Minutes of Special Commissioners Meeting   -   October 11, 2006

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County , New Jersey , was held in the Commissioners’ Meeting Room at 9:30 a.m.  On roll call the following answered to their names:

Gould - Cabrera – Groon – Yes

 

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader and The Press on November 10, 2005.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

The Clerk advised those present that the second reading, public hearing, and final adoption on Ordinances No. 1018, 1019 and 1020 would not be held as scheduled since the Cape May County Herald failed to publish all three pending ordinances as directed on September 28, 2006 at 9:03 a.m. The second reading, public hearing and final adoption for Ordinances No. 1018, 1019, and 1020, on the basis of the foregoing shall be held on Wednesday, October 25, 2006 at 7:00 p.m.

 

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 357-06

(Authorizing acceptance of proposed amendments to the Atlantic County Municipal JIF By-Laws)

 

Mrs. Gould motioned, seconded by Mr. Groon, that the foregoing Resolution be adopted.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 358-06

(Authorizing observation of Trick or Treat to be between the hours of 5 pm and 7 pm on Tuesday, October 31, 2006)

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

RESOLUTION NO. 359-06

(Urging adoption of A-3444/S-2183 regarding CAP relief/banking)

 

Mr. Groon motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 360-06

(Authorizing submission of a “discretionary aid application” to the NJDOT for improvements to the existing bicycle path and rescinding the former resolution which south to extend the bicycle path)

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 361-06

(Authorizing award of contract to Albrecht & Heun, Inc. in the total bid amount of $1,818,250 for the Sunset Lake Shoreline Stabilization Project)

 

Prior to motion and vote, the Clerk reported that the Project Engineer and the Borough Solicitor have approved the bid for technical and legal compliance with the bid specifications, respectively. He added that the Project Engineer verbally advised him that approval has been received from the Department of Environmental Protection. The Solicitor interjected that the amount being awarded includes the Alternate Bid.

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

Mrs. Gould motioned, seconded by Mr. Cabrera, that all bills properly authorized, as submitted and which appear in full on the following page, be paid.

A discussion was held with regard to possibly adopting a new logo for the Borough to replace the “Brigantine Nancy.” Mrs. Gould indicated that she has been told that the “Brigantine Nancy” is actually not a brigantine. The Clerk stated that it was his understanding that when the Borough was incorporated in 1910 the “Brigantine Nancy” was part of the seal during that incorporation. Mr. Groon inquired if the Borough has an obligation to utilize the same logo. The Clerk responded, “whatever you wish to use in terms of the logo.” Mr. Groon stated that the existing logo is not utilized Borough-wide. Mrs. Gould concurred, stating that the police have their own logo, as well as Public Works and Public Safety. It was Mr. Groon’s opinion that the Borough should have one logo that represents the entire community as opposed to each department having a different logo. He suggested that the community, and perhaps the school, be involved in the process of developing a new logo that can be used on all of the Borough’s vehicles.

Mrs. Gould concurred. Mr. Groon suggested that the Clerk and Solicitor look into the matter of the incorporation as it relates to the Borough’s logo. Mr. Cabrera concurred that the suggestion was “on the right track,” but questioned whether a professional designer or graphic artist should be utilized to design an “official” logo. Mr. Groon stated that the idea would come from the community and that idea would be taken to a professional to design. Mrs. Gould agreed with Mr. Groon. She suggested that a flyer could be inserted in the next Borough mailing and posted on the website. Mr. Groon suggested that the Commissioners think about the matter for a couple of weeks before making a final determination.

 

There being no public comments, and given the fact that the Board was determined to go into closed session for the purpose of discussing compliance with the County Revaluation Order as well as ongoing JCOW litigation and the borough’s continued membership therein, THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 362-06

(Closed session – Litigation/negotiations with respect to JCOW; compliance with the County Revaluation Order)

 

Mrs. Gould motioned, seconded by Mr. Cabrera, that the foregoing Resolution be adopted.

Vote:          Gould-Cabrera-Groon-Yes

The Clerk also advised that the closed minutes would be released at the conclusion of the matter, that formal action may be taken upon resumption of the open portion of the meeting, at which time all interested parties would be welcomed back into the meeting.

 

Upon returning from closed session, there being no additional discussion, Mrs. Gould motioned, seconded by Mr. Cabrera, that the meeting be adjourned.
