Minutes of Commissioners Meeting - July 16, 2007
Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

Mrs. Gould read the following statement: In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said special meeting by posting notice on the bulletin board in the Borough Hall and by fax transmitting and mailing same to the Gazette-Leader and The Press on Wednesday, July 11, 2007 at 4:30 p.m.
Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.
The Clerk indicated for those present that the purpose of this Special Meeting was to discuss and potentially authorize a Settlement Agreement with NJDEP regarding Tier A Municipal Stormwater Permit. He added that consideration of adoption of the authorizing resolution would be conditioned upon payment by Van Note-Harvey Associates of the mutually agreed upon assessment fee, in the amount of $2,500.00 – said negotiated agreement between Van Note Harvey and representative(s) of the DEP to fully resolve all outstanding issues in this matter - and that all costs associated with this settlement, including but not limited to the agreed upon assessment fee, shall be borne exclusively by Van Note-Harvey Associates.
On the basis of the foregoing, THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:
RESOLUTION NO. 565-07
(Authorizing execution of a settlement agreement, by the Mayor and Borough Clerk, regarding the Tier A Municipal Stormwater Permit, said authorization being made with the full understanding that all fees to be paid and costs incurred shall be borne by Van Note-Harvey Associates)
Mr. Cabrera motioned, seconded by Mrs. Gould, that the foregoing Resolution be adopted.
There being no further discussion, Mrs. Gould motioned, seconded by Mr. Cabrera, that the meeting be adjourned.
