Minutes of Commissioners Meeting   -   June 26, 2013

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 7:00 p.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader, the Herald and The Press on November 28, 2012.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

 Prior to the commencement of the meeting, the Cape May County Municipal Clerks’ Association presented Municipal Clerk, Kevin M. Yecco, with a certificate and a plaque honoring him for his many years of service to the residents of Wildwood Crest, Cape May County and the State of New Jersey. This meeting was Mr. Yecco’s final meeting as Municipal Clerk prior to his retirement effective July 1, 2013.

 

Mr. Cabrera motioned, seconded by Mrs. Gould, that Ordinance No. 1171 be placed on second reading and final passage by title only.

RESOLUTION NO. 1043-13

 

WHEREAS, Kevin M. Yecco, Borough Clerk/Administrator of the Borough of Wildwood Crest, has announced his retirement effective July 1, 2013; and

 

WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest has determined that it is in the best interests of the Borough to appoint Janelle M. Holzmer as Borough Clerk of the Borough of Wildwood Crest;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, as follows:

 

               1.            That the allegations of the preamble are incorporated herein as if fully set forth.

 

               2.            That Janelle M. Holzmer shall hereby be appointed Borough Clerk of the Borough of Wildwood Crest, commencing July 1, 2013, at an annual rate of pay provided for in the existing Salary Ordinance of the Borough of Wildwood Crest, and in accordance with the provisions of N.J.S.A. 40A:9-133, for a term of three (3) years, and shall include the performance of all required duties and responsibilities as Borough Clerk of the Borough of Wildwood Crest under authority of the law.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1044-13

 

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May and State of New Jersey, that JANELLE M. HOLZMER, Borough Clerk, be and she is hereby appointed REGISTRAR OF VITAL STATISTICS for the Borough of Wildwood Crest. Said appointment shall commence effective July 1, 2013 and shall run concurrent with the appointment as Municipal Clerk of the Borough of Wildwood Crest.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1045-13

 

WHEREAS, NJSA 40A:9-135 provides for the unclassified appointment of a Deputy Municipal Clerk by the governing body, as well as the compensation, term of office, and the powers, duties and functions of such office; and

 

WHEREAS, the Deputy Municipal Clerk, “during the absence or disability of the Municipal Clerk, shall have all the powers of the Municipal Clerk and shall perform the functions and duties of such office;” all as set forth in NJSA 40A:9-135; and

 

WHEREAS, the specific powers, duties, and functions to be exercised and/or performed are fully contained in the existing “job specifications” for the position of Deputy Municipal Clerk; and

 

WHEREAS, Janelle M. Holzmer, currently employed as Deputy Municipal Clerk with the Borough of Wildwood Crest, shall be promoted to the position of Municipal Clerk effective July 1, 2013; and

 

WHEREAS, the Commissioner of Revenue and Finance is prepared to offer in nomination the name of PATRICIA FEKETICS for appointment to the position of Deputy Municipal Clerk, as the most qualified applicant, based upon results of an extensive screening and interview process; and

 

WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest has determined that it is in the best interests of the Borough to confirm and ratify the appointment of PATRICIA FEKETICS;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, as follows:

 

               1.            The allegations of the preamble hereto are incorporated herein as if fully set forth.

 

               2.            That the full-time appointment of PATRICIA FEKETICS as Deputy Municipal Clerk, effective July 1, 2013, at an annual rate of pay as permitted within the parameters of the range established in the existing Salary Ordinance of the Borough of Wildwood Crest, be and the same is hereby confirmed and ratified.

 

               3.            That said unclassified appointment shall extend for a period of three (3) years commencing effective July 1, 2013, is in accordance with NJSA 40A:9-135, and all provisions pertaining thereto. Re-appointment shall be subject to satisfactory performance and attainment of the Registered Municipal Clerk certification, issued by the State of New Jersey, Department of Community Affairs.

