Minutes of Commissioners Meeting   -   November 21, 2011

Wildwood Crest, NJ

Prior to the opening of the meeting, Mr. Groon led those present in the Pledge of Allegiance to the Flag.

 

The meeting of the Board of Commissioners, Borough of Wildwood Crest, Cape May County, New Jersey, was held in the Municipal Court Room at 7:00 p.m.  On roll call the following answered to their names:

 

Gould - Groon – Yes

Cabrera - Absent

 

Mr. Groon read the following statement:  In compliance with the Open Public Meeting Act, Chapter 231, P.L. 1975, the notice requirements have been satisfied as to the time, place and date of holding said meeting by posting notice on the bulletin board in the Borough Hall and by mailing same to the Gazette-Leader, the Herald and The Press on November 29, 2010.

 

Mr. Groon next announced the one-way in and the one-way out method of ingress and egress in case of emergency.

 

Mrs. Gould motioned, seconded by Mr. Groon, that Ordinance No. 1133 be placed on second reading and final passage by title only.

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1133

 

AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 75, TRAILERS, TEMPORARY DWELLINGS AND STRUCTURES, OF THE CODE OF THE BOROUGH OF WILDWOOD CREST, COUNTY OF CAPE MAY, NEW JERSEY

 

Mrs. Gould motioned, seconded by Mr. Groon, that a public hearing be held on Ordinance No. 1133.

Bill Shalaka inquired as to the purpose of including the setback restrictions in the ordinance. He was advised that the purpose was to maintain uniformity.

 

There being no further public comments, Mrs. Gould motioned, seconded by Mr. Groon, that the public hearing on Ordinance No. 1133 be closed.

THE CLERK READ THE FOLLOWING ORDINANCE BY TITLE ONLY:

ORDINANCE NO. 1134

 

A CAPITAL ORDINANCE PROVIDING FOR THE ACQUISITION OF PUBLIC WORKS VEHICULAR EQUIPMENT AND APPROPRIATING THEREFOR THE AMOUNT OF $29,000 FROM CAPITAL IMPROVEMENT FUND

 

Mr. Groon motioned, seconded by Mrs. Gould, that a public hearing be held on Ordinance No. 1134.

There being no public comments, Mrs. Gould motioned, seconded by Mr. Groon, that the public hearing on Ordinance No. 1134 be closed.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 657-11

WHEREAS, BRENDAN SCIARRA, 212 East St. Louis Avenue, Wildwood Crest, New Jersey 08260, made application before the Wildwood Crest Planning Board on August 23, 2011 for minor subdivision with no variances for Block 12, Lots 27, 28 and 29, a/k/a 112 East Buttercup Road, Wildwood Crest, New Jersey; and

 

WHEREAS, BRENDAN SCIARRA has requested the return of the unused escrow fee of $600.00; and

 

WHEREAS, the Planning Board of the Borough of Wildwood Crest, by Resolution No. A-11-13 of said Board dated November 2, 2011, has recommended that the escrow fee as referenced above be returned to BRENDAN SCIARRA;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that the Chief Financial Officer of the Borough of Wildwood Crest be and he is hereby authorized and directed to cause a refund of escrow fee of $600.00 to be made to BRENDAN SCIARRA, 212 East St. Louis Avenue, Wildwood Crest, New Jersey 08260, for the reasons set forth above.

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

RESOLUTION NO. 658-11

 

WHEREAS, on October 31, 2011 , MR. TIMOTHY COOPER & MS. HEATHER SLOWAKIEWICZ , 349 E. Myrtle Ave. , Feasterville, PA 19053 , applied for a Special Events Permit for the purpose of a WEDDING   to be held on June 9, 2012 ,  from 3:00 p.m. to 5:00 p.m., on the beach between Hollywood Ave. and Topeka Ave. ; and

                                                                                                                                               

WHEREAS, MR. TIMOTHY COOPER & MS. HEATHER SLOWAKIEWICZ, 349 E. Myrtle Ave., Feasterville, PA 19053 have supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and have further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey that the Borough Clerk be and he is hereby authorized and directed to issue a Special Events Permit to MR. TIMOTHY COOPER & MS. HEATHER SLOWAKIEWICZ, 349 E. Myrtle Ave., Feasterville, PA 19053 for the purpose of a WEDDING to be held on June 9, 2012 , from 3:00 p.m. to 5:00 p.m., on the beach between Hollywood Ave. and Topeka Ave.

THE CLERK READ THE FOLLOWING RESOLUTION IN FULL:

RESOLUTION NO. 659-11

 

WHEREAS, N.J.S.A. 40A:4-58 permits transfers between budget appropriations during the final two (2) months of the fiscal year;

 

NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Borough of Wildwood Crest, County of Cape May, New Jersey, that transfers between 2011 budget appropriations be and the same are hereby authorized as follows:

THE CLERK READ THE FOLLOWING RESOLUTION BY TITLE ONLY:

WHEREAS, on November 9, 2011, the GREATER WILDWOOD JAYCEES, P.O. Box 63, Wildwood, NJ 08260 applied for a Special Events Permit for the purpose of a Christmas Parade to be held on Friday, December 2, 2011 from 6:30 p.m. to 8:00 p.m., with a rain date of Sunday, December 4, 2011, on Pacific Ave. from Cresse Ave. to Heather Rd., turn around on Heather Rd. and return on Ocean Ave. to Cresse Ave., and

 

WHEREAS, the GREATER WILDWOOD JAYCEES  have supplied all documentation required under Ordinance No. 936, including the requisite Certificate of Insurance, and have further pledged to comply with all applicable rules and regulations pertaining to the conduct of said Special Event; and

 

WHEREAS, the application has been reviewed by the Board of Commissioners, upon verification by appropriate members of staff as to completeness of the application, scheduling compatibility, etc.;
