Minutes of Commissioners Meeting   -   April 24, 2013

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 7:00 p.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader, the Herald and The Press on November 28, 2012.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1003-13

 

WHEREAS, the Commissioner of Public Safety desires to appoint nine (9) additional Class II Police Officers for the Borough of Wildwood Crest as a supplement to the officers previously hired; and

 

WHEREAS, it is the desire of the Commissioner of Public Safety to appoint Anthony Casario, Haley Filer, Andre Ouellette, Vincent Sampoli, Ronald Sutton, Richard Thomas, Megan Tole, Dylan Young, and Robert Ainslie as Class II Police Officers for the Borough of Wildwood Crest, to serve in an “at-will” capacity at the pleasure of the Commissioner of Public Safety at an annual salary as contained in the current year salary ordinance of the Borough of Wildwood Crest; and

 

WHEREAS, the Board of Commissioners of the Borough of Wildwood Crest has determined that it is in the best interests of the Borough of Wildwood Crest to confirm and ratify the appointment of Anthony Casario, Haley Filer, Andre Ouellette, Vincent Sampoli, Ronald Sutton, Richard Thomas, Megan Tole, Dylan Young, and Robert Ainslie as Class II Police Officers.

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, as follows:

 

1.      The allegations of the preamble hereto are incorporated herein as if fully set forth.

2.      The appointment of Anthony Casario, Haley Filer, Andre Ouellette, Vincent Sampoli, Ronald Sutton, Richard Thomas, Megan Tole, Dylan Young, and Robert Ainslie as Class II Police Officers effective the date of passage of this resolution, at an annual salary as permitted within the parameters of the range established in the current year “Salary Ordinance” of the Borough of Wildwood Crest, be and the same is hereby confirmed and ratified.

3.      That said unclassified appointment shall be “at-will,” at the pleasure of the Commissioner of Public Safety, and shall remain in full force and effect until further notice.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1004-13

 

Resolution Authorizing Support of Application to the United States Coast Guard for Official Designation of Wildwood Crest as “A Coast Guard Community”

 

 

WHEREAS, the United States Congress, through federal legislation, has enabled the United States Coast Guard to designate a community having a special relationship with the Coast Guard as a “Coast Guard Community;” and

 

WHEREAS, local Coast Guard command is empowered to recommend that the “Coast Guard Community” designation be awarded to a surrounding city, county or other jurisdictional entity that meets rigorous application standards, with only 14 communities across the nation having received such designation; and

 

WHEREAS, the residents of Cape May County and the Borough of Wildwood Crest have enjoyed a unique relationship with Coast Guard personnel and their families for nearly a century, by virtue of, among other things, the Coast Guard’s ownership and maintenance of properties in municipalities throughout the County; and

 

WHEREAS, most notably, since as early as 1917 the Coast Guard has had a presence at what has grown into the 352-acre site in Cape May City, County of Cape May, now known as Training Center Cape May, or “TRACEN;” and

 

WHEREAS, Coast Guard personnel and their families reside both in on-base housing in Cape May City and in private housing located in municipalities throughout the County, including the Borough of Wildwood Crest, which, by virtue of its unique geographic configuration as a peninsula surrounded by water, is comprised of 16 contiguous municipalities whose economic, social and civic structures are closely interdependent; and

 

WHEREAS, Coast Guard families and non-Coast Guard families interact with and support one another on a daily basis in all aspects of community living; and

 

WHEREAS, the Coast Guard presence at TRACEN today includes over 1,160 total military and civilian personnel working at the base, providing recruit training for all entry-level recruits entering the Coast Guard service and graduating an average of more than 2,300 recruits yearly, in addition to providing officer training and education, vessel support, air/sea rescue, investigative services, communication facilities, and homeland security services, all in furtherance of the continuous coastal patrol and defense of our nation; and

 

WHEREAS, Coast Guard personnel and their families also welcome over 41,000 additional guests and visitors annually into Cape May County; and

 

WHEREAS, Wildwood Crest residents and businesses have a longstanding history of recognizing and supporting their Coast Guard neighbors, and wish to formalize their continuing commitment to these men, women and children and make known to the public their commitment by attaining the designation of “Coast Guard Community;” and

 

WHEREAS, the Borough of Wildwood Crest joins with the County of Cape May and the City of Cape May in this collaborative initiative;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, that;

 

1.      The above recitals are incorporated herein by reference;

 

2.      Upon adoption of this Resolution, the Mayor and Borough Clerk are hereby authorized and directed to execute any and all documents necessary and appropriate to join efforts with the County of Cape May and the City of Cape May to complete an application for regional designation by the United States Coast Guard as an official “Coast Guard Community;” and

 

3.      The Borough of Wildwood Crest affirms its lengthy and honored relationship with the United States Coast Guard, and pledges to continue its long history of full and unwavering support for Coast Guard personnel and their families.

