Minutes of Commissioners Meeting   -   February 27, 2013

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 7:00 p.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader, the Herald and The Press on November 28, 2012.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

RESOLUTION NO. 958-13

 

RESOLUTION TO USE ALTERNATE TAX COLLECTION RATE

 

 PURSUANT TO N.J.S.A. 40A:4-41

 

FOR USE IN THE 2013 MUNICIPAL BUDGET

 

WHEREAS, the Borough of Wildwood Crest experienced substantial cancellations of 2012 property taxes due to tax appeal judgments of the County Tax Board pursuant to R.S.54:3-21 et seq., or the State Tax Court pursuant to R.S.54:48-1 et seq., resulting in a decline of the tax collection rate for the year 2012; and

 

WHEREAS, the use of the lower collection rate in arriving at the budget appropriation  Reserve for Uncollected Taxes in the 2013 Municipal Budget may result in an unfair tax burden to the taxpayers of the Borough of Wildwood Crest; and

 

WHEREAS, if tax appeal judgments of the County Tax Board or the State Tax Court result in tax reductions for the previous fiscal year, the governing body of the municipality may elect to calculate the current year reserve for uncollected taxes by reducing the certified tax levy of the prior year by the amount of the adjustments resulting from those judgments; and

 

WHEREAS, the Division of Local Government Services, Department of Community Affairs will allow the Borough of Wildwood Crest to use the alternate collection rate for the year 2012 in calculating the budget appropriation Reserve for Uncollected Taxes in the 2013 Municipal Budget; and

 

WHEREAS, the 2012 collection rate without reducing the certified tax for County Tax Board or State Tax Court appeals is 97.52%; and

 

WHEREAS, the 2012 collection rate with reducing the certified tax for County Tax Board or State Tax Court appeals in the amount of $164,712.38 is 98.16%;

 

NOW, THEREFORE, BE IT RESOLVED that the Borough of Wildwood Crest elects to reduce the certified tax levy of the prior year by the amount of tax levy adjustments of the County Tax Board pursuant to R.S. 54:3-21 et seq., and State Tax Court pursuant to R.S.54:48-1 et seq., in order to calculate the prior year tax collection rate and give the Borough of Wildwood Crest the ability to use that rate as the maximum percentage to be used in the calculation for the Reserve for Uncollected Taxes.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 959-13

 

WHEREAS, by statute, when a municipality raises school taxes on a school year basis, an amount of not more than 50% of the levy may be deferred to the following year; and

 

WHEREAS, 50% of the school tax levy of the Borough of Wildwood Crest school district is $3,146,447.

 

NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May, New Jersey, desires to defer school taxes to the year 2013 in the amount of $1,250,000.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 960-13

 

WHEREAS, Borough of Wildwood Crest Ordinance No. 947, as amended by Ordinance No. 1065, contains a formula for the calculation and establishment of annual sewerage rates, including the annual Variable Rate Fee; and

 

WHEREAS, the said calculations have been prepared and reviewed in accordance with the aforementioned Ordinance No. 947, as amended by Ordinance No. 1065; and

 

WHEREAS, it is promulgated in Ordinance No. 947, as amended by Ordinance No. 1065, that the Commissioner of Revenue and Finance shall submit the proposed sewerage rates and minimum charges to the Board of Commissioners for confirmation by resolution; and

 

WHEREAS, the rates as calculated, reviewed and submitted are as follows:

 

               Fixed Rate Charge:           $3.00 per 1000 gallons of metered water consumption

               Variable Rate Charge:      $20.86 per 1000 gallons of metered water consumption

               Minimum Annual Charge:                             $124.00

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, in the County of Cape May and State of New Jersey, that the sewerage rates and minimum charges as presented by the Commissioner of Revenue and Finance be confirmed for calendar year 2013.

SUBJECT:  LOCAL BUDGET OF THE BOROUGH OF WILDWOOD CREST, COUNTY OF CAPE MAY, NEW JERSEY, FOR THE FISCAL YEAR 2013

 

BE IT RESOLVED that the following statements of revenue and appropriations shall constitute the local budget for the year 2013.

 

BE IT FURTHER RESOLVED that said budget be published in The Cape May County Herald issue of March 6, 2013.

 

NOTICE is hereby given that the budget and tax resolution were approved by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey on February 27, 2013.

 

A hearing on the budget and tax resolution will be held in the Municipal Court Room in Borough Hall on Wednesday, MARCH 27, 2013 AT 7:00 P.M., Municipal Court Room, Borough Hall, 6101 Pacific Avenue, Wildwood Crest, New Jersey, at which time and place objections to said budget and tax resolution for the year 2013 may be presented by taxpayers and other interested persons.