RESOLUTION NO. 1046-13

 

WHEREAS, Kevin M. Yecco, Clerk/Administrator of the Borough of Wildwood Crest, has announced his retirement effective July 1, 2013; and

 

WHEREAS, Kevin M. Yecco is currently the Borough’s Fund Commissioner for the Atlantic County Municipal Joint Insurance Fund (ACMJIF); and

 

WHEREAS, Janelle M. Holzmer is currently the Alternate Fund Commissioners for the ACMJIF; and

 

WHEREAS, it is the desire of the Board of Commissioners to appoint Janelle M. Holzmer as the Borough’s Fund Commissioner for the ACMJIF, effective July 1, 2013; and

 

WHEREAS, it is the further the desire of the Board of Commissioners to appoint Neil Young, CFO, as Alternate Fund Commissioner;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, as follows:

 

               1.            The preamble hereto is repeated herein as if fully set forth.

 

               2.            Janelle M. Holzmer be and she is hereby appointed as the Borough’s Fund Commissioner for the ACMJIF effective July 1, 2013.

 

               3.            Neil Young be and he is hereby appointed as the Borough’s Alternate Fund Commissioner for the ACMJIF effective July 1, 2013.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1047-13

 

RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF A SETTLEMENT AGREEMENT FOR PENDING LITIGATION WITH ASKOLD S. LOZYNSKYJ, HARRY A. AND JEAN M. HUDSON, EDMUND AND ELEANOR GIGANTI, RICHARD AND KATHLEEN HUDSON AND THE BOROUGH OF WILDWOOD CREST

 

WEREAS, on or about December 16, 2011, a complaint was filed in the Superior Court of New Jersey, Chancery Division, Cape May County, Docket No. C-56-11, in which the Borough of Wildwood Crest was named as a defendant in a matter concerning a property and easement dispute and concerning issuance of fence permits, and

 

WHEREAS, this matter was defended through the insurance carrier for the Borough of Wildwood Crest and representation was by Erin Thompson, Esq., and

 

WHEREAS, Judge Raymond Batten conducted a settlement conference in this matter, which conference resulted in a settlement by all parties that would result in the conclusion of pending litigation and all anticipated future litigation, and

 

WHEREAS, the Borough of Wildwood Crest, as a named defendant, is a party to the Settlement Agreement and Mutual Release (copy of which is attached hereto and made a part hereof).

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, as follows:

 

1.      The terms and conditions of the Settlement Agreement and Mutual Release dated May 6, 2013 as annexed hereto is hereby approved, and the Mayor and Borough Clerk are authorized to execute such documents and take appropriate measures as may be necessary to conclude such settlement.

 

2.      This Settlement Agreement and Mutual Release does not require that any payment be made by the Borough of Wildwood Crest to Plaintiff concerning said settlement, and no authorization for same is provided herein.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1048-13

 

Authorizing Retention Via Professional Services Agreement

Of A Law Firm With Regard Bond Counsel

 

 

 

WHEREAS, the Borough of Wildwood Crest requires the professional services of a Law Firm to assist the municipality with the selling of bonds, or bond anticipation notes, for financing the cost of the capital improvement program and for the rendering of legal opinions related thereto; and

 

WHEREAS, it is desired to employ a professional, pursuant to law, who is duly trained, experienced and specialized in the area of municipal bonds; and

 

WHEREAS, the Local Public Contracts Law provides for the entering into of a contract for professional services pursuant to R.S.40A:11-5(1)(a), without advertising for competitive bidding; and

 

WHEREAS, the Borough has determined that the firm of Hawkins, Delafield & Wood is qualified to perform the said work and it is desired to enter a professional contract with them for said services pursuant to law, and to provide for the advertising of a notice pursuant to law; and

 

WHEREAS, Hawkins, Delafield & Wood has completed and submitted a Business Entity Disclosure Certification which certifies that Hawkins, Delafield & Wood will not make any reportable contributions pursuant to N.J.S.A. 19:44A-1 commencing June 26, 2013 to any political committee or candidate through the term of this contract;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, as follows:

 

1.                Hawkins, Delafield & Wood is hereby retained as Bond Counsel to provide specialized professional services in the field of municipal bond work. The said professional services to be received shall be “as directed” by the Borough of Wildwood Crest from time to time.

 

2.                The Mayor and Borough Clerk be and they are hereby authorized and directed to enter into a contract with Hawkins, Delafield & Wood for specialized professional services as Bond Counsel for a term of one (1) year, which contract shall provide for fees to be calculated as set forth in the letter of Hawkins, Delafield & Wood dated June 13, 2013 and attached hereto, contingent upon certification below from the Chief Financial Officer as to the availability of funds.

 

3.                This contract is awarded without competitive bidding as a professional service in accordance with the provisions of the Local Public Contracts Law aforesaid, and in accordance with the provisions of N.J.S.A. 19:44A-1, and shall be in a form approved by the Borough.