WHEREAS, on April 12, 2013 , the NORTH AMERICAN BLOKART SAILING ASSOCIATION (NABSA) , 20 Bear St. , Washoe Valley, NV 89704 , applied for a Special Events Permit for the purpose of a BEACH LAND SAILING EVENT   to be held on from April 25, 2013 thru April 28, 2013 ,  on the WILDWOOD CREST BEACH, between high and low tide line; and

                                                                                                                                               

WHEREAS,  the NORTH AMERICAN BLOKART SAILING ASSOCIATION (NABSA), 20 Bear St., Washoe Valley, NV 89704 has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

WHEREAS, on April 15, 2013 , NAPKA (NORTH AMERICAN POWER KITE ASSOCIATION) , P.O. Box 1358 , Westport, WA 98595 , applied for a Special Events Permit for the purpose of a KITE BUGGY EVENT   to be held             from April 25, 2013 thru April 28, 2013 ,  on the Beach at Rosemary Rd. and the Hard Sand Beach Area from Cresse Ave. to Jefferson Rd. ; and

                                                                                                                                               

WHEREAS,  the NORTH AMERICAN BLOKART SAILING ASSOCIATION (NABSA), 20 Bear St., Washoe Valley, NV 89704 has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

WHEREAS, on April 16, 2013 , JESSICA BELLERBY , 2156 Pennsylvania Ave. , Bensalem, PA 19020 , applied for a Special Events Permit for the purpose of a WEDDING   to be held on August 4, 2013 ,  from 4:00 p.m. to 6:00 p.m., on the PRIMROSE RD. BEACH ; and

                                                                                                                                               

WHEREAS,  the NORTH AMERICAN BLOKART SAILING ASSOCIATION (NABSA), 20 Bear St., Washoe Valley, NV 89704 has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and he is hereby authorized and directed to issue a Special Events Permit to  the NORTH AMERICAN BLOKART SAILING ASSOCIATION (NABSA) , 20 Bear St., Washoe Valley, NV 89704 for the purpose of a BEACH LAND SAILING EVENT to be held on from April 25, 2013 thru April 28, 2013, on the WILDWOOD CREST BEACH, between high and low tide.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1009-13

 

Authorizing Change in Scope for Grant Agreement with USDA Authorized on June 23, 2010 by Resolution No. 298-10

 

 

WHEREAS, on June 23, 2010, by Resolution No. 298-10, the Borough of Wildwood Crest authorized application to the U.S. Department of Agriculture Rural Development for a Traffic Signalization Repair/Replacement Grant; and

 

WHEREAS, it is the desire of the Board of Commissioners to change the scope of the Grant Agreement to now provide for application of $61,000 of the grant funding toward the purchase of a sewer cleaner/Vac-All Truck;

 

NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, does hereby authorize4 amendment of the Grant Agreement to change the scope of said agreement to provide for application of $61,000 of the grant funding toward the purchase of a sewer cleaner/Vac-All Truck;

 

BE IT FURTHER RESOLVED that the Mayor and Borough Clerk be and they are hereby authorized, instructed, and empowered to execute and attest any and all documents pertaining to the change in scope of the agreement with the USDA Rural Development.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 1010-13

 

WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by any public or private funding source and the amount thereof shall not have been determined at the time of the adoption of the budget; and

 

WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; and

 

WHEREAS, the Borough of Wildwood Crest will receive $26,000.00 from the Greater Wildwood Tourism Improvement and Development Authority, and wishes to amend its 2013 Municipal Budget to include this amount of revenue.

 

NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, does hereby request the Director of the Division of Local Government services to approve the insertion of an item of revenue in the municipal budget of the Borough of Wildwood Crest for the year 2013 in the sum of                                                                        $         26,000.00

which is now available as a revenue from:

Miscellaneous Revenues

Special Items of General Revenue Anticipated with

Prior Written Consent of the Director of the Division

of Local Government Services - Public and Private

Revenues Offset with Appropriations:

Mrs. Gould motioned, seconded by Mr. Cabrera, that the minutes of Commission meetings held March 27, 2013 and April 10, 2013, as well as the closed session of March 27, 2013 be approved as presented.

Mrs. Gould motioned, seconded by Mr. Cabrera, that the calendar year 2013 Tax Cab Licenses, in accordance with the provisions of Chapter 73 of the Code of the Borough and based upon the complete packages as submitted by the Mercantile Licensing Clerk, be approved.

With regard to the proposal for a coastal engineer, the Clerk reported that the Borough had made additional contact with Hatch-McDonald Engineers who will be meeting with Borough representatives on March 25, 2013 to discuss issues related to the Borough in terms of coastal engineering, as well as FEMA matters. He indicated that a further report would be provided after that meeting. The Clerk added that it was his understanding that funds were available from two different sources in the amount of $25,000 as a maximum with respect to any such contract.

 

Concerning the proposed Shared Services Committee, the Clerk reported that it had been offered that Commissioner Cabrera would continue as the Borough’s representative during initial discussion stages. If in the future additional representation from the Borough should be needed, whereby the governing body is on-board with a potential consider shared service, the Clerk/Administrator and CFO would join the committee.

 

The Clerk provided a copy of a plan from the Engineer with regard to the Sunrise Park turnaround, driveway and playground equipment. Mr. Cabrera explained that the proposal was a concept plan to “clean up” traffic as it comes on and off Rambler Road from the bicycle path. The Engineer reviewed the plans with the governing body and the Chief of Police with an eye toward public safety. The Clerk raised the issue of funding sources. It was determined that a final plan would be agreed upon and then a discussion would be had with the CFO regarding available funding sources.

 

Mr. Groon submitted a copy of a grant list for the review of the governing body. Mr. Groon indicated that it was a working document for future grant applications. He asked that the governing body review the list and then a plan of action would be formulated at a later time as to which grants would be pursued.

 

With regard to the New Jersey Avenue street reconstruction project, the Engineer submitted a plan for review by the governing body. After further discussion with the Engineer and the Chief of Police, some changes were suggested and the Engineer was instructed to revise the plans.

 

There being no public comments, Mrs. Gould motioned, seconded by Mr. Cabrera, that the meeting be adjourned.
