Minutes of Commissioners Meeting   -   July 7, 2010

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 9:30 a.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader, the Herald and The Press on October 23, 2009.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1102 be placed on second reading and final passage by title only.

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1102

AN ORDINANCE AMENDING SECTION 2. OF ORDINANCE NO. 1095 OF THE BOROUGH OF WILDWOOD CREST, COUNTY OF CAPE MAY, NEW JERSEY, ADOPTED MARCH 24, 2010, RE-APPROPRIATING THE SUM OF TWO HUNDRED THOUSAND ($200,000.00) DOLLARS FROM CAPITAL IMPROVEMENT FUND FOR THE PURPOSE OF FUNDING VARIOUS MUNICIPAL PROJECTS AND PURCHASES

Mrs. Gould motioned, seconded by Mr. Cabrera, that a public hearing be held on Ordinance No. 1102.

There being no public comments, Mrs. Gould motioned, seconded by Mr. Cabrera, that the public hearing on Ordinance No. 1102 be closed.

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1103

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 32A, FEES, SECTION 32A-1, FEES, GENERAL, OF THE CODE OF THE BOROUGH OF WILDWOOD CREST, AMENDING ORDINANCE NO. 1048 ADOPTED NOVEMBER 26, 2007 AND ORDINANCE NO. 1090 ADOPTED JANUARY 27, 2010; AMENDING AND SUPPLEMENTING CHAPTER 56, RECREATION COMMISSION, SECTION 56-3, POWERS AND DUTIES, RATES AND FEES SCHEDULE, OF THE CODE OF THE BOROUGH OF WILDWOOD CREST, AMENDING ORDINANCE NO. 1069 ADOPTED FEBRUARY 25, 2009 AND ORDINANCE NO. 1090, ADOPTED JANUARY 27, 2010

Mrs. Gould motioned, seconded by Mr. Cabrera, to place Ordinance No. 1103, as amended, on first reading by title only with second reading, public hearing and final passage of the aforesaid amended version of this ordinance to be held on Wednesday, July 21, 2010 at 7:00 p.m.

The Clerk announced for those present that the purpose of the amendment to Ordinance No. 1103 was to bring the Borough’s fees for photocopy charges in line with the recently enacted State requirements of five cents per page for letter size and seven cents per page for legal size copies and that, until very recently with this legislation having been passed, we included guidance from  the Government Records Council in the initial introduced version of the ordinance that only “actual costs” of paper and toner be charged.

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1104 be placed on second reading and final passage by title only.

AN ORDINANCE AUGMENTING AND AMENDING THE LAND USE DEVELOPMENT ORDINANCE OF THE BOROUGH OF WILDWOOD CREST – CHAPTER 85 – ARTICLE IV – R-1 LOW DENSITY RESIDENTIAL ZONE, SECTION 28E – MINIMUM LOT YARDS FOR PRINCIPAL BUILDINGS, ARTICLE V- R-1A – SEMI-LOW DENSITY RESIDENTIAL ZONE – SECTION 85-32E – MINIMUM LOT YARDS FOR PRINCIPAL BUILDINGS, ARTICLE VII – R-2 – TWO FAMILY RESIDENTIAL ZONE – SECTION 85-40C – PRINCIPAL BUILDING MINIMUM

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1105 be passed on first reading, advertised according to law, be brought up for second and final reading and public hearing on Wednesday, July 21, 2010 at 7:00 p.m.

The first matter for discussion was the Rambler Road Park Project. The Clerk stressed that there are considerable time constraints on this project, stating that the Borough must be under contract by September 1, 2010 in order to avoid losing the grant funds. Mr. Cabrera stated that it was his opinion that he, the Borough Engineer and the architect meet to further discuss the plan, and he suggested that a special meeting be scheduled later for a final discussion. It was decided that the special meeting would be scheduled for Thursday, July 15, 2010 at 9:30 a.m.

 

Mr. Groon reported that the proposed amendments to the awnings provision of the Land Use Ordinance were in the process of being reviewed.

The Clerk reported that he had provided each of the Commissioners with information regarding Park and Pay by Phone. He indicated that the City of Wildwood currently utilizes the system. He added that the City of North Wildwood had reported to him that the company would be willing to forego the administrative fees if all three island municipalities were to become part of the system.

He requested the governing body go on-line to the “icontrolmobile” website to gather further information on the system and to indicate whether they have interest in pursuing same.

 

John Thorpe, 9105 Pacific Avenue, commented on the new bulkhead at Rosemary Road and the bay. He questioned the need for the fixed pier and the floating dock at that location. Mr. Groon responded that there were pilings at the location from an old pier, and the purpose was to provide another kayak launch area as well as a walk-out area for the public.

 

Dean Lyons, 109 Aster Road, inquired as to the status of the three traffic lights on New Jersey Avenue at Sweetbriar, Cardinal and Aster Roads. Mr. Groon responded that the Borough had signed an agreement with the County of Cape May that authorized them to pursue a grant to replace all three lights. He indicated that he did not have a timeline for the work, but that the County had indicated it would be done as soon as possible.

 

There being no further public comments, Mrs. Gould motioned, seconded by Mr. Cabrera, that the meeting be adjourned.