 

4.                The Business Disclosure Entity Certification and the Determination of Value shall be placed on file with this Resolution.

 

5.                This Resolution and a copy of the contract for professional services shall be maintained on file in the offices of the Borough Clerk for public inspection.

 

6.                A copy of this Resolution shall be published in the legal newspaper designated by the Borough as required by law, within ten (10) days of its passage.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1049-13

 

BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, in accordance with the provisions of P.L. 1992, Chapter 165 – Section 20, Paragraph c which specifically provides for the appointment of members of the GREATER WILDWOOD TOURISM IMPROVEMENT DEVELOPMENT AUTHORITY, that ROBERT PATTERSON, 8405 Seaview Avenue, Wildwood Crest, New Jersey, be and he is hereby appointed as the Borough’s “resident” member of the GREATER WILDWOOD TOURISM IMPROVEMENT DEVELOPMENT AUTHORITY for a term of four (4) years; said term commencing effective immediately and expiring July 1, 2017.

 

BE IT FURTHER RESOLVED that the foregoing appointment constitutes one of the three appointments the Borough of Wildwood Crest is entitled to make to the aforesaid Authority, based upon the provisions of the above referenced public law, otherwise known as the “Tourism Improvement and Development District Act.”

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1050-13

 

WHEREAS, CHRISTINE MCWILLIAMS, 213 W. Magnolia Avenue, Wildwood, NJ 08260

submitted application and subsequently paid for a memorial bench dedication in the amount of

$500.00 on May 6, 2013; and

WHEREAS, CHRISTINE MCWILLIAMS subsequently has requested to cancel the memorial

bench dedication; and

WHEREAS, the Borough of Wildwood Crest has incurred no expense to date in relation to the

memorial bench dedication;

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of

Wildwood Crest, County of Cape May, New Jersey that the Chief Financial Officer be and is

hereby authorized and directed to issue a refund of $500.00 to CHRISTINE MCWILLIAMS, 213

W. Magnolia Avenue, Wildwood, NJ 08260 to cancel the memorial bench dedication.

WHEREAS, on June 18, 2013, the VIETNAM VETS CHAPTER #955, 4200 Atlantic Ave.,

Wildwood Crest, NJ 08260, applied for a Special Events Permit for the purpose of a 5K RUN to

be held on July 4, 2013, from 9:00 a.m. to 11:00 a.m., on the BEACH from Cresse Ave. to

Primrose Rd.; and

WHEREAS, the VIETNAM VETS CHAPTER #955, 4200 Atlantic Ave., Wildwood Crest, NJ

08260 has supplied all documentation required under Ordinance No. 936, including the requisite

Certificate of Insurance, and has further pledged to comply with all applicable rules and

regulations pertaining to the conduct of said Special Event; and

WHEREAS, the application has been reviewed by the Board of Commissioners, upon

verification by appropriate members of staff as to completeness of the application, scheduling

compatibility, etc.;

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of

Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and he is hereby

authorized and directed to issue a Special Events Permit to the VIETNAM VETS CHAPTER

#955, 4200 Atlantic Ave., Wildwood Crest, NJ 08260 for the purpose of a 5K RUN to be held on

July 4, 2013, from 9:00 a.m. to 11:00 a.m., on the BEACH from Cresse Ave. to Primrose Rd.

 

 

RESOLUTION NO.1052-13

 

WHEREAS, on May 28, 2013, TOM & ROSEMARY (COOKIE) DELANEY, 8906 New Jersey

Ave., Wildwood Crest, NJ 08260, applied for a Special Events Permit for the purpose of a

CHRISTMAS IN JULY BLOCK PARTY to be held on July 27, 2013, from 5:00 p.m. to 8:00

p.m., on the 100 W. block of Charleston Ave.; and

WHEREAS, TOM & ROSEMARY (COOKIE) DELANEY, 8906 New Jersey Ave., Wildwood

Crest, NJ 08260 have supplied all documentation required under Ordinance No. 936, including

the requisite Certificate of Insurance, and have further pledged to comply with all applicable

rules and regulations pertaining to the conduct of said Special Event; and

WHEREAS, the application has been reviewed by the Board of Commissioners, upon

verification by appropriate members of staff as to completeness of the application, scheduling

compatibility, etc.;