Authorizing Sale of Surplus Property No Longer Needed

For Public Use on an Online Auction Website

 

 

WHEREAS, the Board of Commissioners has determined that the items listed on the attached Schedule “A” is property no longer needed for public use; and

 

WHEREAS, the State of New Jersey permits the sale of surplus property no longer needed for public use through the use of an online auction service, pursuant to the Local Unit Electronic Technology Pilot Program and Study Act, P.L. 2001, c.30; and

 

WHEREAS, the Borough of Wildwood Crest has received authorization from the State of New Jersey, Department of Community Affairs, Division of Local Government Services, to conduct an online sale of property no longer needed for public use; and

 

WHEREAS, the Borough of Wildwood Crest is in possession of the property listed in Schedule “A,” attached to this Resolution, and desires to sell this property online;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, that said items are hereby declared surplus property, to be forthwith advertised for public sale pursuant to the provisions of N.J.S.A. 40A:11-36; and

 

BE IT FURTHER RESOLVED that said materials shall be sold at a public sale to the highest bidder through a contracted government on-line auction service, GovDeals, Inc. The Borough of Wildwood Crest reserves the right to reject any and all bids; and

 

BE IT FURTHER RESOLVED that a Notice of On-Going Public Sale of Surplus Property be published one (1) time in The Herald of Cape May County edition of March 6, 2013.

WHEREAS, Section 40-16, et. seq., of the Code of the Borough of Wildwood Crest, County of Cape May, State of New Jersey, sets forth the pertinent law regarding the issuance of licenses to persons, firms or corporations desiring to engage in the peddling and soliciting of ice cream products within the Borough of Wildwood Crest; and

WHEREAS, on February 19, 2013 , WCHS/ALAMENO SCHOLARSHIP FUND , 1500 Central Ave , N. Wildwood, NJ 08260 , applied for a Special Events Permit for the purpose of a PROCESSION and PLUNGE EVENT   to be held on March 2, 2013 ,  from 12:00 p.m to 2:00 p.m., on Monterey Ave., from Bayview Drive to the beach ; and

                                                                                                                                               

WHEREAS,  WCHS/ALAMENO SCHOLARSHIP FUND, 1500 Central Ave, N. Wildwood, NJ 08260 has supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and has further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

RESOLUTION NO. 967-13

 

BE IT RESOLVED, by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that application to the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust for the replacement and improvement of sanitary and storm sewer infrastructure, including but not limited to full reconstruction of the streets at the following locations is hereby authorized.

 

Sanitary Sewer Improvements:

1.      New Jersey Avenue between Primrose Road and the southern Borough limit (south of Jefferson Avenue);

2.      Washington Avenue between Seaview Avenue and New Jersey Avenue;

3.      Hollywood Avenue between Bayview Drive and New Jersey Avenue;

5.      Monterey Avenue between Bayview Drive and New Jersey Avenue

BE IT FURTHER RESOLVED, that Neil Young, Chief Financial Officer, be and is hereby authorized to act as the Authorized Representative for the Borough of Wildwood Crest in all matters relating to the project undertaken pursuant to the above referenced New Jersey Environmental Infrastructure Loan to be executed with the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust.  The Authorized Representative may be contacted at Borough Hall, 6101 Pacific Avenue, Wildwood Crest, NJ  08260.

BE IT RESOLVED, by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that Ralph Petrella Jr., Professional Engineer and Principal of Van Note – Harvey Associates, PC (VNHA) is designated as the Professional Engineer for all matters, including but not limited to surveying, design, engineering, professional and technical reports, permitting, environmental work, administration, resident engineering and inspection services relative to the application to the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust and all work pertaining thereto for the replacement and improvement of sanitary and storm sewer infrastructure, including but not limited to full reconstruction of the streets at the following locations.

  1. Planning Document, environmental report, surveying, design, preparation of plans and specifications, environmental permitting services, technical reports; not to exceed $600,000.00
  2. Resident engineering, inspection and construction observation services; not to exceed $1,000,000.00.
  3. Construction Stakeout services; not to exceed $75,000.00.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 969-13

 

                        WHEREAS, bids have been received in response to advertisement of Notice to Bidders

                        published in The Herald issue of January 30, 2013, for the following item:

 

Sand Harvesting, Redistribution, Transfer of Sand and Grading of the Beach, Borough of Wildwood Crest; and

 

WHEREAS, Don Rogers, Inc., P.O. Box 338, Bridgeton, NJ 08302, submitted the low bid in the amount of One Hundred Ninety One Thousand Five Hundred ($191,500.00) Dollars; and

