Minutes of Commissioners Meeting   -   October 10, 2007

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Commissioners’ Meeting Room at 9:30 a.m.  On roll call the following answered to their names:

Gould - Cabrera – Groon – Yes

 

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader and The Press on November 9, 2006.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION 623-07

(Authorizing submission of an application to the New Jersey DLGS for participation by the Borough in the E-Procurement Pilot Program)

 

Mr. Groon motioned, seconded by Mrs. Gould, that the foregoing Resolution be adopted.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 624-07

(Authorizing re-appointment of Randolph Lafferty as Municipal Prosecutor)

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 625-07

(Authorizing observation of Trick-or-Treat to be between the hours of 5:00 p.m. and 7:00 p.m. on Wednesday, October 31, 2007)

 

Mr. Groon inquired if the date and time for trick-or-treat had been coordinated with Wildwood and North Wildwood. The Clerk responded that it had not. Mrs. Gould interjected that it has always been on October 31st with the exception of one year when Frank McCall was Mayor. The Clerk added that the Borough has, in the past, designated the 31st as trick-or-treat unless it fell on a Sunday. Mr. Groon agreed to designating the 31st, but added that he would like the hours to be coordinated with Wildwood and North Wildwood in order to avoid cross-over trick-or-treating. The Clerk indicated he would advise Wildwood and North Wildwood of the hours designated by Wildwood Crest and request that they employ the same date and hours.

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 626-07

(Authorizing award of contract to Bud Concrete, Inc., in the total amount of $41,720 for 2007 concrete gutter replacement)

 

Mr. Cabrera motioned, seconded by Mr. Groon, that the foregoing Resolution be adopted.

Mrs. Gould motioned, seconded by Mr. Cabrera, that all bills properly authorized, as submitted and which appear in full on the following page, be paid.

The Clerk reported that the Commissioner of Public Works is in the process of working on the DEP Recycling/Solid Waste Management Plan Requirements with the Superintendent of Public Works, in conjunction with an ordinance amendment by the Solicitor, to bring the Borough into compliance. Mr. Cabrera indicated that the State of New Jersey DEP is requesting more strict enforcement of recycling regulations. He added that there are some internal moves to be made by the Public Works Department, pending personnel discussions, and he will report back to the governing body after those discussions are complete. He indicated that the changes are required to be made by the end of 2007.

 

The Clerk reported that the grant application for the Rambler Road project has been submitted to the State of New Jersey by the grants coordinator, and he will keep the governing body apprised of any developments.

 

The Solicitor drafted an ordinance requiring designation of a condominium association representative for service of notices by the Borough, and a copy was provided to the governing body. The Clerk brought to the attention of the governing body and the solicitor that on page two of the draft the Clerk’s Office was designated to receive the representative information, and it was his suggestion that the Tax Assessor should be designated to receive the information. Mrs. Gould agreed with the Clerk. The Solicitor indicated that her rationale for designating the Clerk was made after discussions with the Municipal Court Judge with regard to enforcement, and to tie that in with the mercantile licenses. Mr. Groon interjected that it would be his opinion that the Assessor is more equipped to receive that information, and should enforcement be necessary, it could be turned over to the code enforcement office. The Clerk added that any property ownership information with regard to mercantile licenses is received by his office from the Assessor. Mr. Groon reminded the governing body that with the new network, the code enforcement office has the ability to download information from the Assessor’s office.

 

With regard to the amendment of the UEZ ordinance, the Clerk reported that his office had contacted the other municipalities to ascertain the status of their UEZ ordinances, and it was learned that none of those municipalities had introduced an ordinance. Mr. Groon interjected that it was his understanding that Wildwood had introduced their ordinance on October 9, 2007. Mrs. Gould indicated that there was a meeting of the UEZ Board scheduled for Wednesday, October 17, 2007 and she would see that one of the Borough’s representatives attends that meeting as she will be absent. The Clerk advised Mrs. Gould to be sure to advise the UEZ director that the Borough of Wildwood Crest has had an ordinance drafted since July and is willing to consider the amendment once confirmation is received from the other member municipalities.

 

The Clerk reported that he had received communication from the State of New Jersey, Department of Health and Senior Services, dated September 2007, although received on October 4, 2007, regarding PEOSH Indoor Air Quality standards. He indicated that the requirements are directly related to HVAC systems, and that each municipality must provide a written plan and designation of a person with responsibility to assure compliance with the Administrative Code. He added that his office would be willing to assist with the development of the plan, in conjunction with the Solicitor, but based on the requirements for testing, the individual designated should be the Superintendent of Public Works. Mr. Cabrera concurred with the Clerk’s recommendation. Mr. Groon inquired if the Superintendent’s job description would have to be amended. The Clerk responded that it can be done by Resolution to indicate these additional duties, but added that a job description controlled by the Department of Personnel cannot be amended.

 

Ann Fitzgerald appeared to discuss the 2007 Hydrofest. Mr. Cabrera indicated that the event was a “huge, huge success” and thanked Ms. Fitzgerald and the volunteers for their efforts. John Fitzgerald complimented the Borough of Wildwood Crest, every department, for going “above and beyond” in making the event a success. Mr. Groon thanked Mr. Fitzgerald, on behalf of the Department Heads, for their kind words.

(Closed Session – Personnel Matters)

 

Mrs. Gould motioned, seconded by Mr. Groon, that the foregoing Resolution be adopted.