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of

Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and he is hereby

DELANEY, 8906 New Jersey Ave., Wildwood Crest, NJ 08260 for the purpose of a

RESOLUTION NO. 1053-13

 

WHEREAS, on June 11, 2013, MARIBEL GONZALEZ, 3700 New Jersey Ave., Wildwood, NJ

08260, applied for a Special Events Permit for the purpose of a WEDDING to be held on August

5, 2013, from 12:30 p.m. to 2:30 p.m., with a rain date of August 6, 2013, at Centennial Park;

and

WHEREAS, MARIBEL GONZALEZ, 3700 New Jersey Ave., Wildwood, NJ 08260 has

supplied all documentation required under Ordinance No. 936, including the requisite Certificate

of Insurance, and has further pledged to comply with all applicable rules and regulations

pertaining to the conduct of said Special Event; and

WHEREAS, the application has been reviewed by the Board of Commissioners, upon

verification by appropriate members of staff as to completeness of the application, scheduling

compatibility, etc.;

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of

Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and he is hereby

authorized and directed to issue a Special Events Permit to MARIBEL GONZALEZ, 3700 New

Jersey Ave., Wildwood, NJ 08260 for the purpose of a WEDDING to be held on August 5, 2013,

from 12:30 p.m. to 2:30 p.m., with a rain date of August 6, 2013, at Centennial Park.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1054-13

 

WHEREAS, N.J.S.A. 40A:11-36 pertains to the sale or other disposition of personal property by municipalities; and

 

WHEREAS, Section (2) of the aforesaid statute provides that “the contracting unit need not advertise for bids when it makes any such sale to the United States, the State of New Jersey, another contracting unit or to any body politic to which it contributes tax raised funds;” and

 

WHEREAS, the Borough of Wildwood Crest has determined that seven hundred (700) 4’ x 6’ existing, damaged wooden walkways are no longer needed for borough use as replacement FEMA funding has been provided to otherwise enable the total replacement of same.  Accordingly, the Borough desires to transfer ownership of the seven hundred (700) 4’ x 6’ wooden walkways to the City of Wildwood for the total sum of $1.00; and

 

WHEREAS, the Borough of Wildwood Crest has satisfactorily met the conditions prescribed and required by the aforementioned Section (2) of N.J.S.A. 40A:11-36, thus enabling a direct sale for the sum total of One ($1.00) Dollar to be authorized with the City of Wildwood for the items described herein above.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, as follows:

 

1.                The allegations of the preamble hereto are incorporated herein as if fully set forth.

 

2.                That in accordance with the provisions of N.J.S.A. 40A:11-36, ownership of seven hundred (700) 4’ x 6’ existing, damaged wooden walkways, presently in the possession of the Borough of Wildwood Crest Department of Public Works, be and the same is hereby authorized to be sold to the City of Wildwood for the total sum of One ($1.00) Dollar.

 

3.                That the appropriate officials of the Borough of Wildwood Crest be and they are hereby authorized, empowered, and directed to execute any and all required documents necessary to conclude the sale of the aforesaid wooden walkways as expeditiously as possible.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

Mrs. Gould motioned, seconded by Mr. Cabrera, that all reports received, from the Court Administrator, CFO, Tax Collector, Chief of Police and Recreation Supervisor for the month ending May 31, 2013 be accepted as presented and filed.

There was discussion regarding the Electric Energy Aggregation program. Mr. Groon reported that he would be attending a Conference of Mayors meeting on Friday, June 28, 2013, where CUC would be making a presentation. He indicated that he would report back to the governing body on the matter after that time.

 

With regard to the Ocean Front Management Plan, the Clerk reported that an ordinance would be required to be adopted in order to codify the Plan. It was anticipated that introduction of the ordinance would be on the July 10, 2013 agenda.

 

Mrs. Gould presented a Borough logo design for review by the Board of Commissioners. She indicated that T-shirts with the logo would be offered for sale at the Centennial Park concerts.

 

Barbara Bixler of 120 West Sweetbriar Road reported that the Wildwood Crest Beautification Committee was now defunct. She indicated the there were funds remaining in the Beautification Committee’s bank account, and that the Committee wished to donate those funds to the Borough to be used for lighting in the business district of New Jersey Avenue. She was advised to speak to the Deputy Municipal Clerk the following day regarding the procedure for that.

 

There being no further public comments, and no further matters for discussion, Mrs. Gould motioned, seconded by Mr. Cabrera, that the meeting be adjourned.
