Minutes of Commissioners Meeting   -   June 10, 2009

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County , New Jersey , was held in the Commissioners’ Meeting Room at 9:30 a.m.  On roll call the following answered to their names:

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader and The Press on November 5, 2008.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1076 be placed on second reading and final passage by title only.

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1076

AN ORDINANCE AUGMENTING AND AMENDING CHAPTER 79

OF THE CODE OF THE BOROUGH OF WILDWOOD CREST, COUNTY

OF CAPE MAY AND STATE OF NEW JERSEY , VEHICLE AND TRAFFIC,

ARTICLE II PROHIBITED PARKING: PROHIBITED STOPPING OR STANDING

With regard to the New Jersey Avenue Streetscape, the Clerk reported that the Borough has received correspondence indicating that the UEZ funding request had been approved and based upon that confirmation, the project will be able to be dealt with in the fall of 2009.

 

Concerning the beach maintenance permit application process, the Clerk reported that he attended a meeting with Mr. Cabrera, the Borough Engineer, the Superintendent of Public Works, and he has circulated a report of that meeting provided by the Engineer. The Clerk advised that report addressed four points that will hopefully enable the Borough to obtain the beach maintenance permit. It does take into account concerns expressed by the Environmental Commission, specifically, that raking of the beach not take place for the entire twelve month period. The new period being proposed is from April 15th through October 14th yearly. Additionally, there are restrictions between the bulkhead and the dune line in certain areas, as well as it being the intention of the Borough to provide additional Christmas tree “plantings” to enhance the dunes. He added that it was intended that the letter would be sent to the DEP within the week so that the required timeline will be met.

 

As to the proposed professional planner for the New Jersey Avenue streetscape, the Clerk indicated that there would be an opportunity prior to the end of the summer to enable the hiring of a professional planner in conjunction with the UEZ funding approval. He added that there is an additional firm with a track record for those types of improvements with whom discussions could be held.

 

The Clerk next reported that the Environmental Commission has requested that the governing body consider an ordinance to require replacement and/or compensation from private firms or businesses that would cause environmental damage to portions of the beach or dunes. He added that the Borough has an ordinance (Chapter 8) dealing with many issues regarding the beach, but he was not aware of any requirement for compensation for damage. Mr. Cabrera inquired if the Borough’s Municipal Court would have jurisdiction. The Clerk responded that without a specific requirement in the ordinance, the Judge would not be able to order compensation to the Borough. Mr. Groon added that the court does not have the latitude to require compensation other than a fine. The Clerk stated that if there was interest by the governing body, he would recommend that the Solicitor draft a proposed ordinance for the governing body’s review.

 

Mrs. Gould inquired if, now that the street work is completed in the vicinity of the Captain’s Table, would the parking meters be replaced in that area. The Engineer responded that the Traffic Maintenance crew has already commenced that work.

RESOLUTION NO. 28-09

(Closed session: personnel re: health benefits; potential land acquisition: Crest Memorial School; contract negotiations regarding COWCO renewal agreement and long range plan for uniform construction code office operations; Borough’s continued participation in the County library system)

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

(The specific items authorized for the closed session discussion were: status update on the UIU contract negotiations, potential land acquisition: Crest Memorial School , COWCO renewal agreement along with long range plans for Uniform Construction Code Office Operations.
