Minutes of Commissioners Meeting   -   November 6, 2013

Wildwood Crest, NJ

Prior to the opening of the meeting, Mrs. Gould led those present in the Pledge of Allegiance to the Flag.

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mrs. Gould read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader, the Herald and The Press on November 28, 2012.

 

Mrs. Gould next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1178 be placed on second reading and final passage by title only.

ORDINANCE NO. 1179

A CAPITAL ORDINANCE PROVIDING FOR THE REPLACEMENT AND WIDENING OF THE BEACHFRONT BIKE PATH AND APPROPRIATING THEREFOR THE AMOUNT OF $350,000 FROM GENERAL CAPITAL FUND BALANCE

 

Mr. Cabrera motioned, seconded by Mrs. Gould, that Ordinance No. 1179 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on Monday, November 25, 2013 at 7:00 p.m.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION 1133-13

WHEREAS, N.J.S.A. 40A:4-58 permits transfers between budget appropriations during the final two (2) months of the fiscal year;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that transfers between 2013 budget appropriations be and the same are hereby authorized as follows:

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION 1134-13

          WHEREAS, the Tax Collector of the Borough of Wildwood Crest collected from the property owner or it's designee an excess amount on 2013 property taxes and/or utility payments; and

 

               WHEREAS, an overpayment was created for the reason listed below, and

 

               WHEREAS, the Tax Collector of the Borough of Wildwood Crest has determined the said overpayment should be refunded accordingly as indicated below.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION 1135-13

 

WHEREAS, the Board of Commissioners has determined that the items listed on the attached Schedule “A” is property no longer needed for public use; and

 

WHEREAS, the State of New Jersey permits the sale of surplus property no longer needed for public use through the use of an online auction service, pursuant to the Local Unit Electronic Technology Pilot Program and Study Act, P.L. 2001, c.30; and

 

WHEREAS, the Borough of Wildwood Crest has received authorization from the State of New Jersey, Department of Community Affairs, Division of Local Government Services, to conduct an online sale of property no longer needed for public use; and

 

WHEREAS, the Borough of Wildwood Crest is in possession of the property listed in Schedule “A,” attached to this Resolution, and desires to sell this property online;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, that said items are hereby declared surplus property, to be forthwith advertised for public sale pursuant to the provisions of N.J.S.A. 40A:11-36; and

 

BE IT FURTHER RESOLVED that said materials shall be sold at a public sale to the highest bidder through a contracted government on-line auction service, GovDeals, Inc. The Borough of Wildwood Crest reserves the right to reject any and all bids; and

 

BE IT FURTHER RESOLVED that a Notice of On-Going Public Sale of Surplus Property be published one (1) time in The Herald of Cape May County edition of November 13, 2013.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION 1136-13

WHEREAS, Kevin M. Yecco, designated Public Agency Compliance Officer (P.A.C.O.) for the Borough of Wildwood Crest, retired from his position as Borough Clerk for the Borough of Wildwood Crest effective July 1, 2013; and

 

WHEREAS, the State of New Jersey, Department of the Treasury, Division of Purchase and Property, requires that each municipality designate a Public Agency Compliance Officer (PA.C.O.); and

 

WHEREAS, it is the desire of the governing body to designate a Public Agency Compliance Officer (P.A.C.O.) to replace Kevin M. Yecco;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, that Janelle M. Holzmer, Borough Clerk, be and she is hereby designated as Public Agency Compliance Officer (P.A.C.O.) for the Borough of Wildwood Crest, New Jersey.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION 1137-13

 

            WHEREAS, on November 13, 2008, the Borough of Wildwood Crest received oral bids at a public auction for the rental of Bicycle Rental Concession #3 at Heather Road and Beach Drive, a/k/a Block 21.04, Lot 8, and Lawrence Zitto was the only bidder at the public auction for the rental of said Bicycle Rental Concession; and

 

               WHEREAS, the Borough, on November 24, 2008, executed a Lease Agreement with Lawrence Zitto for a rental term of five (5) years beginning January 1, 2009 and terminating December 31, 2013; and

 

               WHEREAS, it is the desire of the Board of Commissioners to extend the term of said Lease Agreement an additional four (4) month to coincide with the rental term of other rental concessions in the Borough of Wildwood Crest;

 

      NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, as follows:

 

               1.            An extension of the lease term for a period of four (4) months (until April 30, 2014) is hereby authorized. No additional rental shall be due from Tenant for this four (4) months extension.

