EMERGENCY PLANNING COMMITTEE are within the jurisdiction of the office of the Mayor; and

 

                WHEREAS, Mayor Carl H. Groon is desirous of appointing a “LOCAL DEFENSE COUNCIL”/LOCAL EMERGENCY PLANNING COMMITTEE for calendar year 2014, which said “COUNCIL” shall remain operational and in full force and effect upon the date of passage of this resolution and until such time as a resolution confirming his re-appointments and/or replacements thereto has been duly adopted.

 

                NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, that the appointments as specifically set forth hereinbelow be and the same have been made by Mayor Carl H. Groon and are hereby reduced to the form of a resolution of the Board of Commissioners to confirm the appointments made and so that the same may be properly entered into the minutes of this meeting for record-keeping purposes:

Hearing no comments from the public, the Mayor opened New Business with the first topic: Cape May County MUA Electronics Recycling Program.  Mrs. Gould informed the Governing Body that the MUA will still pick it up until July 1st.  Mr. Cabrera added that he feels the Borough should follow with the recommendation of the MUA, which is to stay in the program.  It was agreed to reach out to Mr. John Baron from the MUA on how to proceed. 

 

The next topic was the Morey Organization Request.  The Mayor had written up a letter regarding support with the state in trying to protect their piers.  The Commissioners were in agreement to send a letter of support of the Morey Organization.

 

Old Business was then opened with Rambler Road bike access.  Commissioner Cabrera indicated there was a revision and it was distributed to the governing body.  Mr. Cabrera informed the Commissioners that he did meet with the CFO regarding the funding and it was already included in the previous estimate from the Engineer.  However, the electrical lighting cost has not been updated yet due to the Engineer being on vacation.  This final proposal should be forth coming soon. 

 

The floor was then opened another time and hearing no comments from the public,
