Minutes of Commissioners Meeting   -   October 25, 2006

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County , New Jersey , was held in the Municipal Court Room at 7:00 p.m.  On roll call the following answered to their names:

Gould - Cabrera – Groon – Yes

 

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader and The Press on November 10, 2005.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1018 be placed on second reading and final passage by title only.

THE CLERK RED THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1018

BOND ORDINANCE PROVIDING FOR IMPROVEMENT OF THE SANITARY SEWERAGE SYSTEM IN AND BY THE BOROUGH OF WILDWOOD CREST, IN THE COUNTY OF CAPE MAY, NEW JERSEY, APPROPRIATING $150,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $142,800 BONDS OR NOTES OF THE BOROUGH FOR FINANCING SUCH APPROPRIATION

Mrs. Gould motioned, seconded by Mr. Cabrera, that a public hearing be held on Ordinance No. 1018.

There being no public comments, Mrs. Gould motioned, seconded by Mr. Cabrera, that the public hearing on Ordinance No. 1018 be closed.

Mrs. Gould motioned, seconded by Mr. Cabrera, that Ordinance No. 1018 be passed on second and final reading and advertised according to law.

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1019

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 23, COURT: MUNICIPAL, OF THE CODE OF THE BOROUGH OF WILDWOOD CREST, COUNTY OF CAPE MAY , STATE OF NEW JERSEY , AND AMENDING ORDINANCE NO. 150 ADOPTED JUNE 13, 1948

Mrs. Gould motioned, seconded by Mr. Cabrera, that a public hearing be held on Ordinance No. 1019.

Bob Young, 207 East Louisville Avenue , inquired as to the reason for this pending ordinance after so many years. The Clerk responded that the changes are not to anything that has not been approved by the Municipal Court Judge, as well as the requirement to be in compliance with Chapter 293 of the Public Laws of 1993. Additionally, the State of New Jersey requires usage of the formal title of “Court Administrator” rather than the “outdated” title of Court Clerk.

There being no additional public comments, Mrs. Gould motioned, seconded by Mr. Cabrera, that the public hearing on Ordinance No. 1019 be closed.

ORDINANCE NO. 1020

BOND ORDINANCE APPROPRIATING $1,835,000, AND AUTHORIZING THE ISSUANCE OF $1,747,400 BONDS OR NOTES OF THE BOROUGH, FOR THE VARIOUS IMPROVEMENTS OR PURPOSES AUTHORIZED TO BE UNDERTAKEN BY THE BOROUGH OF WILDWOOD CREST, IN THE COUNTY OF CAPE MAY , NEW JERSEY

Mrs. Gould motioned, seconded by Mr. Cabrera, that a public hearing be held on Ordinance No. 1020.

There being no public comments, Mrs. Gould motioned, seconded by Mr. Cabrera, that the public hearing on Ordinance No. 1020 be closed.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 365-06

(Authorizing refund of duplicate tax payment in the amount of $350 to Donna Orr for 130 East Forget-Me-Not Road )

 

Mrs. Gould motioned, seconded by Mr. Groon, that the foregoing Resolution be adopted.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 366-06

(Authorizing refund for ambulance transport duplicate payment in the amount of $59.48 to Eleanor M. Townley)

 

Mrs. Gould motioned, seconded by Mr. Groon, that the foregoing Resolution be adopted.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 367-06

(Authorizing submission of a grant application in the amount of $2,000 under the Buckle Up South Jersey Seat Belt Initiative)

 

Mrs. Gould motioned, seconded by Mr. Groon, that the foregoing Resolution be adopted.

Mrs. Gould motioned, seconded by Mr. Groon, that all bills properly authorized, as submitted and which appear in full on the following page, be paid.

Mrs. Gould motioned, seconded by Mr. Groon, that all reports received, from the Court Administrator, CFO, Tax Collector and Chief of Police, be accepted as presented and filed.

Mrs. Gould motioned, seconded by Mr. Groon, that the minutes of meetings held September 27, and October 11, 2006, and the special meeting of October 19, 2006, as well as the closed session minutes of October 11, 2006, be approved as presented.

Robert Young, 207 East Louisville Avenue , commented on the on-going street reconstruction in the Borough and inquired why the residents are not notified by the contractor that the street will be under construction during a given period. Mr. Cabrera responded that notice should be given, especially if the water is going to be turned off during construction, and the engineer should be providing notice as well. He added that there is a process and he will take care of seeing that the process if followed.

 

Mr. Young also inquired if the Borough can limit the size and weight of trucks on the newly reconstructed streets. The Chief of Police responded that if there is construction taking place on a street that is not on the truck route, the Borough cannot prevent trucks from getting to the construction site, even if they must travel on the residential street to do so. The Chief added that as long as the truck is legally registered, under state law they cannot be prevented from utilizing a street to get to a construction site. Mr. Young inquired if the Borough receives funding for the streets. The CFO responded that the only funding the Borough receives is from the Transportation Trust Fund Authority, but that is not guaranteed funding. Mr. Young stated his opinion that the Borough should be permitted to limit the weight if the Borough is paying for the reconstruction of the streets.

 

Mr. Young then inquired as to the number of Planning and Zoning Board Members who have completed the New Jersey Land Use Seminars. Mrs. Gould responded that “all” of the members have completed the course.

 

Mr. Young also commented on the Borough’s participation in JCOW and the situation as it presently exists.

 

There being no additional public comments, THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 368-06

(Closed session – JCOW Litigation)

 

The Clerk indicated that the specific purposes for this closed session were with respect to the ongoing JCOW litigation and continued membership therein, as well as compliance with the County Revaluation Order and that the board will deliberating in closed session immediately upon adoption of the required resolution and that the discussion will be released to the public upon conclusion of the matter. He added that it was intended that formal action may be taken upon resumption of the open session.

Mrs. Gould motioned, seconded by Mr. Groon, that the foregoing Resolution be adopted.

Upon returning from closed session, and there being no further discussion, Mrs. Gould motioned, seconded by Mr. Cabrera, that the meeting be adjourned.