 

               2.            The appropriate Borough official and Borough Clerk be and are hereby authorized to execute the Addendum to Lease Agreement, a copy of which is attached hereto and incorporated herein, for the extension of the Lease Agreement.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION 1138-13

WHEREAS, the County of Cape May has obtained various emergency equipment through various grants from the Office of Homeland Security and Federal Emergency Management Agency; and

 

WHEREAS, said equipment, identified in Schedule A attached, was purchased with the intent to be shared with the various municipalities in Cape May County; and

 

WHEREAS, it is the desire and intent of the governing body of the Borough of Wildwood Crest to participate with the County of Cape May in a Shared Services Agreement for the use of said equipment identified in Schedule A; and

 

WHEREAS, N.J.S.A. 40A:65-1, et. seq., authorizes local government units, including municipalities and counties, to enter into agreements for the exchange of services pursuant to the provisions of said statute known as the “Uniform Shared Services and Consolidation Act;”

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May and State of New Jersey, that the Shared Services Agreement between the County of Cape May and the Borough of Wildwood Crest for various emergency equipment be and the same is hereby authorized and approved for participation, all of which is in accordance with and more fully set forth in the Agreement annexed hereto and made a part hereof by reference as if fully set forth.

 

BE IT FURTHER RESOLVED that the Commissioner of Revenue and Finance and the Borough Clerk be and they are hereby authorized, directed and empowered to execute said Agreement and affix the corporate seal of the Borough of Wildwood Crest thereto.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION 1139-13

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, that the Borough Clerk be and she is hereby authorized, instructed and empowered to advertise Notice to Bidders in The Herald of Cape May County issue of November 27, 2013.

 

Sealed bids will be received by the Bid Opening Committee in the Municipal Court Room, Wildwood Crest Borough Hall, on Tuesday, December 10, 2013, AT 11:00 a.m., prevailing time, for furnishing the items hereinafter set forth in accordance with the Specifications on file in the Borough Hall.  Said items are as follows:

 

BIKE PATH CONCRETE IMPROVEMENTS

BETWEEN LOTUS AND MORNING GLORY ROADS

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION 1140-13

 

WHEREAS, WILLIAM MOREY, 121 West Jefferson Avenue, Wildwood Crest, New Jersey 08260, has paid Fifty ($50.00) Dollars to the Borough of Wildwood Crest for the enrollment of his daughter, Ellasyn, in the Von Savage Memorial Pool swim lesson program; and

 

WHEREAS, due to unforeseen circumstances, Ellasyn Morey was unable to participate in the swim lesson program, requiring her withdrawal; and

 

WHEREAS, William Morey has requested a refund of the fee paid for said swim lessons on behalf of his daughter;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Chief Financial Officer be and is hereby authorized and directed to issue a refund in the amount of Fifty ($50.00) Dollars to WILLIAM MOREY, 121 West Jefferson Avenue, Wildwood Crest, New Jersey 08260 for the withdrawal of his daughter, Ellasyn, from the Von Savage Memorial Pool swim lesson program.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

There being no public comments, Mrs. Gould discussed the first item of new business: credit card policies.  Mrs. Gould asked the tax collector to explain the current policy of the Borough.  The convenience fees need to addressed and whether you pass it on to the taxpayer or the Borough bears the fee.  The Clerk added that many people request paying mercantile fees via credit card payment as well as marriage license fees.  Mr. Cabrera asked about parking meters and credit cards, and Captain Mayer suggested that it’s as easy as downloading an app, pulling up the meter and then make the payment.  The tax collector also indicated that currently North Wildwood and Wildwood do not collect property taxes with credit cards.  The clerk also suggested about looking into putting an ATM in the foyer if credit card were not feasible.  The tax collector suggested that it would be good for mercantile and fire prevention, but taxes can be up to thousands of dollars.  An option would be to pay by phone and call the company directly and reference a number and make payment.  You run the risk of collecting the wrong amounts with accounts.  The opinion of the Tax Collector would be to get a company that does all of the work behind the scenes and still gives the taxpayer the option of using a credit card.  The Tax Collector indicated it is approximately less than $400.00 per year at a cost to the Borough, which is non-negotiable.  It was determined to continue the discussion until next meeting.

 

The next topic was ALS/Paramedic Services and the Clerk indicated that Mr. Groon was working on that and due to his absence, the topic was skipped.  The next item was the Flood Map Revisions and the Solicitor indicated there may be one more change before it is adopted.  With regards to 2014 Capital Improvements, there was a sheet distributed regarding Pay as you Go and this too was determined to be finalized at the next meeting.

 

The Clerk indicated there was a request made to Commissioner Cabrera from Jessica Ridge (girl scout working on Gold Ward Project) and she would like to install greenhead boxes on the beach.  There is no cost to the Borough to build or install initially; the Borough would have to remove them at the end of the summer and reinstall at the beginning of the next season.  Both commissioners were on board with the decision. 

 

Under old business, the first topic was the Naming of Borough Parks and facilities.  There have been no changes in this regard.  The next topic was 2013 Capital Improvements and the Borough Engineer supplied a new cost estimate and it reduced approximately $40,000.00 and the number was around the projected target.  Lastly, the topic of Wildwood Crest “branding” has not changed.

 

There being no further matters for discussion and no further comments from the public, Mr. Cabrera motioned, seconded by Mrs. Gould, that the meeting be adjourned.