 

WHEREAS, the Solicitor has reviewed the bids submitted and thereby provided a legal opinion recommending that the contract be awarded to the “lowest responsible bidder,” Don Rogers, Inc., P.O. Box 338, Bridgeton, NJ 08302, for the bid amount of One Hundred Ninety One Thousand Five Hundred ($191,500.00) Dollars, to perform all required work in connection with the project described above; that said award is further conditioned upon technical review by Ralph Petrella, Jr., Borough Engineer, as to compliance with the bid specifications, and upon receipt of certification of available funds by the Chief Financial Officer of the Borough of Wildwood Crest; and

 

WHEREAS, the legal opinion provided does specifically recommend that the contract be awarded to the above “lowest responsible bidder,’ and is finally conditioned upon compliance with the Notice to Bidders, Specifications, Bid Proposal Form and all other related bid/contract documents appertaining to this award which are made a part hereof by reference as if fully set forth; and

 

WHEREAS, Ralph Petrella, Jr., Borough Engineer, has reviewed the total and complete bids submitted in conjunction with the specifications and all other requirements appertaining thereto and has certified that the compliance has been met and that a contract be awarded to Don Rogers, Inc., P.O. Box 338, Bridgeton, NJ 08302, for the total bid amount of One Hundred Ninety One Thousand Five Hundred ($191,500.00) Dollars.

 

NOW THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May and State of New Jersey, as follows:

 

  1. That the allegations of the preamble hereto are incorporated hereby in reference as if fully set forth.
  2. That a contract be awarded to the successful bidder, Don Rogers, Inc., P.O. Box 338, Bridgeton, NJ 08302, for the total and complete project bid of One Hundred Ninety One Thousand Five Hundred ($191,500.00) Dollars, and is subject to certification below as to the availability of funds by the Chief Financial Officer.

 

  1. That the Mayor and Borough Clerk of the Borough of Wildwood Crest be and they are hereby authorized and directed to execute and attest said contract on behalf of the Borough of Wildwood Crest.

Concerning the issue of UEZ participation for 2013, the Clerk reported that the Solicitor had worked on several issues to resolve some outstanding exchange of financial obligations with the City of Wildwood. He added that a resolution had not been received from the City of Wildwood, although a letter had been received. The Solicitor indicated that the City of Wildwood had adopted a resolution, but that she had not received a copy.

 

The Clerk reported that the County library renovations project was progressing.  Some additional avenues were being pursued regarding potential parking, as well as any land use obligations for the proposed project.

 

With regard to FEMA matters, Mr. Groon reported that he had met with the Construction Official and a letter would be drafted by the Construction Official as to how questions from the public are to be handled. He added that it appeared that FEMA would be introducing their new “penalty” costs for those properties that do not comply with new construction or if they were substantially damaged; Preliminary maps would be forthcoming sometime late summer 2013.

 

The Clerk reported that a request had been received from the City of Wildwood for a Shared Services Committee, sponsored by GWTIDA. He added that the request was for each of the municipalities to assign members to the Committee for discussion of consideration of possible island-wide shared services.

 

As to parking for the new library, the Clerk reported that options were being explored by the County for potential vacant ground northerly of the library.

 

Mrs. Gould reported that she was waiting for the latest draft of the Borough logo, and she anticipated that she would receive some renderings in March, which will be shared with the governing body.

 

Bill Szlachta, 113 East Preston, commented on the proposed Shared Services Committee, and inquired as to which services were being considered to be shared. Mr. Groon responded that there were two services discussed, beach patrol and beach cleaning services. He indicated that at this point, there was no movement on either issue for 2013. He added that it was his understanding that the Committee would meet to discuss other ways to share services. The Clerk interjected that timing was a central issue, stating that budget considerations were essential to any decisions and the beginning of a new fiscal year is not the time to consider same for that same year; that a great deal of planning will have to go into a project of this magnitude. Mr. Groon added that there are many issues to be discussed and the Borough wants to act prudently to protect the community.

 

Mr. Szlachta then inquired, with regard to the County library, if the timeframe was for the completion of the renovations and the move to the new location. He also inquired as to plans for the existing library property. Mr. Groon responded that the timeframe, generally, has been discussed as being eighteen months for completion of construction. He stressed that they were not ready for construction, and it was his opinion that it would be more in the vicinity of two years. With regard to plans for the existing library, Mr. Groon indicated that the Commissioners had discussed several options, but there was no final plan currently. He stressed that currently there were no plans to sell the property or demolish the structure.

 

There being no further public comments, Mrs. Gould motioned, seconded by Mr. Groon, that the meeting be adjourned.
